narrowly defined as “advocacy of hatred<br />
<strong>on</strong> prohibited grounds that c<strong>on</strong>stitutes<br />
<strong>incitement</strong> <strong>to</strong> discriminati<strong>on</strong>, hostility or<br />
violence” (in short, “<strong>incitement</strong> <strong>to</strong> hatred”<br />
or “<strong>incitement</strong>”).<br />
The aim of this <str<strong>on</strong>g>policy</str<strong>on</strong>g> paper is twofold.<br />
Firstly, it offers a detailed set of<br />
recommendati<strong>on</strong>s <strong>on</strong> how States should<br />
interpret their obligati<strong>on</strong>s under Article<br />
20(2) of the ICCPR. Sec<strong>on</strong>dly, with the<br />
aim of moving <strong>to</strong>wards greater c<strong>on</strong>sensus<br />
<strong>on</strong> this issue, it proposes a comprehensive<br />
test <strong>to</strong> be used for reviewing cases and for<br />
determining whether a particular expressi<strong>on</strong><br />
reaches the threshold of <strong>incitement</strong> <strong>to</strong><br />
hatred. <str<strong>on</strong>g>ARTICLE</str<strong>on</strong>g> <str<strong>on</strong>g>19</str<strong>on</strong>g> seeks <strong>to</strong> establish<br />
clear boundaries between permissible and<br />
impermissible expressi<strong>on</strong>, as well as robust<br />
criteria that can be used. Our objective<br />
in doing so is <strong>to</strong> help ensure that all<br />
people enjoy the rights <strong>to</strong> both freedom of<br />
expressi<strong>on</strong> and equality.<br />
This <str<strong>on</strong>g>policy</str<strong>on</strong>g> paper builds <strong>on</strong> the recent<br />
foundati<strong>on</strong> work undertaken by <str<strong>on</strong>g>ARTICLE</str<strong>on</strong>g> <str<strong>on</strong>g>19</str<strong>on</strong>g><br />
<strong>on</strong> this subject. This includes:<br />
• The Camden Principles <strong>on</strong> Equality<br />
and Freedom of Expressi<strong>on</strong> (“Camden<br />
Principles”) 3 developed in 2009 in<br />
collaborati<strong>on</strong> with a panel of internati<strong>on</strong>al<br />
human rights legal scholars and experts;<br />
• The <strong>on</strong>e-day expert meeting organised<br />
at the end of 2010 by <str<strong>on</strong>g>ARTICLE</str<strong>on</strong>g> <str<strong>on</strong>g>19</str<strong>on</strong>g><br />
and Columbia University <strong>to</strong> unpack<br />
the elements c<strong>on</strong>stitutive <strong>to</strong> Article<br />
20(2) of the ICCPR and their various<br />
interpretati<strong>on</strong>s. This meeting allowed a<br />
preliminary determinati<strong>on</strong> of a threshold<br />
test for Article 20(2);<br />
• The five regi<strong>on</strong>al analyses of <strong>incitement</strong><br />
legislati<strong>on</strong> and implementati<strong>on</strong><br />
c<strong>on</strong>tributed by <str<strong>on</strong>g>ARTICLE</str<strong>on</strong>g> <str<strong>on</strong>g>19</str<strong>on</strong>g> as part of a<br />
series of expert workshops organised by<br />
the Office of the High Commissi<strong>on</strong>er for<br />
Human Rights (“OHCHR”) throughout<br />
2011 and 2012. 4/5 These analyses<br />
included an evolving set of criteria <strong>to</strong> be<br />
used <strong>to</strong> assess whether <strong>incitement</strong> cases<br />
have met the threshold of Article 20(2) of<br />
the ICCPR.<br />
This <str<strong>on</strong>g>policy</str<strong>on</strong>g> paper offers a final versi<strong>on</strong><br />
of this test based <strong>on</strong> the feedback and<br />
critiques offered by participants <strong>to</strong> the<br />
OHCHR workshops. It is divided in<strong>to</strong> four<br />
main secti<strong>on</strong>s.<br />
• The first secti<strong>on</strong> provides an overview<br />
of the internati<strong>on</strong>al standards that<br />
apply and the problems related <strong>to</strong> their<br />
interpretati<strong>on</strong>;<br />
• The sec<strong>on</strong>d secti<strong>on</strong> proposes key overriding<br />
principles that should guide <str<strong>on</strong>g>policy</str<strong>on</strong>g> making<br />
and interpretati<strong>on</strong> of <strong>incitement</strong>;<br />
