Recommendati<strong>on</strong> 1:<br />
Definiti<strong>on</strong> of key terms<br />
<str<strong>on</strong>g>ARTICLE</str<strong>on</strong>g> <str<strong>on</strong>g>19</str<strong>on</strong>g> recommends the following<br />
definiti<strong>on</strong> of the key terms of Article 20(2) –<br />
and of Article 4(a) of ICERD. 38<br />
• “Hatred” is a state of mind characterised<br />
as “intense and irrati<strong>on</strong>al emoti<strong>on</strong>s of<br />
opprobrium, enmity and detestati<strong>on</strong><br />
<strong>to</strong>wards the target group.” 39<br />
• “Discriminati<strong>on</strong>” shall be unders<strong>to</strong>od<br />
as any distincti<strong>on</strong>, exclusi<strong>on</strong>, restricti<strong>on</strong><br />
or preference based <strong>on</strong> race, gender,<br />
ethnicity, religi<strong>on</strong> or belief, disability, age,<br />
sexual orientati<strong>on</strong>, language political or<br />
other opini<strong>on</strong>, nati<strong>on</strong>al or social origin,<br />
nati<strong>on</strong>ality, property, birth or other status,<br />
colour which has the purpose or effect of<br />
nullifying or impairing the recogniti<strong>on</strong>,<br />
enjoyment or exercise, <strong>on</strong> an equal<br />
footing, of human rights and fundamental<br />
freedoms in the political, ec<strong>on</strong>omic,<br />
social, cultural or any other field of<br />
public life. 40<br />
• “Violence” shall be unders<strong>to</strong>od as the<br />
intenti<strong>on</strong>al use of physical force or power<br />
against another pers<strong>on</strong>, or against a<br />
group or community that either results<br />
in or has a high likelihood of resulting<br />
in injury, death, psychological harm,<br />
maldevelopment, or deprivati<strong>on</strong>. 41<br />
• “Hostility” shall be unders<strong>to</strong>od as a<br />
manifested acti<strong>on</strong> of an extreme state<br />
of mind. Although the term implies a<br />
state of mind, an acti<strong>on</strong> is required.<br />
Hence, hostility can be defined as the<br />
manifestati<strong>on</strong> of hatred – that is the<br />
manifestati<strong>on</strong> of “intense and irrati<strong>on</strong>al<br />
emoti<strong>on</strong>s of opprobrium enmity and<br />
detestati<strong>on</strong> <strong>to</strong>wards the target group”. 42<br />
A clear, uniform definiti<strong>on</strong> of these terms<br />
would not <strong>on</strong>ly provide the certainty needed<br />
for an obligati<strong>on</strong> which prohibits specific<br />
c<strong>on</strong>duct in this way, but would also mean<br />
that the obligati<strong>on</strong> would be c<strong>on</strong>sistently<br />
applied in jurisprudence.<br />
Recommendati<strong>on</strong> 2:<br />
N<strong>on</strong>-exhaustive prohibited<br />
grounds <strong>on</strong> <strong>incitement</strong><br />
Article 2(1) and Article 26 of the ICCPR<br />
guarantee an equal enjoyment of the rights<br />
stipulated in the ICCPR and the equal<br />
protecti<strong>on</strong> of the law irrespective of “race,<br />
colour, sex, language, religi<strong>on</strong>, political<br />
or other opini<strong>on</strong>, nati<strong>on</strong>al or social origin,<br />
property, birth or other status.”<br />
