<strong>Sime</strong> <strong>Darby</strong> <strong>oil</strong> <strong>palm</strong> <strong>and</strong> <strong>rubber</strong> <strong>plantation</strong> <strong>in</strong> Gr<strong>and</strong> <strong>Cape</strong> <strong>Mount</strong> county, Liberia<br />

community needs (HCV 5), <strong>and</strong> forest areas critical to traditional culture, <strong>in</strong>clud<strong>in</strong>g burial<br />

sites (HCV 6) 101 , <strong>and</strong> notes the need for participatory mapp<strong>in</strong>g of boundaries. 102<br />

<strong>Sime</strong> <strong>Darby</strong> also sought <strong>and</strong> obta<strong>in</strong>ed the necessary EIA licence from the EPA, allow<strong>in</strong>g it to<br />

proceed with the planned development. 103 The permit was granted despite be<strong>in</strong>g disputed by<br />

community members <strong>in</strong> a jo<strong>in</strong>t letter dated 18 th August 2011, claim<strong>in</strong>g <strong>in</strong>ter alia that the<br />

project would amount to eviction due to the loss of crop l<strong>and</strong>; that the ESIA consultants failed<br />

to give sufficient weight to community concerns <strong>in</strong> its conclusions; <strong>and</strong> that the government<br />

failed to consult the communities before grant<strong>in</strong>g the concession.<br />

In a letter dated 29 th August 2011, the EPA contacted <strong>Sime</strong> <strong>Darby</strong> accus<strong>in</strong>g it of a ‘willful<br />

violation of the Environment Protection <strong>and</strong> Management Law of Liberia’, highlight<strong>in</strong>g the<br />

lack of a monitor<strong>in</strong>g report as <strong>in</strong>structed <strong>in</strong> the EPA permit conditions, <strong>and</strong> a lack of<br />

engagement with the other permit conditions. In a subsequent letter dated 5 th October 2011,<br />

the EPA imposed a f<strong>in</strong>e of $50,000 USD on <strong>Sime</strong> <strong>Darby</strong> for violations specified <strong>in</strong> the 29 th<br />

August 2011 letter that had not been addressed. 104 The EPA letter followed compla<strong>in</strong>ts sent<br />

by Green Advocates to the EPA that <strong>Sime</strong> <strong>Darby</strong> was <strong>in</strong> violation of the environmental law<br />

<strong>and</strong> the EIA licence requirements.<br />

8. The right to free, prior <strong>and</strong> <strong>in</strong>formed consent: a compliance analysis of <strong>Sime</strong> <strong>Darby</strong><br />

<strong>and</strong> the government of Liberia<br />

8.1. What has either the government or the company done or not done, to allow<br />

recognition of communities’ rights to their customary l<strong>and</strong> <strong>and</strong>/or to give or<br />

withhold their FPIC<br />

<strong>Sime</strong> <strong>Darby</strong><br />

As evident from the concession contract as discussed above, the company’s negotiations led<br />

to a contract that is <strong>in</strong>consistent with <strong>in</strong>ternational law <strong>and</strong> RSPO st<strong>and</strong>ards, <strong>in</strong>clud<strong>in</strong>g a<br />

failure to recognise community l<strong>and</strong> rights or provide provisions for respect<strong>in</strong>g the<br />

communities’ rights to FPIC.<br />

<strong>Sime</strong> <strong>Darby</strong> <strong>in</strong> Monrovia outl<strong>in</strong>ed the process through which they had <strong>in</strong>formed the<br />

communities, <strong>and</strong> it seems clear from their account that this process does not satisfy the<br />

requirements for FPIC as set out <strong>in</strong> the RSPO Pr<strong>in</strong>ciples & Criteria, <strong>and</strong> as described by<br />

<strong>in</strong>ternational human rights law <strong>and</strong> jurisprudence. The <strong>Sime</strong> <strong>Darby</strong> powerpo<strong>in</strong>t outl<strong>in</strong><strong>in</strong>g the<br />

FPIC process, referred to the second step <strong>in</strong> this process as ‘Conduct Propag<strong>and</strong>a Campaign<br />

on the Ground’. In addition, <strong>Sime</strong> <strong>Darby</strong>’s Liberian manager responsible for FPIC described<br />

the process as tell<strong>in</strong>g communities that: (1) l<strong>and</strong> will be developed, (2) a portion of l<strong>and</strong> will<br />

be left for agriculture, <strong>and</strong> (3) there will be an ‘out-growers’ scheme <strong>and</strong> agro-forestry for the<br />

communities. 105 <strong>Sime</strong> <strong>Darby</strong> <strong>in</strong>formed communities that their farml<strong>and</strong> would be left: ‘The<br />

l<strong>and</strong> <strong>in</strong> question is not be<strong>in</strong>g taken away by <strong>Sime</strong> <strong>Darby</strong> forcibly but the farm<strong>in</strong>g activities<br />

you have carried out will cont<strong>in</strong>ue to be carried out’, <strong>and</strong> that the improvement will be <strong>in</strong><br />

‘everyone’s liv<strong>in</strong>g st<strong>and</strong>ards: there will be schools, safe dr<strong>in</strong>k<strong>in</strong>g water’.<br />

From <strong>Sime</strong> <strong>Darby</strong>’s explanation it was clear that communities were given the impression that<br />

their farm l<strong>and</strong> would rema<strong>in</strong>, <strong>and</strong> that <strong>Sime</strong> <strong>Darby</strong> would be develop<strong>in</strong>g l<strong>and</strong> further away<br />

from them while also giv<strong>in</strong>g them an opportunity to benefit from employment <strong>and</strong> from<br />

tak<strong>in</strong>g part <strong>in</strong> the out-growers scheme.<br />
