<strong>Sime</strong> <strong>Darby</strong> <strong>oil</strong> <strong>palm</strong> <strong>and</strong> <strong>rubber</strong> <strong>plantation</strong> <strong>in</strong> Gr<strong>and</strong> <strong>Cape</strong> <strong>Mount</strong> county, Liberia<br />

general apparent lack of compliance with the competitive bidd<strong>in</strong>g processes required by the<br />

Public Procurement <strong>and</strong> Concessions Commission <strong>and</strong> associated procurement law. 53<br />

In terms of the agriculture sector <strong>in</strong> particular, the Panel observes that it has yet to undergo<br />

similar reforms despite suffer<strong>in</strong>g from the same governance weaknesses as other sectors. 54<br />

The current conflict at Gr<strong>and</strong> <strong>Cape</strong> <strong>Mount</strong> can thus be seen as a cont<strong>in</strong>uation of exist<strong>in</strong>g<br />

problems <strong>in</strong> this sector, <strong>in</strong>clud<strong>in</strong>g violence <strong>and</strong> human rights abuses at the former Guthrie<br />

<strong>plantation</strong> as identified <strong>in</strong> the Panel’s report. The governance weaknesses referred to by the<br />

Panel <strong>in</strong>clude a lack of transparency of even basic <strong>in</strong>formation on agricultural l<strong>and</strong> plann<strong>in</strong>g<br />

<strong>and</strong> contracts. 55 The Panel notes the challenges even it faced <strong>in</strong> locat<strong>in</strong>g copies of concession<br />

contracts. If the UN Panel of Experts operat<strong>in</strong>g under a Security Council m<strong>and</strong>ate had such<br />

difficulties, rural communities are even less likely to be able to ga<strong>in</strong> access to such basic<br />

<strong>in</strong>formation.<br />

Further key problems with agricultural concession allocation processes <strong>and</strong> correspond<strong>in</strong>g<br />

recommendations for address<strong>in</strong>g these, as identified by the Panel, <strong>in</strong>clude the follow<strong>in</strong>g:<br />

Consultation <strong>and</strong> participation: There are ‘no specific legal requirement for multistakeholder<br />

participation or community consultation with regard to l<strong>and</strong>ownership or ex<br />

ante social agreements’. 56 As stated by the Panel, public participation <strong>and</strong> consultation of<br />

communities <strong>and</strong> other stakeholders will help br<strong>in</strong>g to light pre-exist<strong>in</strong>g l<strong>and</strong> claims or<br />

disputes, <strong>and</strong> prevent l<strong>and</strong> disputes <strong>and</strong> associated conflict.<br />

Benefit shar<strong>in</strong>g: Despite various benefits be<strong>in</strong>g promised (for schools, health care <strong>and</strong><br />

hous<strong>in</strong>g etc.) there is a lack of consistency <strong>in</strong> the benefits promised; benefits are poorly<br />

def<strong>in</strong>ed <strong>in</strong> the contracts <strong>in</strong> terms of time frame <strong>and</strong> st<strong>and</strong>ards; <strong>and</strong> they apply only to<br />

employees as opposed to the whole affected community. 57 As the Panel notes, long-term<br />

stability <strong>and</strong> development objectives depend on the population benefit<strong>in</strong>g at the<br />

community, regional <strong>and</strong> national levels. 58<br />

Monitor<strong>in</strong>g: Negotiation <strong>and</strong> compliance with contracts <strong>and</strong> social agreements is not<br />

currently overseen by any government m<strong>in</strong>istry, leav<strong>in</strong>g them subject to the goodwill of<br />

the company <strong>and</strong> the negotiat<strong>in</strong>g position of communities (which is comparatively weak)<br />

<strong>and</strong> the unions. 59 The Panel asserts that the ‘ability to monitor concessions is crucial on a<br />

number of fronts, <strong>in</strong>clud<strong>in</strong>g ensur<strong>in</strong>g that contracts are allocated <strong>and</strong> negotiated to the<br />

benefit of Liberia <strong>and</strong> its citizens; that required payments are made by companies; that<br />

social, health, education <strong>and</strong> employment provisions of contracts are met; <strong>and</strong> that<br />

environmental terms <strong>and</strong> conditions are met’. 60<br />

Regulat<strong>in</strong>g private security arrangements: F<strong>in</strong>ally, given the history of l<strong>and</strong> conflict<br />

<strong>and</strong> potential for violence, the Panel notes with concern the implications of private<br />

security arrangements <strong>and</strong> a lack of transparency <strong>in</strong> those arrangements. They recommend<br />

vett<strong>in</strong>g procedures to exclude <strong>in</strong>dividuals from combatant cha<strong>in</strong>s of comm<strong>and</strong> <strong>and</strong>/or<br />

<strong>in</strong>volved <strong>in</strong> past human rights abuses, <strong>and</strong> recommend establish<strong>in</strong>g <strong>in</strong>ternal codes of<br />

conduct relat<strong>in</strong>g to rules of engagement <strong>and</strong> human rights tra<strong>in</strong><strong>in</strong>g. 61<br />

Furthermore, the Panel notes that <strong>Sime</strong> <strong>Darby</strong>’s concession contract only vaguely def<strong>in</strong>es the<br />

l<strong>and</strong> area concerned, deferr<strong>in</strong>g demarcation until after the concession has been ratified by the<br />

Liberian legislature. 62 However, as a result of this ratification, the contract enters <strong>in</strong>to<br />

Liberian law <strong>and</strong> the full range of contractual provisions comes immediately <strong>in</strong>to force<br />
