<strong>Sime</strong> <strong>Darby</strong> <strong>oil</strong> <strong>palm</strong> <strong>and</strong> <strong>rubber</strong> <strong>plantation</strong> <strong>in</strong> Gr<strong>and</strong> <strong>Cape</strong> <strong>Mount</strong> county, Liberia<br />

1. Introduction<br />

<strong>Sime</strong> <strong>Darby</strong>’s <strong>oil</strong> <strong>palm</strong> <strong>and</strong> <strong>rubber</strong> concession <strong>in</strong> Gr<strong>and</strong> <strong>Cape</strong> <strong>Mount</strong> county <strong>in</strong> northwest<br />

Liberia has come under sharp national <strong>and</strong> <strong>in</strong>ternational focus after a compla<strong>in</strong>t was<br />

submitted under the RSPO New Plant<strong>in</strong>gs Procedure (NPP) <strong>in</strong> November 2011. The<br />

compla<strong>in</strong>t, submitted by communities affected by the concession, claimed that their Free,<br />

Prior <strong>and</strong> Informed Consent (FPIC) had not been sought, <strong>and</strong> that the destruction of their<br />

farml<strong>and</strong>s by the company <strong>in</strong> order to plant <strong>palm</strong> <strong>oil</strong> was leav<strong>in</strong>g them destitute. <strong>Sime</strong><br />

<strong>Darby</strong>’s concession also <strong>in</strong>cludes l<strong>and</strong> <strong>in</strong> the neighbour<strong>in</strong>g counties of Bomi, Gbarpolu <strong>and</strong><br />

Bong. This case study, based on field research conducted <strong>in</strong> February 2012, assesses the<br />

nature <strong>and</strong> extent of community <strong>in</strong>volvement <strong>in</strong> the acquisition of l<strong>and</strong> for <strong>Sime</strong> <strong>Darby</strong>’s<br />

concession <strong>in</strong> Gr<strong>and</strong> <strong>Cape</strong> <strong>Mount</strong>, <strong>in</strong> particular with regard to whether the right to Free, Prior<br />

<strong>and</strong> Informed Consent was respected. 1<br />

Liberia is known to have the best rema<strong>in</strong><strong>in</strong>g examples of the ‘Upper Gu<strong>in</strong>ea’ forest. 2 Gr<strong>and</strong><br />

<strong>Cape</strong> <strong>Mount</strong> <strong>and</strong> neighbour<strong>in</strong>g Gbarpolu conta<strong>in</strong> one of the two rema<strong>in</strong><strong>in</strong>g large forest areas<br />

<strong>in</strong> Liberia, <strong>and</strong> l<strong>and</strong> <strong>in</strong> <strong>and</strong> around <strong>Sime</strong> <strong>Darby</strong>’s operations <strong>in</strong> Gr<strong>and</strong> <strong>Cape</strong> <strong>Mount</strong> <strong>in</strong>cludes<br />

mixed shift<strong>in</strong>g cultivation <strong>and</strong> forest. Liberia’s natural resource governance, <strong>and</strong> <strong>in</strong> particular<br />

the trades <strong>in</strong> diamonds <strong>and</strong> timber, played a significant role <strong>in</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g the fourteen-year<br />

armed conflict <strong>in</strong> Liberia <strong>and</strong> the region, which led to the UN Security Council plac<strong>in</strong>g<br />

sanctions on timber, diamonds <strong>and</strong> arms <strong>in</strong> 2003. 3 Poor governance <strong>in</strong> relation to l<strong>and</strong> <strong>and</strong><br />

resources, <strong>in</strong>clud<strong>in</strong>g corruption <strong>and</strong> bias along ethnic l<strong>in</strong>es, <strong>and</strong> government policy lead<strong>in</strong>g to<br />

a sudden rise <strong>in</strong> the price of food are seen as some of the key triggers for fourteen years of<br />

civil conflict which ended <strong>in</strong> 2003. The conflict caused over a quarter of a million deaths <strong>and</strong><br />

led to more than 1.3 million people be<strong>in</strong>g displaced from their homes. 4<br />

2. The communities <strong>and</strong> their historical relationship to the l<strong>and</strong> <strong>and</strong> customary norms<br />

The pr<strong>in</strong>cipal ethnic group among the affected communities <strong>in</strong> the Gr<strong>and</strong> <strong>Cape</strong> <strong>Mount</strong> is the<br />

‘Vai’, one of the sixteen pr<strong>in</strong>cipal tribal groups <strong>in</strong> Liberia. 5 These groups are dist<strong>in</strong>ct from the<br />

descendants of freed slaves from the United States of America who settled <strong>in</strong> Liberia <strong>in</strong> the<br />

early n<strong>in</strong>eteenth century under the <strong>in</strong>itiative of colonisation societies set up for this purpose.<br />

The affected communities also <strong>in</strong>clude <strong>in</strong>dividuals from other parts of Liberia <strong>and</strong> from other<br />

ethnic groups, who have moved <strong>in</strong>to the area as a result of <strong>in</strong>ternal displacement from the<br />

civil war (<strong>in</strong>clud<strong>in</strong>g ex-combatants), as well as economic migrants such as those seek<strong>in</strong>g<br />

employment from <strong>Sime</strong> <strong>Darby</strong>.<br />

The largest settlements <strong>in</strong> the area are known as towns, with a collection of towns mak<strong>in</strong>g up<br />

a clan. The affected area comprises eighteen towns <strong>in</strong> the Garwula District who are all part of<br />

the Vai ‘Manobah’ clan. Traditional l<strong>and</strong> use practices <strong>and</strong> settlement patterns are dynamic<br />

<strong>and</strong> change over time. Some areas, for example, have been impacted by the development of<br />

the BF Goodrich <strong>rubber</strong> <strong>plantation</strong> <strong>in</strong> 1954, now <strong>in</strong>corporated <strong>in</strong>to <strong>Sime</strong> <strong>Darby</strong>’s concession<br />

area.<br />

The affected towns <strong>and</strong> villages <strong>and</strong> adjacent communities engage <strong>in</strong> multiple <strong>and</strong><br />

overlapp<strong>in</strong>g l<strong>and</strong> uses. As well as shift<strong>in</strong>g agriculture for subsistence food crops (e.g. cassava,<br />

rice, okra, ‘bitter ball’- a k<strong>in</strong>d of auberg<strong>in</strong>e, peppers, maize etc.), families will often also<br />

grow cash crops (e.g. sugar cane, cocoa, <strong>rubber</strong>, oranges, mango, avocado, kola nut <strong>and</strong><br />

native <strong>oil</strong> <strong>palm</strong>). Cash crops are planted by community members to meet future cash needs,<br />

for example as a k<strong>in</strong>d of pension/<strong>in</strong>surance for when they are unable to do the more heavy<br />
