this entire area are <strong>of</strong>fshore <strong>of</strong> Duck Cove, which will be removed. Placement <strong>of</strong> new<br />

moorings on <strong>the</strong>se submerged lands will be prohibited.<br />

5. Swimming Beach/Boat Launch Areas: No moorings shall be allowed within 100 feet<br />

<strong>of</strong> swimming beaches and boat launch ramps.<br />

There are three designated swimming areas in Tomales Bay: Shell Beach, Hearts<br />

Desire Beach and Chicken Ranch Beach. Vessel moorings are restricted from being<br />

placed within 100 feet <strong>of</strong> <strong>the</strong>se areas to eliminate <strong>the</strong> potential for sewage<br />

contamination <strong>of</strong> public swimming areas. There is one public <strong>vessel</strong> launch area in<br />

Tomales Bay. A 100-foot buffer zone around <strong>the</strong> launch area will ensure safe access<br />

to <strong>the</strong> ramp. Swimming beaches and boat launch areas are depicted in Figure 4:<br />

Public Health and Water Quality Map.<br />

6. State Parks Criteria: No moorings shall be allowed within 1000 feet <strong>of</strong>fshore <strong>of</strong> State<br />

Parks property.<br />

Currently CSP policy does not allow moorings within 1000 feet <strong>of</strong>fshore <strong>of</strong> State<br />

Parks property. The CSP no-mooring zones for Tomales Bay can be seen in Figure<br />

9: Natural Resource Protection Siting Criteria Map.<br />

7. Aquaculture: No moorings shall be allowed within areas that fail to meet <strong>the</strong><br />

California Department <strong>of</strong> Public Health calculations for safe distances between<br />

moorings and shellfish growing operations. No moorings shall be located within<br />

state water bottom lease areas for aquaculture unless directly associated with<br />

aquaculture pursuant to a valid lease, permit, license or o<strong>the</strong>r authorization issued by<br />

<strong>the</strong> State <strong>of</strong> California.<br />

Leases and permits for all aquaculture operations are administered by CDFG, while<br />

CDPH oversees <strong>the</strong> quality and safety <strong>of</strong> <strong>the</strong> harvested product. CDPH oversees<br />

shellfish monitoring programs to assure food quality and applies national ordinances<br />

and guidelines to prevent potential contaminants from human sewage by setting safe<br />

distances between <strong>vessel</strong> moorings and shellfish growing operations. These safe<br />

distances between moorings and shellfish growing operations are calculated by<br />

CDPH based on dilution ratios and must be applied on a case-by-case basis upon<br />

review <strong>of</strong> each TBMP lease application. Commercial aquaculture moorings within<br />

state water bottom lease areas are regulated by CDFG and will be excluded from this<br />

criterion.<br />

Aquaculture lease areas, as provided by CDFG, are depicted in Figure 4: Public<br />

Health and Water Quality Map. Additional information on Tomales Bay aquaculture<br />

and related potential public health impacts and agency policies and regulations can be<br />

found in <strong>the</strong> Existing Environmental Conditions section.<br />

8. Navigation Channels: No moorings shall be allowed within navigation channels <strong>of</strong><br />

Tomales Bay.<br />
