"<strong>Langford</strong> Zoning Bylaw, Amendment No. 327 (1004 Fashoda Place), 2011".<br />

The Mayor opened the Public Hearing for Bylaw No. 1365 at 7:01 p.m.<br />

Mayor Young advised members <strong>of</strong> the audience that any person present who believes that his or her<br />

interest is affected by the proposed bylaws shall be given an opportunity to be heard on the matters<br />

contained in the proposed bylaw. Those who wish to speak concerning this proposed bylaw should give<br />

their name, address and views concerning the proposed bylaw. Mayor Young advised that after<br />

everyone has expressed their views, he shall state three times "Is there anyone else who wishes to be<br />

heard", and if no further views are forthcoming, the Public Hearing shall be declared closed.

The <strong>City</strong> Planner advised that Sam Edmundson has applied to amend the zoning designation <strong>of</strong> 1004<br />

Fashoda Place and that the purpose <strong>of</strong> the Public Hearing was to hear from the public regarding Bylaw<br />

No. 1365 which, if adopted, would amend the zoning designation <strong>of</strong> 1004 Fashoda Place from AGl<br />

(Agriculture 1) to RS3 (Small Lot Residential 3) and R2A (One- and Two-Family Residential) to allow a<br />

five-lot residential subdivision.<br />

As part <strong>of</strong> the rezoning application, a public hearing is required in accordance with the regulations <strong>of</strong> the<br />

Local Government Act.<br />

In support <strong>of</strong> the rezoning, the applicant has agreed to provide the following contributions toward the<br />

General Amenity Reserve Fund:<br />

1. $9,300 per lot;<br />

2. $4.19 perm 2 <strong>of</strong> lot area; and<br />

3. A contribution equal to 10% <strong>of</strong> the total market value <strong>of</strong> the property after rezoning.<br />

This proposal is consistent with the Official Community Plan 'Neighbourhood' designation. Notifications<br />

and advertisements have been placed as required by Council policy.<br />

The Mayor called a first time for presentations.<br />

Mr. Glen Willing <strong>of</strong> 739 Willing Drive addressed Council with respect to drainage concerns.<br />

Mayor Young called a second time for presentations.<br />

The Mayor called a third and final time for presentation, there being none, the Mayor <strong>of</strong>ficially declared<br />

the Public Hearing for Bylaw No. 1365 closed at 7:06 p.m.<br />

Exhibition decided to go floral for its theme this<br />

year, who better to <strong>of</strong>fer their assistance than<br />

Community Showcase: <strong>City</strong> <strong>of</strong> <strong>Langford</strong><br />

<strong>City</strong> Centre Park is <strong>Langford</strong>'s showcase multi-purpose recreation centre, located in the<br />

heart <strong>of</strong> this fast-growing community.<br />

On land donated by the neighbouring Westhills master-planned community, <strong>City</strong> Centre Park<br />

has something for everyone.<br />

The development <strong>of</strong> a dry-floor arena, playzone and minigolf made up the first phase <strong>of</strong><br />

development, and this was followed quickly by the construction <strong>of</strong> two all-weather turf fields,<br />

a small stadium, a lake surrounded by walking trails and exercise stations, a water play<br />

park, an ice arena with both indoor and outdoor skating areas, a 10-pin bowling facility and<br />

a facility that will become the national headquarters for Rugby Canada.<br />

<strong>City</strong> Centre Park is the realization <strong>of</strong> a vision for community recreation that was expressed by<br />

the citizens <strong>of</strong> <strong>Langford</strong> at a series <strong>of</strong> public open houses in January 2008.<br />

Community Showcase:<br />

District <strong>of</strong> Peachland<br />

Swim Bay Wheel Chair Ramp<br />

Swim Bay is a favorite waterfront park<br />

which, during the summer months, is the<br />

hub <strong>of</strong> the community.<br />

In the Centennial year <strong>of</strong> 2009, the<br />

Lions Club partnered with the District <strong>of</strong><br />

Peachland to provide wheelchair access<br />

to this swim area.<br />

Ideally situated because <strong>of</strong> its proximity<br />

to seasonal lifeguards, the ramp allows<br />

individuals who are mobility challenged<br />

to easily access the water, swim safely<br />

and enjoy the Okanagan lifestyle.<br />

The ramp is also used by children <strong>of</strong> all<br />

ages who like to play in the shallow<br />

water. It is also an ideal exit point for<br />

both triathlon and swim races that<br />

happen on the waterfront.<br />

1. Application for a Development Variance Permit for the 4 lot subdivision at 960 Isabell Avenue.<br />

The applicant is applying to vary the Subdivision and Development Servicing Bylaw No. 1000<br />

requirement for a cul-de-sac to nil, and a 23m (75ft) section <strong>of</strong> sidewalk to nil and the<br />

applicant is proposing to provide a two point turnaround for vehicle turning movements Staff<br />

That Council:<br />

1. Proceed with consideration <strong>of</strong> a Development Variance Permit No. DVP-11-0011 for 960<br />

Isabell Avenue, with the following variances:<br />

i. That Section 4 in Subdivision and Development Servicing Bylaw No. 1000 be varied<br />

to eliminate the required cul-de-sac and sidewalk to nil for 960 Isabell Avenue,<br />

subject to the following condition:<br />

a. That the applicant provide a sign and thermoplastic line painting stating "No<br />

Parking - Fire Lane" in the fire truck turnaround area to the satisfaction <strong>of</strong><br />

the Fire Chief; and<br />

b. That the turnaround area be to the satisfaction <strong>of</strong> the <strong>City</strong> Engineer and Fire<br />

Chief and be determined prior to subdivision approval.<br />

2. Application to Vary Section 9.6 <strong>of</strong> the Subdivision and Development Servicing Bylaw No. 1000<br />

by Allowing Single Phase Transmission Systems to Remain Aboveground at 2381 Fleetwood<br />

Crt; 2389 Fleetwood Crt (DVP11-0024)<br />

That Council direct staff to proceed with consideration <strong>of</strong> the following variance for 2381 and<br />

2389 Fleetwood Court:<br />

a) That Section 9.6 <strong>of</strong> the Subdivision and Development Servicing Bylaw No. 1000 is varied<br />

by allowing single phase transmission systems in the Fleetwood Court frontage <strong>of</strong> the<br />

subdivision to remain aboveground.<br />

3. Application to vary the distance that a building or structure may be located from the interior<br />

side lot line from 1.5 m (5 ft) to 0.3 m (1 ft) to allow for an addition comprising an attached<br />

workshop with habitable floor space above at 2719 Scafe Road (DVP11-0025)<br />

That Council proceed with consideration <strong>of</strong> Development Variance Permit No. DVP11-0025 for<br />

the property at 2719 Scafe Road, with the following variance:<br />

a. That Section 6.21.06(l)(b) <strong>of</strong> Zoning Bylaw No. 300 is varied by reducing the distance<br />

that a building or structure may be located from the interior lot line from 1.5 m (5 ft) to<br />

0.3 m (1 ft) for the proposed addition at 2719 Scafe Road.

Proposed Agreement with BC Ambulance Service (BCAS)<br />

Background<br />

Over the past year and a half, staff have been working closely with the British Columbia Ambulance<br />

Service (BCAS) to relocate their existing Vancouver Island Ambulance Dispatch Center currently located<br />

in Saanich to <strong>Langford</strong>. Staff are pleased to advise that the <strong>City</strong> has received a signed <strong>of</strong>fer to lease a<br />

purpose built facility from the <strong>City</strong> to house the Dispatch Center and Ambulance Station.<br />

The Agreement (attached) with BCAS provides for the <strong>City</strong> <strong>of</strong> <strong>Langford</strong> building and lease back to the<br />

BCAS a two storey, post disaster designed building that would house a 4 bay ambulance station on the<br />

main level, with the second floor occupied as the Vancouver Island Ambulance Dispatch Center on Leigh<br />

Road just south <strong>of</strong> the TCH. The lease would be structured to pay all the costs associated with the<br />

facility.<br />

Operationally, considering response times are critical to medical emergencies it would be a significant<br />

benefit to <strong>Langford</strong> residents to have a post-disaster built, 4 bay ambulance station centrally located in<br />

our community. The fact that the building will have excellent access to both provincial and municipal<br />

roads, due to close proximity to the Spencer Road Interchange, which is proposed to be completed<br />

around the same time as the opening <strong>of</strong> the facility, is also a benefit. As well, relocating the dispatch<br />

personnel to a new state <strong>of</strong> the art BCAS 911 dispatch facility will bring additional employment and new<br />

families to our community.<br />

Options<br />

That Council:<br />

1. Agree to the terms <strong>of</strong> the <strong>of</strong>fer and direct staff to prepare the necessary lease agreement for<br />

signature by the Mayor and Corporate Officer; or<br />

2. Advise BCAS that it is not prepared to enter into the agreement as proposed.<br />

encroachment agreement with the <strong>City</strong>, regarding an existing mortared masonry wall that was<br />

constructed on Mr. Sidhu's property. When surveyed by Scansa Construction Ltd., the wall was found<br />

to straddle <strong>City</strong> <strong>of</strong> <strong>Langford</strong> property. Please see the attached sketch and photos <strong>of</strong> wall.<br />

COMMENTARY<br />

As the wall was constructed at the cost <strong>of</strong> the owner, it is not practical to re-build the wall. The wall as<br />

constructed does not pose any danger to the public. The wall retains existing back fill that is stock<br />

piled nearby adding to usable 'back-yard' space forthe resident (to the extent <strong>of</strong> the property line).<br />

The terms <strong>of</strong> the Encroachment Agreement if approved would be for the life <strong>of</strong> the structure and be an<br />

agreement with the property owner. Any change <strong>of</strong> owner would result in Council's ability to reconsider<br />

the encroachment. Staff propose to amend the agreement to include the statement that any<br />

costs related to the removal and or repair <strong>of</strong> the wall would be borne by the owners, not the <strong>City</strong>.<br />

The retaining wall exceeds 4 feet in height; therefore a pr<strong>of</strong>essional engineer's review was required and<br />

has been provided.<br />

FINANCIAL IMPLICATIONS<br />

This letter summarizes our meeting <strong>of</strong> September 21 at the above site. Of interest is the mortared<br />

stone retaining wall along the rear property line. Photos are appended.<br />

The grade difference between the front and back <strong>of</strong> the wall will be approximately 1.0 m. The<br />

wall has a substantial base approximately 0.5 m wide. The wall will be backfilled with shotrock<br />

stockpiled nearby on the <strong>City</strong> <strong>of</strong><strong>Langford</strong> Parks property.<br />

The wall is suitable for the intended purpose <strong>of</strong> retaining higher ground on the <strong>City</strong> <strong>of</strong><strong>Langford</strong><br />

properly behind the subject lot. Wall backfill should be graded level w ithin 1.2 m <strong>of</strong> the property<br />

boundary.<br />

Commentary<br />

A BYLAW TO AUTHORIZE A HOUSING AGREEMENT<br />

WHEREAS the owner <strong>of</strong> land in the <strong>City</strong> has applied to rezone the land legally described as<br />

PID No. 000-192-490, Parcel "A" (DD 140453-1), Section 84, Metchosin District, Except Part in<br />

Plan 6521 and Except Parcel No. 1 (DD 1971001) and PID No. 005-396-662, Amended Lot 3<br />

(DD 3161161), Section 84, Metchosin District, Plan 9835 (the "Land") to permit the construction<br />

<strong>of</strong> ten or more single-family residential dwellings; and<br />

the Land to be registered as a covenant against proposed Lots 1, 20, 21 & 28, shown on<br />

Schedule "A".<br />

2. The Mayor and Administrator <strong>of</strong> the <strong>City</strong> are authorized to execute the Form C housing<br />

agreement and the Administrator is authorized to sign and file in the Land Title Office a<br />

notice <strong>of</strong> the housing agreement, as required by the Local Government Act.<br />

Road Closure Bylaw<br />

WHEREAS, pursuant to Section 40 <strong>of</strong> the Community Charter, Council may, by<br />

bylaw, close a portion <strong>of</strong> a highway to traffic and remove the dedication <strong>of</strong> the<br />

highway, if prior to adopting the bylaw, Council publishes notices <strong>of</strong> its intention in a<br />

newspaper and provides an opportunity for persons who consider they are affected<br />

by the bylaw to make representations to Council;<br />

BYLAW NO. 1373<br />

A BYLAW TO AMEND BYLAW NO. 300, LANGFORD ZONING BYLAW, 1999<br />

The Council <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Langford</strong>, in open meeting assembled, hereby enacts as follows:<br />

A. <strong>Langford</strong> Zoning Bylaw No. 300,1999 is amended as follows:<br />

1. By replacing Sec. 3.05.02(4) and (5) with the following:<br />

"(4)The total floor area <strong>of</strong> buildings that are accessory to a residential use on any lot in a<br />

residential zone or comprehensive development zone may not exceed 30 m2 (323 ft2),<br />

except under the following circumstances:<br />

a) on a lot with an area greater than or equal to 200 m2 (2153 ft2), and where the<br />

principal use is a one-family residential dwelling the maximum total floor area <strong>of</strong><br />

accessory buildings may exceed 30 m2 (323 ft2) but may not exceed 60m2 (645 ft2);<br />

b) on a lot with an area greater than or equal to 550 m2 (5920 ft2), and where the<br />

principal use is a one-family residential dwelling the maximum total floor area <strong>of</strong><br />

accessory buildings may exceed 30 m2 (323 ft2) but may not exceed 65 m2 (700 ft2);<br />

c) on a lot with an area greater than or equal to 800 m2 (8611 ft2), and where the<br />

principal use is a one-family residential dwelling, the maximum total floor area <strong>of</strong><br />

accessory buildings may exceed 30 m2 (323 ft2) but may not exceed 80 m2 (861 ft2);<br />

d) on a lot with an area greater than or equal to 1000 m2 (0.25 acre) where the principal<br />

use is a one-family residential dwelling the maximum total floor area <strong>of</strong> accessory<br />

buildings may exceed 30 m2 (323 ft2) but may not exceed 100 m2 (1076 ft2);<br />

e) on a lot with an area greater than 1000 m2, where the principal use is a one-family<br />

residential dwelling, the maximum total floor area for accessory buildings may be<br />

increased from 100 m2 (1076 ft2) by an additional 10 m2 (107.6 ft2) for each additional<br />

100 m2 (1076 ft2) <strong>of</strong> lot area in excess <strong>of</strong> 1000 m2 (0.25 acres);<br />

f) on any lot where the principal use is a two-family dwelling the total combined floor area<br />

<strong>of</strong> accessory buildings may not exceed 160 m2 (1722 ft2);<br />

g) on any lot where the principal use is a multi-family residential dwelling, the total<br />

combined floor area <strong>of</strong> accessory buildings may not exceed 30 m2 (323 ft2) per dwelling<br />

unit on the lot, exclusive <strong>of</strong> secondary suites and flex units; and<br />

h) under no circumstance may accessory buildings and structures exceed the maximum<br />

site coverage regulations in Part 6 <strong>of</strong> this Bylaw.

(5) Notwithstanding subsection 3.05.02(4) <strong>of</strong> this Bylaw and subject to maximum site coverage<br />

regulations in Part 6 <strong>of</strong> this Bylaw, where an accessory building contains a Secondary Suite<br />

permitted by Part 6 and Section 3.08 <strong>of</strong> this Bylaw on a lot in a Residential Zone or a<br />

Comprehensive Development Zone, the floor area <strong>of</strong> the accessory building may exceed<br />

60 m2 (645 ft2), but the building footprint <strong>of</strong> the accessory building may not exceed:<br />

a) 60 m2 (645 ft2) on lots with an area less than 550 m2 (5920 ft2);<br />

b) 65 m2 (700 ft2) on lots with an area greater than or equal to 550 m2 (5920 ft2);<br />

c) 80 m2 (861 ft2) on lots with an area greater than or equal to 800 m2 (8611 ft2); or<br />

d) 100 m2 (1076 ft2) on lots with an area greater than or equal to 1000 m2 (0.25 acre);<br />

and for each additional 100 m2 (1076 ft2) <strong>of</strong> lot area in excess <strong>of</strong> 1000 m2 (0.25 acres) the<br />

maximum floor area <strong>of</strong> an accessory building may be increased by 10 m2 (107.6 ft2)."<br />

2. By replacing Sec. 3.05.02(3) with the following:<br />

"(3)The height <strong>of</strong> an accessory building shall not exceed the maximum height for a building or<br />

structure permitted in Part 6 <strong>of</strong> this bylaw, with the exception that:<br />

(a) any building that is accessory to a one-or two-family residential use may not exceed a<br />

height equal to:<br />

i) a single storey, or the height <strong>of</strong> the principal dwelling if that building is a single<br />

storey above grade, or 60% <strong>of</strong> the height <strong>of</strong> the principal dwelling if that building is<br />

more than a single story above grade; or<br />

ii) two storeys, or the maximum height permitted for the principal dwelling where the<br />

principal use on the property is a one-family residential dwelling and the lot area is<br />

greater than or equal to 1000 m2 (0.25 acres); and<br />

(b) any building that is accessory to a multi-family residential use may not exceed a height<br />

equal to a single storey, or the height <strong>of</strong> the principal dwelling if that building is a single<br />

storey above grade, or 60% <strong>of</strong> the height <strong>of</strong> the principal dwelling if that building is two<br />

storeys in height or more above grade."<br />
