DRIVERS’ HOURS
& SPEED LIMITS
This is a summary of EC Regulations 561/2006 and 3821/85. For comprehensive information, you should obtain a copy of the latest GV262 ‘Drivers’ Hours and Tachograph Rules for Goods Vehicles
in the UK and Europe’ available through the Department for Transport or contact your Regional Helpdesk.
EU DRIVERS’ HOURS RULES APPLY TO MOST VEHICLES OVER 3.5 TONNES PERMISSABLE MAXIMUM WEIGHT,
INCLUDING ANY TRAILER. THESE RULES APPLY TO ANY PERSON WHO DRIVES THE VEHICLE EVEN FOR A
SHORT PERIOD OR IS CARRIED IN THE VEHICLE IN ORDER TO BE AVAILABLE FOR DRIVING IF NECESSARY.

If a driver is expected to drive a vehicle fi ted with a
digital tachograph it is important that the operator
ensures that a driver smart card has been issued to that
driver.
It is an o fence for a driver to drive an in-scope vehicle
unless he has been issued with a driver smart card.

These are national speed limits and apply to a l roads, unless signs show otherwise. A 30mph speed limit applies to
a l tra fic on a l roads in England and Wales (and Class C unclassified roads in Scotland) with street lighting, unless
signs show otherwise. The speed limit is the absolute maximum and does not mean it is safe to drive a that speed
irrespective of conditions. Driving at speeds too fast for the road and tra fic conditions can be dangerous.
New vehicles
Goods vehicles over 3.5t gross design weight, first registered after 1 January 2005 are required to be fi ted with speed
limiters. However, for Goods vehicles (over 3.5t but not exceeding 7.5t gvw) used solely within the UK this requirement is
defe red to 1 January 2008.
Retro-fit to existing vehicles
SPEED LIMITERS
There are retro-fit requirements that apply to goods vehicles (over 3.5t GDW) that were first registered between 1 October
2001 and 31 December 2004 (inclusive). Vehicles caught by these requirements should have been fi ted with speed
limiters with e fect for 1 January 2006, or a the latest by 1 January 2007 if the vehicle is being used solely within the UK.
Changes to vehicles already fitted with speed limiters.
Goods vehicles (with a gross design weight over 7.5t but not exceeding 12.0t, first registered between 1 October 2001 and
31 October 2004) wi l need to have the speed limiters reset so the maximum set speed of 60 mph is replaced by a reduced
se ting that wi l ensure the stabilised speed cannot exceed 90kph.

BREAKS FROM DRIVING
Each period of 4½ hours
driving must contain or be
immediately fo lowed by a total
of 45 minutes break. This may
be taken as two breaks, the
first of at least 15 minutes and

RECORD KEEPING
In-scope drivers must use a

Actions in the event of an accident or emergency
In th event of an accident or emergency that may occur or arise during carriage, the members of the vehicle
crew sha l take the fo lowing actions where safe and practicable to do so:
- Apply the braking system, stop the engine and isolate the ba tery by activating the master switch
where available;
- Avoid sources of ignition, in particular, do not smoke or switch on any electrical equipment;
- Inform the appropriate emergency services, giving as much information about the incident or
accident and substances involved as possible;
- Put on the warning vest and place the self-standing warning signs as appropriate;
- Keep the transport documents readily available fo responders on arrival;

- Do not walk into or touch spi led substances and avoid inhalation of fumes, smoke, dusts and
vapours by staying up wind;
- Where appropriate and safe to do so, use the fire extinguishers to put out smal/initial fires in
tyres, brakes and engine compartments;

- Fires in load compartment sha l not be tackled by members of the vehicle crew;
- Where appropriate and safe to do so, use on-board equipmento prevent leakages into the aquatic
environment or the sewage system and to contain spi lages;
- Move away from the vicinity of the accident or emergency, advise other persons to move away

- Remove any contaminated clothing and used contaminated protectiv equipment and dispose of it
safely.

Returns: If goods need to be returned for any reason, please ensure that you notify
the RHA Hauliers Shop within 48 hours of receipt of goods.
Damaged goods: If you receive goods that are damaged please sign for as
damaged goods with the carrier then notify the RHA Hauliers Shop immediately.
Damaged, incorrect or incomplete orders that are not reported to the RHA Hauliers
