sexual harassment. Sexual assault includes<br />
what is commonly known as “rape,” whether<br />
forcible or non-forcible, “date rape” and<br />
“acquaintance rape.” Nothing contained<br />
in this definition shall be construed to limit<br />
or conflict with the sex offenses enumerated<br />
in Article 130 of the New York State Penal<br />
Law, which shall be the guiding reference in<br />
determining if alleged conduct is consistent<br />
with the definition of sexual assault.<br />
<strong>SUNY</strong> <strong>Canton</strong> has programs in place to<br />
protect all members of the campus community<br />
from sexual assault, including programs<br />
for prevention and prosecution of these<br />
crimes that occur within the jurisdiction of<br />
<strong>SUNY</strong> <strong>Canton</strong> University Police. Additional<br />

If you are sexually or otherwise assaulted<br />
on campus:<br />
—Get to a safe place as soon as you can.<br />
—If an emergency, contact <strong>SUNY</strong> <strong>Canton</strong><br />
University Police immediately at 315-386-<br />
7777 or use a Blue Light emergency phone.<br />
—Try to preserve all physical evidence.<br />
Do NOT shower/bathe/wash, douche,<br />
change/launder clothing, comb hair, drink<br />
or eat, or do anything that would alter a<br />
physical exam. Wait until after one has<br />
been completed at a hospital.<br />
— Visit http://www.canton.edu/titleix/ for<br />
Title IX contacts, complaint procedure,<br />
resources, and more.<br />
Remember, assaults – sexual or otherwise<br />
– are crimes; they are not the victim’s fault.<br />
Victims have the right to pursue adjudication<br />
of crimes that occur on the <strong>SUNY</strong> <strong>Canton</strong><br />
campus through criminal courts and/or<br />
through the University’s internal disciplinary<br />
process (under the Campus Code of <strong>Student</strong><br />
Conduct). <strong>SUNY</strong> <strong>Canton</strong>’s University Police<br />
are trained to assist with prosecution in both<br />
systems.<br />

victim of sexual assault or sexual misconduct,<br />
you may seek support services as well<br />
as the assistance described above from the<br />
Counseling Center, Campus Center 225,<br />

Disciplinary Action<br />
Where there is probable cause to believe<br />
the College’s regulations prohibiting sexual<br />
misconduct have been violated, the College<br />
STUDENT LIFE<br />
will pursue strong disciplinary action through<br />
its own channels. This discipline includes<br />
the possibility of suspension or dismissal<br />
from the College. An individual charged<br />
with sexual misconduct will be subject to<br />
college disciplinary procedures, whether<br />
or not prosecution under New York State<br />
Criminal Statutes is pending.<br />
The College will make every effort to<br />
be responsive and sensitive to the victims<br />
of these serious crimes. Protection of the<br />
victim and prevention of continued trauma<br />
is the College’s priority. When the victim<br />
and the accused live in the same residence<br />
hall, an immediate hearing with the College<br />
Judicial Officer will be held to determine<br />
the need for modifying the living arrangements.<br />
Assistance for any other personal<br />
or academic concerns will be reviewed and<br />
options provided.<br />
During the disciplinary process, the victim’s<br />
rights are:<br />
—To provide a written statement with personally-identifiable<br />
information redacted<br />
in lieu of appearing before the Hearing<br />
Board as a witness or be permitted to give<br />
testimony from a remote location.<br />
—To have a person or persons of the victim’s<br />
choice accompany the victim throughout<br />
the disciplinary hearing.<br />
—To remain present during the entire<br />
proceeding.<br />
—As established in State criminal codes,<br />
to be assured that his/her irrelevant past<br />
sexual history will not be discussed during<br />
the hearing.<br />
—To make a “victim impact statement” and<br />
to suggest an appropriate penalty if the<br />
accused is found in violation of the Code<br />
of <strong>Student</strong> Conduct.<br />
—To be informed immediately of the outcome<br />
of the hearing.<br />
— During the disciplinary process, the rights<br />
of the “accused” are as described under Section<br />
15.6, Article VI: Adjudication and/<br />
or Section 15.9, Article IX: Procedures<br />
for Judicial Hearings.<br />
—To have access to all statements and<br />
documents provided to the accused in a<br />
judicial hearing.<br />
—To have the right to an appeal.<br />

20.5 Workplace Violence<br />
<strong>SUNY</strong> <strong>Canton</strong> is committed to providing<br />
a safe work environment for all employees<br />
that is free from intimidation, threats, and<br />
violent acts. The College will respond<br />
promptly to threats, acts of violence, and<br />
acts of aggression by employees or against<br />
employees by co-workers, members of the<br />
public, or others.<br />
<strong>SUNY</strong> <strong>Canton</strong> will not tolerate any act<br />
or threat of violence made in the workplace,<br />
on College property, or while in work status.<br />
No person may engage in violent conduct or<br />
make threats of violence, implied or direct,<br />
on <strong>SUNY</strong> <strong>Canton</strong> property or in connection<br />
with college business. This includes, but<br />
is not limited to: (1) the use of force with<br />
the intent to cause harm; (2) behavior that<br />
dimin-ishes the dignity of others through<br />
sexual, racial, religious, or ethnic disparagement,<br />
or harassment; (3) acts or threats<br />
which are in-tended to intimidate, harass,<br />
threaten, bully, coerce, or cause fear of harm<br />
whether directly or indirectly; or (4) acts or<br />
threats made directly or indirectly by oral<br />
or written words, gestures, or symbols that<br />
communicate a direct or indirect threat of<br />
physical or mental harm. No person, without<br />
legal authority, may carry, possess, or use<br />
any dangerous weapon on <strong>SUNY</strong> <strong>Canton</strong><br />
property or in college buildings or facilities.<br />
Unauthorized possession or use of firearms,<br />
knives (except non-spring pocket knives), or<br />
other weapons or explosives is prohibited.<br />
Incidents of workplace violence, threats<br />
of workplace violence, or observations of<br />
workplace violence are not to be ignored<br />
by any member of the <strong>SUNY</strong> <strong>Canton</strong><br />
community. Workplace violence should be<br />
promptly reported to University Police at<br />
(315) 386-7777. Additionally, all members<br />
of the college community are encouraged<br />
to report behavior they reasonably believe<br />
poses a potential for workplace violence in<br />
order to maintain a safe working and learning<br />
environment. Every threat will be taken<br />
seriously and must be reported. Employees<br />
who commit a violent act or threaten to commit<br />
a violent act are subject to disciplinary<br />
action and/or civil/criminal prosecution as<br />
appropriate. Any individual who makes a<br />
substantial threat, exhibits threatening behavior,<br />
or engages in violent acts on <strong>SUNY</strong><br />
<strong>Canton</strong> property shall be subject to removal<br />
from the premises as quickly as safety permits,<br />
pending the outcome of an investigation.<br />
