EMERGENCY PROVISION OF RELIEF ITEMS FOR AFFECTEES OF SINDH,<br />

BALOCHISTAN AND PUNJAB – FLOOD 2011<br />

As on 11-Oct-2011<br />

The National Disaster Management Authority (<strong>NDMA</strong>) being the executive<br />

arm/secretariat of National Disaster Management Commission has been mandated under<br />

Section 9 of the National Disaster Management Act - 2010 to act as the implementing,<br />

coordinating and monitoring body for the <strong>disaster</strong> <strong>management</strong>, coordinate response in the<br />

event of any threatening situation or <strong>disaster</strong> under sub-section (f) of Section 9 of the Act.<br />

2. In order to respond to <strong>disaster</strong>s the <strong>NDMA</strong> under section 32 of the Act has been<br />

authorized, if it deems appropriate, to undertake immediate procurement of provisions or<br />

materials or the immediate application of resources for rescue and relief in the affected<br />

areas. The extract of relevant section is reproduced as under:<br />

“Where by reason of any impending <strong>disaster</strong> situation or <strong>disaster</strong>, the National<br />

Authority or Provincial Authority or District Authority is satisfied that<br />

immediate procurement of provisions or materials or immediate application of<br />

resources are necessary for rescue or relief it may authorize the concerned<br />

department or <strong>authority</strong> to make the <strong>emergency</strong> procurement in such cases,<br />

the standard procedure requiring inviting of tenders shall be deemed to be<br />

waived.”<br />

3. In accordance with the Public Procurement Rules, 2004 all <strong>emergency</strong> procurements<br />

are governed under following rules:-<br />

“Rule 42 (c ) (v): A procuring agency shall only engage in direct contracting if<br />

the following conditions exist, namely<br />

(v) in case of <strong>emergency</strong>:<br />

Rule 42 (d) (iii): A procuring agency may engage in negotiated tendering<br />

with one or more suppliers or contractors with or without prior public<br />

publication of a procurement notification. This procedure shall only be used<br />

when:-<br />

(iii) for reasons of extreme urgency brought about by events<br />

unforeseeable by the procuring agency, the time limit laid down for open and<br />

limited bidding methods cannot be met. The circumstances invoked to justify<br />

extreme urgency must not be attributable to the procuring agency:”<br />

4. The unprecedented rains in Sindh during the monsoon season of 2011, have<br />

severely affected major portion of Sindh province causing losses to life and property. Due to<br />

widespread water inundations caused by continuous heavy rain pour, i.e. starting 10 th<br />

August 2011, around 9 million people got affected during the <strong>disaster</strong>. All the affectees<br />

residing in relief camps or outside their houses in the open area became dependant entirely<br />

upon continuous relief assistance.<br />

5. <strong>NDMA</strong> entered in rescue and relief operations at initial stage, i.e. 13 th August 2011;<br />

and remained active in providing relief [tents, family ration packs and Non-Food Items<br />

(NFIs)] to flood affectees since the start of these heavy and unprecedented rains. Entire<br />

stock of tents in <strong>NDMA</strong> Warehouses was released to the province of Sindh, Balochistan<br />

and Punjab from the reserves maintained by <strong>NDMA</strong> to take care of the initial scale of the<br />

devastation. For supply of family ration packs Utility Stores Corporation (USC) being the<br />

Government entity, was contracted for the provision of family ration packs. Highly unfolding<br />

nature of the catastrophe, with Pakistan Meteorological Department’s (PMD) continuous<br />

forecasts of more rains aggravated the situation, resulting in gradual increase in number of<br />

affected districts and population.<br />

TENTS<br />

6. While the entire stock of tents was released in the first few days of <strong>disaster</strong>, demand<br />

continued to increase. In order to quickly respond to this need, an Emergency Tender was<br />

floated on Aug 17, 2011, both in <strong>national</strong> dailies and on the website of Public Procurement<br />

Regulatory Authority (PPRA) as well as <strong>NDMA</strong> for procurement of tents sized 3x4 and 4x4.<br />

The tenders were opened, examined and categorization was done with the technical<br />

assistance of concerned UN organizations as under:-<br />

7. While the process was underway, a marked increase in the monsoon activity<br />

resulted in more sporadic rains spreading over entire Sindh and parts of Balochistan which<br />

further increased the affected population that necessitated continuous and enhanced<br />

supply of tents, ration packs, and other life saving NFIs.<br />

8. Due to the prevailing unprecedented situation and number of requests, SOS<br />

messages, calls by the Sindh Government, PDMAs and DCOs of affected districts,<br />

Chairman <strong>NDMA</strong> immediately called meeting on the second day of Eid-ul-Fitr, i.e. 1 st<br />

September 2011 for <strong>emergency</strong> procurement of relief items enabling effective response in<br />

relief operation. The situation worsened by continuous rains and advisories of heavy to very<br />

heavy rainfall by PMD, necessitating the need for provision of relief items under <strong>emergency</strong><br />

procurement clause of NDM Act, 2010<br />

9. Though the <strong>emergency</strong> procurement was resorted to yet being cognizant of the<br />

importance of transparency, the Authority ensured that all requirements and procedures for<br />

fair and timely procurement are fulfilled despite the time constraint and urgency of relief<br />

goods supply.<br />

10. In case of tents, which are locally manufactured on advance orders and take<br />

considerable time in production and availability, the Authority explored the possibility of<br />

availing the entire stock of tents held with the manufacturers, subject to meeting acceptable<br />

specifications. Since the tender for procurement of tents had already been floated on 17 th<br />

August, 2011, the Authority invited all the contenders/participants to indicate their stock<br />

position and possible delivery schedule along with revised cost (category wise) so as to<br />

match the lowest price for each category of tent samples/match the price assessed by UN<br />

Expert for each category. Participating Manufacturers/Suppliers, meeting the required<br />

standards of quality and technical specifications (Reference para 2 above) were accordingly<br />

issued the Purchase Orders for immediate supply at the designated districts with predefined<br />

focal persons and locations. It deserves special mention here that prices of tents of all<br />

categories procured were lesser than the procurement made earlier. Details are as under:-<br />

12. For food items, initially Utility Stores Corporation (USC) was engaged for provision of<br />

family food packs weighing 35 Kg @ Rs. 2074/- (including packing material, packing<br />

charges and loading/unloading charges) containing following ingredients/ items sufficient for<br />

a family of 7 persons for fifteen days.<br />

13. The Utility Stores Corporation (USC) despite being the largest supply chain network<br />

in Pakistan could not cater for the requirements of the entire affected population. Therefore,<br />

Canteen Stores Department (CSD) was also involved in the supply of family ration packs to<br />

supplement the efforts. Due to changed food requirements and need-based contents of the<br />

ration packs conveyed by the District Authorities the CSD was asked to provide family<br />

rations packs weighing 18 Kg containing following ingredients/ items sufficient for a family<br />

of 7 persons for seven days. However, to avoid delay/break in the supply chain of USC it<br />

was allowed to switch over to supply of 18 kg ration packs instead of 35 kg without<br />

changing the ingredients. This strategy helped in reaching out to a large number of<br />

affectees at the same time. The USC charged Rs. 1318/- per family ration pack of 18 Kg,<br />

while CSD charge Rs. 1400/- for standard family ration pack of 19 Kg because of additional<br />

ingredients to meet the nutritional requirements.<br />

14. Continuation of the longest and heaviest 3 rd spell of rain from 29 th August, 2011<br />

without any end time prediction, escalated the already deteriorated situation in almost all<br />

the districts of Sindh besides few districts of Balochistan and parts of Punjab. This situation<br />

demanded a large scale supply of ration packs, estimated at around 100,000 ration packs<br />

per day. The USC & CSD who were the sole suppliers of family ration packs being<br />

government owned supply chains were given ample opportunity to be able to deliver the<br />

required quantity. Their performance, however, remained considerably low in terms of<br />

number of packs supplied and timings of delivery, calling undue agitations in the flood<br />

affected areas. Only after their failure to come up to the expectations for guaranteed<br />

supplies of relief operations, various private vendors were contracted from all over the<br />

country for immediate provision of family ration packs containing above mentioned items on<br />

same rates and conditions as being arranged through CSD to fill in the capacity gaps. The<br />

quantity assigned to the vendors was based on their per day delivering capacity.<br />

Procurement orders are being issued/revised keeping in view the evolving situation and the<br />

requirement of respective PDMAs/ Province. Details of the purchase orders issued to the<br />

Mosquito Nets, Aqua-Tabs, Jerry Cans, Water Purification Units, water coolers, plastic<br />

MONITORING<br />

16. To ensure the quality and quantity of these supplies, the PDMAs and respective<br />

DCOs were advised to ensure that the items so provided are fully in conformity with the<br />

standard quality and quantity. Moreover, it is also being ensured through a check<br />

list/certificate provided to the vendors along with the purchase order, required to be filled in<br />

by the respective district authorities, certifying the quantity and the quality of the relief items<br />

delivered to assigned destinations. The procurement contract provides necessary<br />

safeguards to check any delay/default on part of the vendor/supplier.<br />

FINANCING<br />

17. It is worth mentioning that available resources with <strong>NDMA</strong> were not sufficient<br />

enough to meet even one week requirement of relief related purchases. The timely relief to<br />

the flood affectees was however, essential as the entire operation was focused on saving<br />

human lives. This could only be made possible, initially with the assistance of government<br />

owned supply chains (USC and CSD) and subsequently with the support of private vendors<br />

who supplied tents, family ration packs and NFIs on credit. The <strong>NDMA</strong> has already started<br />

making payments to the vendors, details of which are attached at Annexure “A”. The details<br />

of delivery so far are being maintained on daily basis which are also available on website of<br />

<strong>NDMA</strong>.<br />
