1 I/We -------------------- have read the various conditions to tender attached here to and agree to
abide by the said conditions. I/we also agree to keep this tender open for acceptance for a period of
60 days from the date fixed opening the same and in default thereof. I/we will be liable to forfeiture
of my /our earnest money. I/we offer to do work for Northern Railway , at the rates quoted in the
attached schedule and hereby bind my self/ ourselves to complete the work in all respect with in ----
-- months from the date of issue of letter of acceptance of the tender.
2. I/We also hereby agree to abide by the general conditions of the contract corrected up to printed/
advance correction slip no------ dated------ and to carry out work according to the special conditions
of contract and specifications of material and works as laid down by Railway works hand book

3. A sum of Rs.----- is herewith forwarded as earnest money. The full value of the earnest money
shall stand forfeited without prejudice to any other right or remedies in case my/our tender is

I/ we do not execute the contract documents with in 7 days after receipt of notice issued by the
Railway that such documents are ready and
I/We do not commence the work with in 15 days after receipt of orders of that effect.
Standing earnest money deposit is not acceptable.
Until a formal agreement is prepared and executed, acceptance of this tender shall constitute a
binding contract between us subject to modification, as may be mutually agreed to between us and
indicated in the letter of acceptance of my/our offer for this work.

6 The dustbins of minimum 80lts Capacity, made of good
quality material & aesthetics shall be provided by the
contractor at an interval of at least 25 meters on
platform. These shall be emptied once in a day in
addition as and when these are full. Each dustbin shall
be kept neat and clean condition. The polythene shall be
collected from each dustbin and disposed off after single
use in the main garbage bins provided for this purpose.

7 Cleaning and washing of all water booths and water
coolers on the entire platform as to keep these neat and
clean round the clock. Grill covered drainage pit & pipes
leading to disposal of waste water should be kept free of
all silt/ debris/polythenes etc. So that there is no

tiles/granite/ metal surface shall be cleaned using
environment friendly/biodegradable cleaning/polishing

stair cases twice in 24 hrs. The contractor shall ensure

entrance door and their aluminum fitting all offices
doors and their glasses, using latest glass cleaning agents

4 For various N.S Item if rates are quoted separately by the party, it shall be considered as a
conditional offer and shall be summarily rejected.
5.The rates to be quoted by the tenderer. Both in words and in figures failing which tender is liable
to be rejected.
6. The contractor values given above are approx. and subject to variation according to actual
requirement to Railway . No claim on this account will be entertained by Railway Administration. The
operation of any item can be withheld without citing any reason by the Administration
7. The administration reserves the right to review the work after six months and terminate/ close
the tender after review without any financial repercussions on either side./ I we clearly understand
that i/We are not entitled to any compensation on account of any variation in the value of contract
and also agree to complete all such works allotted to me/us with in stipulated period.

submitting bills by the contractor

Branch N. Rly Ambala Cantt and under takes to inform the Sr. Divisional Commercial Manager
Northern Railway Ambala Cantt in writing at once of my /our relative if subsequently appointed or
transferred during the currency of this tender and will obey and abide by all the instructions even to
me/us by officers and contains in the enclosed special terms and condition.
Special Terms and Conditions.
1.0 General
MEANING OF TERMS
1(1). Definition:
In these General Conditions of contract, the following terms shall have the
Definitions/meanings assigned hereunder except where the context otherwise requires:-
“Railway” shall mean the President of the Republic of India or the Administrative Officers of
the Indian Railway or of the Successor Railway authorized to deal with any matters, which
these presents are concerned on his behalf.
“General Manager” shall mean the officer in charge of the Chief Commercial Manager and
control of the Railway.
“Chief Commercial Manger” shall mean the officer in charge of the Commercial Department
of the Railway.
“Divisional Railway Manager” shall mean the officer in charge of division and shall mean
and include the Divisional Railway Manager of the successor Railway.
“Officer’ shall mean the Sr. Divisional Commercial Manger/Divisional Commercial Manager,
executive in-charge of the works as the case may be and shall include the officers of the
commercial Department of the Indian Railway.
“Department’s Representative” shall mean the Assistant Divisional Commercial Manager
Officer/Divisional Commercial Manager/Sr. Divisional Commercial Manager in direct charge

of the work and shall include Sectional Commercial Inspector/ station Supdt or any Inspector
of the Commercial manager appointed by the Indian Railway and shall mean and include the
Department’s Representative of the successor Railway.
“Contractor” shall mean the person/the firm/Co-operative or Company whether incorporated
or not who enters into the contract with the Railway shall and shall include their executors,
administrators, Successors and permitted assigns.
“Contract” shall mean and include the agreement of work order the accepted schedule of
rates or the schedule of rates of Northern Railway modified by the tender percentage for
items of works quantified or not quantified, the general conditions of contract, the special
conditions of the contract, if any, the drawings, the specifications, the special specifications,
if any and tender forms if any.
“Works” shall mean the works to be executed in accordance with the contract.
“Specifications’ shall mean the standard specifications for Materials & Works, of Northern
Railway issued under the authority of the Sr. Divisional Commercial Manager or as
amplified, added to or superseded by special specifications, if any.” Schedule of rates
Northern Railway” shall mean the schedule of rates issued under the authority of the Chief
Engineer/Chief Commercial Manager from time to time.
“Drawings” shall mean the maps, drawings, plans and tracings or prints thereof annexed to
the contract and shall include any modifications of such drawings and further drawings as
may be issued by the Chief Engineer/Chief Commercial Manager from time to time.
“Constructional Plan” shall mean all appliances or things of whatsoever nature required for
the execution, completion or maintenance of the works or the temporary works (as
hereinafter defined) but do not include materials or other things pended to form or forming
part of the permanent work.
“Temporary works” shall mean all temporary works of every kind required for the execution,
completion and /or maintenance of the works.
“Site” shall mean the lands and other places on, under, in, or through which the works are to
be carried out and any other lands or places provided by the railways for the purpose of the
contract.
“Period of maintenance” shall mean specified period of the maintenance from the date of
completion of the works as certified by the Officer.
GCC shall mean General Conditions of contract, May 1999 issued by Northern Railway as
amended from time to time.
1(2).Singular & Plural
Words imparting the singular number shall also include the plural and vice versa where the
context requires.
1(3).Heading & Marginal Heading
The heading and marginal headings in these general conditions are solely for the purpose of
facilitating reference and shall not be deemed to be part thereof or to be taken into
consideration in the interpretation or construction thereof or the contract.
1 (4) All offers shall be submitted before the time and date fixed for the receipt of the offers
as set forth in the tender papers. Offers received after the stipulated time and date shall not
be considered. Tender papers are not transferable.

2. Technical Qualifications :
The contractor should fulfill following technical criteria to be eligible for consideration
2 (a) Earnest Money –
2 (a) (i) The tenderer shall be required to deposit earnest money with the tender, for the due
performance, with the stipulation to keep the offer open till such date as specified in the
tender, under the conditions of tender. The earnest money shall be 2% of the estimated
tender value as indicated in the tender notice. The earnest money shall be rounded to the
nearest Rs. 10/-.
2 (a) (ii) It shall be understood that the tender documents have been sold/issued to the
tenderer and the tenderer is permitted to tender in consideration of stipulation on his part,
that after submitting his tender he will not resile from his offer or modify the terms and
conditions thereof in a manner not acceptable to the Officer. Should the tenderer fail to
observe or comply with the said stipulation, the aforesaid amount shall be liable to be
forfeited to the Railway.
2 (a) (iii) If his tender is accepted, this earnest money mentioned in sub-clause 2(a)(i) above
will be retained as part security for the due and faithful fulfilment of the contract in terms of
Clause 16 of the General Conditions of Contract. The earnest money of other tenderers,
shall save as herein before provided, be returned to them, but the Railway shall not be
responsible for any loss or depreciation that may happen thereto while in their possession,
nor be liable to pay interest thereon.
2 (a) (iv)The earnest money should be in cash or in any of the following forms,
(i) A deposit in cash
(ii) Government securities at 5% below the market value
(iii) Deposit receipts or demand drafts of the nationalized banks
(iv)A deposit in the Post office saving bank
(v) National Savings Certificates
(vi)Twelve year national Defence certificates
(vii)Ten Year Defence Deposits,
(viii)National Defence Bonds,
(ix) Time Deposit Account which came into force on 16.3.1970 and notified under Ministry of
Finance, Notification No. F3(7)NS/70 dated 28.2.1970,
(x) IRFC Bonds.
Note (vi) to (viii) These certificates/bonds may be accepted at their surrender value.
2 (b) Proof of Eligibility Criterion such as credentials to be submitted along with
tender/s.
(i) As a proof of having experience for similar nature of work.
The Similar nature of work is defined as under:
All the tenderers have to submit experience in similar nature of work in absence of which the
offer shall be rejected. Similar nature of work means any one of Disposal of garbage from
garbage bins, Picking of garbage from open area/track also termed as Rag Picking,
Collection of garbage door to door from each house hold in colonies and mechanized
housekeeping works of offices, hotels, factories, airports, Railway Stations, service buildings,
hospitals, workshops etc., Desilting of Nallahs and drains; septic tanks and bio gas
chambers and Manholes/sewer/sewer lines and leading of silt etc to disposal grounds,
Jungle cutting as a part of sanitation work, Surface cleaning by mechanical means including

oads, open ground, platforms, circulating areas, service buildings, waiting room, retiring
room, toilets, urinals, coach cleaning, train cleaning including leading of garbage etc to
disposal ground etc.
3. Certificates attached as proof of experience, issued by private individuals, for whom such
works are executed/being executed shall not be accepted.
4. Financial Credibility
As a proof of sufficient financial capacity and organizational resources, contractor should
submit bank statement .
5. Contractor has to satisfy the eligibility criteria for technical capability and competence as
well as for financial capacity and organizational resources.
6. VALIDITY
This contract shall be valid for a period of 24 Months (Two Years)
7. Security Money
The security money will be @ 5% of the total value of the contract. The security deposit /rate of
recovery /mode of recovery shall be as under: -
The rate of recovery shall be at the rate of 10% of the bill amount till the full security deposit is
recovered
Security deposits (SD) will be recovered only from the running bills of the contract and no other
mode of collecting SD such as SD in the form of instruments like Bank Guarantee, Fixed Deposits etc.
shall be accepted towards security deposit. Security deposit shall be returned to the contractor after
the physical completion of the works as certified by the competent authority.
8. Performance Guarantee
8 (a) The successful bidder shall give a performance guarantee in the form of an irrevocable bank
guarantee amounting to 5% of the contract value.
The performance guarantee should be furnished by the successful contractor after the letter of
acceptance has been issued, but before signing of the agreement and should be valid up to expiry of
the maintenance period .The agreement should normally be signed with 15 (Fifteen) days after the
issue of Letter Of Acceptance and performance Guarantee should also be submitted within this time
limit.
Performance guarantee shall be released after satisfactory completion of the work and maintenance
period is over .The procedure for releasing shall be same as for security deposit,
8 (b) wherever the contracts are rescinded, the security deposit shall be forfeited and the
performance guarantee shall be encashed and the balance work shall be got done separately, the
original contractor shall be debarred from participating in the tender for executing the balance work.
If the failed contractor is a JV or a partnership firm, then every member / partner of such a firm
would be debarred from participating in the tender for the balance work either in his /her individual
capacity or as a partner of any other JV/partnership firm.

9. The contractor or his nominated supervisor shall be available all the times for
inspection/supervision.
10. No material shall be supplied by railways. The contractor shall use latest / environment friendly /
biodegradable cleaning materials and supply protective gear to his workers. The brands/cleaning
material shall be approved by officer before start of work.
11 Payments on monthly basis for the items mentioned in Schedule of Rates will be made on
satisfactory completion of work. Concerned CMI/Dhuri and Station Supdt/Dhuri be inspecting
authorities.
12. The Railways is at liberty to accept or reject the tender without assigning any reason thereof.
13. All the work done by the contractor will be subject to the satisfaction of and according to the
instructions given by the Sr. Divisional Commercial Manager N.Rly Ambala Cantt or any subordinate
nominated by him to supervise the work.
14. The contractor will supply the identity card, uniform, illuminated jackets with reflective bands
and name plates to his labour at his own cost. The identity card shall bear the signatures and seal of
Contractor and concerned Station Supdt/ Dhuri The uniform should have approval of the Sr.
DCM/UMB. In case contractor’s labour is found working without uniform, a sum of Rs. Ten per
person per day shall be deducted from the contractor’s bill. This deduction shall not prejudice the
right of administration to impose any other penalty on this account.
15. Payment of Taxes Sales Tax, works contract tax or any other tax on material and on overall work
in respect of this contract shall be payable by the contractor and the authority will not entertain any
claim whatsoever in this respect. Service tax in respect of this contract shall be payable by the
contractor. Tendered rates are inclusive of all taxes, duties and levies payable under the respective
state statute. However, pursuant to the constitution (Forty sixth Amendment) Act, 1982, if any
further tax or duty or levy is imposed by State, after the date of receipt of tenders, and the
contractors there-upon necessarily and properly pays such taxes/levies the contractor shall be
reimbursed the amount so paid (on production of proof of payment of such taxes) , provided such
payment, if any, is not, in the opinion of Officer (Whose decision shall be final and binding)
attributable to delay in execution of work within the control of the contractor.
(i) The contractor shall keep necessary books of accounts and other documents for the purpose of
this condition as may be necessary and shall allow inspection of the same by the Officer and further
shall furnish such other information / document as the Officer may require.
(ii) The contractor shall, with in a period of 30 days of imposition of any further tax of levy, pursuant
to the constitution (Forty sixth Amendment) Act 1982 give a written notice thereof to the Officer
that the same is given pursuant to this condition, together with all necessary information relating
there to.
(iii) The quoted rates of the contractor shall also be inclusive of works contract tax, sales tax, and
other such taxes as applicable. For this purpose the contractor shall be required to obtain
Registration/License from appropriate authority within fifteen days from the date of issue of award
letter. If the contractor fails to pay the works contract tax, sales tax or other statutory levies etc,

ecovery will be made as applicable from time to time and the same will be remitted to the
appropriate authority.
16. The special conditions shall supersede any similar provision in the General Conditions of
Contract.
17. Care in submission of tenders – Before submitting a tender, the tenderer will be deemed to
have satisfied himself by actual inspection of the site and locality of the works, that all conditions
liable to be encountered during the execution of the works are taken into account and that the rates
he enters in the tender forms are adequate and all inclusive to accord with the provisions in clause
37 of the General conditions of contract for the completion of works to the entire satisfaction of the
Officer.
18. Right of Railway to deal with tenders – The Railway reserves the right of not to invite tenders
for any of Railway work or works or to invite open or limited tenders and when tenders are called to
accept a tender in whole or in part or reject any tender or all tenders without assigning reasons for
any such action.
19. Compliance of related Acts & Laws.
19 (a) The Contractor shall comply with the provisions of the payment of Wages Act 1936, Minimum
Wages Act 1948, Employees Liability Act 1938, workmen’s Compensation Act 1923, Industrial
disputes Act, 1947, Maternity Benefits Act 1961 of the Contractor’s Labour (Regulation & Abolition)
Act 1970, Any other state/local rules/regulations applicable as required by local authorities or the
modification there of or any other laws relating thereto and the rules made the under from time to
time.
19(b) The Contractor shall indemnify Railways against payments to be made under and for the
observance of the Laws aforesaid. The regulations aforesaid shall be deemed to be a part of this
contract and any breach thereof shall be deemed to be a breach of this contract.
20. The contractor shall obtain necessary labour license from appropriate authority before starting
the work.
21. No labour below the age of eighteen years shall be employed on the work
22. Payment of wages to labour.
The contractor shall, not with standing the provisions of any contract, to the contrary, cause to be
paid fair wage to labour.
23. In respect of all labour directly or indirectly employed in the work for the performance of the
contractor’s part of this agreement the contractor shall at his own expense arrange for the safety
provisions and shall at his own expense provide for all facilities in connection therewith.
24 CONSTITUTION OF FIRMS :
(a). Tenderers should specifically and fully disclose their respective constitutions and submit
along with tender attested copies of documents like partnership deed, articles or memorandum of
Association, certificates of Incorporation etc., If any, in support of such disclosures. If a tenderer is a
firm i.e. a partnership business it should be stated whether the name of the firm is registered under
the Indian Partnership Act and the names and addresses of all the partners of the firm should be

fully disclosed. The Railway Administration shall always have the liberty to ask for production of the
Originals of the said documents and also make out further and other requisitions regarding the
constitutions of the tenderers as may be considered necessary from the time to time.
(b).When the work is tendered by a firm or company of contractors, the Tender shall be signed by
the individual legally authorized to enter into commitments on their behalf.
The Railway will not be bound any power of attorney granted by the Tenderers or by changes in the
composition of the firm made subsequent to the execution of the contract. It may however
recognize such power of attorney and changes after obtaining proper legal advise and the cost of
which will be chargeable to the contractor as following
(i). for initial vetting Rs.100/-
(ii). for subsequent vetting Rs.30/-
(c). If the tenderer(s) deliberately gives/give wrong information in his/their or creates/create
circumstances for the acceptance of his/their tender, the Railway reserve the right to reject such
tender at any stage.
(d). If the tenderer(s) expires after the submission of his/their tender or after the acceptance of
his/their tender, the Railway shall deem such tender cancelled. If a partner of a firm expires after
the submission of their tender or after the acceptance of their tender, the Railway shall deem such
tender and cancelled, unless the firm retains its character.
(e) Partnership firm is eligible to quote, if entered into prior to issue of tender notice. Tenderer
should endorse/submit experience certificate in the same name and style. The credentials shall be
considered to the extent of work executed by the partnership firm. Experience of individual partner
will not be considered.
25. EXECUTION OF CONTRACT AGREEMENT (DOCUMENT) :
The tenderer whose tender is accepted shall be required to appear in person at the office of t he Sr.
Divisional Commercial Manager Northern Railway Ambala Cantt, as the case may be or, if a firm or
corporation, a duly authorised representative shall so appear and execute the contract documents
within 15(Fifteen) days after the notice that the contract has been awarded to him. Failure to do so
shall constitute a breach of the agreement by the acceptance of the tender in which case the full
value of the earnest money submitted along with the tender stands forfeited without prejudice to
any other right or remedies. In the event of any tenderer whose tender is accepted, refuses to
execute the contract documents as herein before provided, the Railway may determine that such
tenderer has abandoned the contract and there upon his tender and acceptance thereof shall be
treated as cancelled and the Railway shall be entitled to forfeit the full amount of the Earnest
Money. The agreement as well as provisions contained in tender papers shall form part of the
contract. In any respect about which any of the provisions in the said agreement form can not be
reconciled with any of the provisions in the tender papers the latter shall prevail.
25.B VARIATION:
The quantities provided in the Schedule are approximate and liable to vary up to 25% on either side
at same rates terms and conditions. In case, the Agree mental value goes beyond (+) 25% payment
shall be at following rates:
(a).For the first 15% increase in the value beyond 25% of Agree mental value, the rates will have a
reduction of 2% in the incremental value of the agreement.

(b).For the next 10% increase in the value, rates will have and additional reduction of 2% in the
further incremental value of the agreement.
26. Inspection
Unless specifically mentioned, Commercial Officers, Commercial Inspector/ Dhuri ,Station
Supdt/Dhuri are nominated as inspecting authorities and fine imposing authorities from
administration side. The contractor shall abide by all instructions given by inspecting authority. The
contractor shall report to concerned CMI/Dhuri & SS/Dhuri before starting the work for taking
guidelines.
27. Penalty
27.1 In case the contractor’s work is found unsatisfactory or not done, the contractor shall not be
paid for it. In addition, the authorised Representative has the right to impose penalty which shall be
minimum Rs. 50/- and maximum up to 20% of the value of total work done, depending on the
quantum of deficiency. The Officer shall finalize the amount of penalty to be imposed considering
the circumstances. This shall be in addition to the Railway’s right to get the left over work done by
any other agency in the larger interest of general hygiene.
27.2 The administration reserves the right to get the work not done by contractor by any other
agency for which no previous notice shall be requited to be given to the contractor. Any other
agency in this case shall include local working railway contractor who is doing similar work as
defined in condition no. 2 and for this work the agency shall be paid by cheque after the end of the
month concerned, on production of certified bill.Payment shall be made every month after
entering into measurement book by SS/Dhuri
28. (i)The tenderer to give consent in a mandate form for receipt of payment through ECS/EFT.
(ii) Tenderer to provide the details of Bank Account in line with RBI guidelines for the same. The
details will include Bank name, Branch Name and Address, Account type, Bank A/c No and
Bank and branch code as appearing on MICR cheque issued by Bank.
(ii)(Tenderer to attach certificate from their Bank certifying the correctness of all
above mentioned information ( as mentioned in Para (ii) above)
(iii) In case of non payment through ECS/EFT or where ECS/EFT facility is not available payment
will be released through cheque.
29. General Condition of Contract for use in connection with sanitation tender definitions and
interpretations which has already been signed by the tenderer will also be applicable.
