FIVE-YEAR NOTICES OF REVIEW AND STATEMENTS OF CONTINUATION<br />
of the long term, permanent nature of public education<br />
foundation funds, there has to be a rule in place with different<br />
investment structures than what is needed for most pubic<br />
funds that are generally short-term funds. This rule provides<br />
for investment in high quality longer term securities and funds.<br />
Having these criteria in a rule allows the Council to respond<br />
rapidly to any changes in the markets. Therefore, this rule<br />
should be continued.<br />

CONCISE EXPLANATION OF THE PARTICULAR STATUTORY PROVISIONS<br />
UNDER WHICH THE RULE IS ENACTED AND HOW THESE PROVISIONS<br />
AUTHORIZE OR REQUIRE THE RULE: Under Section 73-22-5, the<br />
Division of Water Rights is given jurisdiction and authority to<br />
require that all wells for the discovery and production of water<br />
to be used for geothermal energy production of water in the<br />
State of <strong>Utah</strong>, be drilled, operated, maintained, and<br />
abandoned in a manner as to safeguard life, health, property,<br />
the public welfare, and to encourage maximum economic<br />
recovery.<br />

LAST FIVE YEAR REVIEW OF THE RULE FROM INTERESTED PERSONS<br />
SUPPORTING OR OPPOSING THE RULE: <strong>No</strong> written comments have<br />

REASONED JUSTIFICATION FOR CONTINUATION OF THE RULE,<br />
INCLUDING REASONS WHY THE AGENCY DISAGREES WITH COMMENTS<br />
IN OPPOSITION TO THE RULE, IF ANY: The Division of Water<br />
Rights maintains jurisdiction and authority to require that all<br />
wells for the discovery and production of water to be used for<br />
geothermal energy production of water in the State of <strong>Utah</strong>, be<br />
drilled, operated, maintained, and abandoned in a manner as<br />
to safeguard life, health, property, the public welfare, and to<br />
encourage maximum economic recovery so this rule should<br />
be continued.<br />
