16. The special conditions shall supersede any similar provision in the General Conditions of<br />
Contract.<br />
17. Care in submission of tenders – Before submitting a tender, the tenderer will be deemed to<br />
have satisfied himself by actual inspection of the site and locality of the works, that all conditions<br />
liable to be encountered during the execution of the works are taken into account and that the rates<br />
he enters in the tender forms are adequate and all inclusive to accord with the provisions in clause<br />
37 of the General conditions of contract for the completion of works to the entire satisfaction of the<br />
Officer.<br />
18. Right of <strong>Railway</strong> to deal with tenders – The <strong>Railway</strong> reserves the right of not to invite tenders<br />
for any of <strong>Railway</strong> work or works or to invite open or limited tenders and when tenders are called to<br />
accept a tender in whole or in part or reject any tender or all tenders without assigning reasons for<br />
any such action.<br />
19. Compliance of related Acts & Laws.<br />
19 (a) The Contractor shall comply with the provisions of the payment of Wages Act 1936, Minimum<br />
Wages Act 1948, Employees Liability Act 1938, workmen’s Compensation Act 1923, Industrial<br />
disputes Act, 1947, Maternity Benefits Act 1961 of the Contractor’s Labour (Regulation & Abolition)<br />
Act 1970, Any other state/local rules/regulations applicable as required by local authorities or the<br />
modification there of or any other laws relating thereto and the rules made the under from time to<br />
time.<br />
19(b) The Contractor shall indemnify <strong>Railway</strong>s against payments to be made under and for the<br />
observance of the Laws aforesaid. The regulations aforesaid shall be deemed to be a part of this<br />
contract and any breach thereof shall be deemed to be a breach of this contract.<br />
20. The contractor shall obtain necessary labour license from appropriate authority before starting<br />
the work.<br />
21. <strong>No</strong> labour below the age of eighteen years shall be employed on the work<br />
22. Payment of wages to labour.<br />
The contractor shall, not with standing the provisions of any contract, to the contrary, cause to be<br />
paid fair wage to labour.<br />
23. In respect of all labour directly or indirectly employed in the work for the performance of the<br />
contractor’s part of this agreement the contractor shall at his own expense arrange for the safety<br />
provisions and shall at his own expense provide for all facilities in connection therewith.<br />
24 CONSTITUTION OF FIRMS :<br />
(a). <strong>Tender</strong>ers should specifically and fully disclose their respective constitutions and submit<br />
along with tender attested copies of documents like partnership deed, articles or memorandum of<br />
Association, certificates of Incorporation etc., If any, in support of such disclosures. If a tenderer is a<br />
firm i.e. a partnership business it should be stated whether the name of the firm is registered under<br />
the Indian Partnership Act and the names and addresses of all the partners of the firm should be
