Admiralty Personal Injury<br />
LEGAL REVIEW<br />
The U.S. was named as defendant in 15 Maritime Administration personal injury cases in the<br />
admiralty jurisdiction of the Federal district courts as of September 30, <strong>2010</strong>. The potential<br />
liability arising from these matters may be up to $1 million. Although certain cases were<br />
resolved and new cases were filed in 20<strong>11</strong>, the potential liability of the Government remained<br />
approximately the same.<br />
There were 16 active personal injury cases pending against the United States in Federal district<br />
court as of September 30, 20<strong>11</strong>.<br />
Environmental Litigation<br />
In Arc Ecology, et al. v. Maritime Administration et al., 2:07-cv-02320 (E.D. Ca) case, the<br />
Maritime Administration achieved a significant milestone in complying with and meeting the<br />
deadline contained in the stipulated consent decree to dry-dock 25 vessels from the Suisun Bay<br />
NDRF fleet by the end of FY 20<strong>11</strong>.<br />
Title XI Litigation<br />
In FY 20<strong>11</strong>, the Maritime Administration successfully concluded litigation in one bankruptcy<br />
related to a Title XI company. In addition, the Maritime Administration commenced foreclosure<br />
proceedings on 5 vessels following default in payment on Title XI loan guarantee obligations.<br />
