C<strong>on</strong>clusi<strong>on</strong><br />
In c<strong>on</strong>clusi<strong>on</strong>, <str<strong>on</strong>g>ARTICLE</str<strong>on</strong>g> <str<strong>on</strong>g>19</str<strong>on</strong>g> hopes that<br />
the recommendati<strong>on</strong>s we have proposed<br />
in this paper will help dispel current<br />
global and nati<strong>on</strong>al c<strong>on</strong>fusi<strong>on</strong> about the<br />
implementati<strong>on</strong> and interpretati<strong>on</strong> of<br />
States’ internati<strong>on</strong>al obligati<strong>on</strong>s <strong>to</strong><br />
prohibit <strong>incitement</strong> <strong>to</strong> discriminati<strong>on</strong>,<br />
hostility and violence.<br />
In creating a new six-part <strong>incitement</strong> test,<br />
we aim <strong>to</strong> provide States with the means<br />
of avoiding both the vague and overly<br />
broad prohibiti<strong>on</strong>s of <strong>incitement</strong> that can<br />
be found in many nati<strong>on</strong>al laws and the<br />
inc<strong>on</strong>sistent and restrictive interpretati<strong>on</strong>s<br />
that can also be frequently seen. We believe<br />
that using this test will help States review<br />
cases and determine whether particular<br />
speech reaches the threshold of <strong>incitement</strong><br />
<strong>to</strong> hatred.<br />
If States accompany the use of the test<br />
with the development of an appropriate<br />
variety of measures, including sancti<strong>on</strong>s –<br />
primarily civil and administrative – which<br />
they use <strong>to</strong> implement their obligati<strong>on</strong>s<br />
c<strong>on</strong>sistently, we will have helped <strong>to</strong> ensure<br />
that all people everywhere are able <strong>to</strong> enjoy<br />
both the right <strong>to</strong> freedom of expressi<strong>on</strong> and<br />
the right <strong>to</strong> equality.<br />
