From the CEO<br />

This issue includes our Annual Report for<br />

the 2011 year, highlighting some <strong>of</strong> the key<br />

developments and on-going benefits for<br />

members. For me, the highlight was the<br />

diversity <strong>of</strong> the incredible businesses we<br />

visited as part <strong>of</strong> the BNZ Partners Business<br />

After Fives and Bowater Motor Group<br />

Women’s Networking Functions. These were<br />

a real source <strong>of</strong> inspiration. I particularly<br />

want to thank our BNZ Business After Five<br />

hosts where attendance was <strong>of</strong>ten around<br />

100 business people (up on average 13%<br />

from two years ago). These functions <strong>of</strong>fer a<br />

fantastic opportunity for business owners to<br />

share ideas and expertise, to learn from each<br />

other in an informal setting and to foster<br />

and build their business connections.<br />

The art <strong>of</strong> networking, knowing how to<br />

‘work a room’ doesn’t come naturally, and<br />

the “Top Tips for Networking” workshop<br />

we piloted in 2011 has proved so successful<br />

we are continuing with these workshops<br />

this year. If you haven’t already booked<br />

to attend one, I encourage you to do<br />

so and make the most <strong>of</strong> the business<br />

networking and promotional opportunities<br />

membership brings.<br />

A new member to member service being<br />

launched this month is 30 minutes free<br />

employment relations (ER) advice. This<br />

exciting new development comes at the<br />

request <strong>of</strong> members for affordable, quality<br />

advice in this area. It covers ER advice – the<br />

here and now – not the more long term<br />

strategic HR field, although the need for<br />

further work in this area may well stem<br />

from an immediate ER issue. As a member,<br />

we encourage you to make use <strong>of</strong> this<br />

new service if and when the need arises in<br />

your business. The depth <strong>of</strong> expertise local<br />

members have is impressive and we thank<br />

the members who are taking part in this<br />

new member to member <strong>of</strong>fer. See inside for<br />

details – and let us know your feedback.<br />

25 year milestone – there is no doubt it will<br />

Salmon: business growth <strong>of</strong> national<br />

significance<br />

All New Zealanders now get to<br />

have a say on a proposal that<br />

has the potential to earn the<br />

country hundreds <strong>of</strong> millions <strong>of</strong><br />

dollars in export revenue.<br />

<strong>Nelson</strong>-based New Zealand King Salmon<br />

has applied to the Environmental Protection<br />

Authority (EPA) to commission nine new<br />

salmon farms over an extended period in<br />

the Marlborough Sounds.<br />

The company’s application has been<br />

‘publicly notified’ by the Board <strong>of</strong> Inquiry<br />

(BOI) established by the Environmental<br />

Protection Authority which means<br />

submissions are now open until <strong>May</strong> 2.<br />

Anyone who wants to can <strong>of</strong>fer their support,<br />

either solely in a written submission or in<br />

tandem with an appearance before the<br />

board.<br />

Reports prepared for the company and<br />

submitted with its application show that if<br />

fully approved, its additional production will<br />

provide up to 120 new jobs in the region.<br />

Its export earnings are forecast to nearly<br />

quadruple from the current $60 million to<br />

more than $230 million a year by 2015.<br />

The company’s plans are capable <strong>of</strong><br />

delivering huge growth for Marlborough<br />

and for New Zealand utilising a quality and<br />

sustainable product that occupies only a<br />

small amount <strong>of</strong> space it says.<br />

NZ King Salmon CEO Grant Rosewarne<br />

is urging New Zealanders to support<br />

his company’s application to promote<br />

sustainable jobs and preserve the<br />

environment for future generations.<br />

“There are huge benefits for New Zealand<br />

and for Marlborough in our plans but we<br />

cannot accomplish those without the<br />

support <strong>of</strong> the community and the ‘silent<br />

majority’. In total, the amount <strong>of</strong> additional<br />

surface water space that will be farmed is a<br />

tiny 12 hectares out <strong>of</strong> the total Sounds area<br />

<strong>of</strong> 150,000 hectares.<br />

“We are world’s biggest producer <strong>of</strong> King<br />

salmon with 55 per cent <strong>of</strong> the global<br />

market and currently we simply cannot meet<br />

demand. Offshore our brand is well known<br />

and preferred among many pr<strong>of</strong>essional<br />

chefs and in the hospitality industry so it has<br />

a high pr<strong>of</strong>ile.<br />

“We are the largest single contributor <strong>of</strong> long<br />

chain Omega-3s in the NZ diet and as such<br />

we make a major contribution to healthy<br />

child brain development, healthy joints,<br />

reduced heart disease and better eyesight.<br />

“Our business has a bright future sustainably<br />

producing a healthy and delicious food<br />

product for which New Zealand already has<br />

a strong international reputation.<br />

“A positive submission is a rare opportunity<br />

for local people to add huge value to our<br />

region and show the world we can have<br />

premium branded Marlborough salmon<br />

while preserving our environment for future<br />

generations.”<br />

Mr Rosewarne says if the company is able to<br />

grow its business it will be well on the way to<br />

creating a cluster <strong>of</strong> supporting businesses.<br />

“The economic benefits go very deep. All<br />

sorts <strong>of</strong> local and national businesses will<br />

benefit from work associated with the<br />

construction and our ongoing operations<br />

– engineering, education, taxis, marine<br />

industry, net makers, transport and hotels<br />

and hospitality industry operators.”<br />

He says the company also hopes to be able<br />

to increase production to the point that<br />

the industry can support a feed mill in New<br />

Zealand with “huge downstream benefits”.<br />

information to support their position until<br />

the evidence exchange part <strong>of</strong> the process,<br />

expected to start in mid-August.<br />

Computing in the clouds<br />

At WHK, more and more<br />

<strong>of</strong> our clients are starting<br />

to implement cloud based<br />

technologies. But what does<br />

the term ‘cloud computing’<br />

actually mean in simple terms<br />

and what are some <strong>of</strong> the<br />

benefits and implications <strong>of</strong><br />

this technology?<br />

Not as ambiguous as it sounds cloud<br />

computing simply refers to an internetbased<br />

computing service where users are<br />

provided with access to servers, s<strong>of</strong>tware,<br />

applications, storage and networking via<br />

the internet. That means the client does not<br />

have a local server, a back up server, or any<br />

<strong>of</strong> the s<strong>of</strong>tware applications.<br />

While this may sound a bit geeky, you<br />

are probably already using cloud based<br />

applications in some way: gmail, skype<br />

and internet banking are all cloud<br />

based applications.<br />

S<strong>of</strong>tware providers, like Xero, are making the<br />

most <strong>of</strong> cloud computing by providing user<br />

friendly accounting solutions for clients. This<br />

technology can simplify accounting work,<br />

making the process simpler for both the<br />

client and the accountant!<br />

Here are some <strong>of</strong> the benefits <strong>of</strong> moving<br />

your computing needs to a cloud:<br />

• Cost effectiveness: cloud technology<br />

can, in some cases, deliver considerable<br />

savings on s<strong>of</strong>tware, hardware, power<br />

and support expenses.<br />

• Easy to use: cloud technology is<br />

generally user friendly and usually<br />

just requires a computer, browser and<br />

internet connection, resulting in very few<br />

maintenance requirements.<br />

• Accessibility: one <strong>of</strong> the major benefits<br />

<strong>of</strong> cloud technology is that it can be<br />

accessed anytime and anywhere, making<br />

work a lot easier for employees who work<br />

remotely.<br />

• Security: many people have security<br />

concerns when it comes to cloud<br />

technology; however, with proper<br />

physical security, anti-virus s<strong>of</strong>tware,<br />

and firewall protection your data is just<br />

as safe as it would be using traditional<br />

technology.<br />

• Disaster recovery: using cloud<br />

technology to backup data in an<br />

alternative location allows crucial<br />

information to be recovered quickly and<br />

business operations to return to normal<br />

as soon as possible.<br />

• Sustainability: cloud technologies can<br />

be better for the environment due to<br />

reduced paper and energy requirements.<br />

As with anything that’s new and a bit<br />

techie it is normal for businesses to<br />

have some concerns when thinking<br />

about implementing this technology.<br />

Unsurprisingly security, availability and<br />

performance are the top concerns cited<br />

by everyday business owners when<br />

contemplating making the move to<br />

cloud computing.<br />

These are valid concerns as security<br />

breaches, problems with accessing data and<br />

reduced performance have been widely<br />

reported in the media. However, experts<br />

have described these issues as being ‘like<br />

airplane disasters’ in that they happen<br />

very infrequently: there are trillions <strong>of</strong><br />

transactions a day but you only hear about<br />

the very few that go wrong!<br />

For an easy move to the cloud and to make<br />

the most <strong>of</strong> what this new technology has to<br />

<strong>of</strong>fer, ensure that you get sufficient support<br />

and advice from trained IT pr<strong>of</strong>essionals.<br />

NMIT students help strengthen China<br />

friendship<br />

<strong>Nelson</strong> Marlborough Institute <strong>of</strong><br />

Technology is strengthening its<br />

relationship with China thanks<br />

to a little help from its students.<br />

NMIT has selected two Bachelor <strong>of</strong><br />

Information Technology (IT) and three<br />

Bachelor <strong>of</strong> <strong>Commerce</strong> students for a<br />

three-week trip to China this month where<br />

they will assist NMIT tutors in the delivery<br />

<strong>of</strong> management and s<strong>of</strong>tware development<br />

courses at one <strong>of</strong> its sister universities -<br />

Zhejiang Water College in Hangzhou City.<br />

NMIT Management lecturer John Inglis<br />

says it is the third year students have<br />

accompanied tutors on the annual trip and<br />

the first time IT students have been included.<br />

“It is a chance to showcase NMIT’s brightest<br />

talent in the emerging Chinese market<br />

while rewarding top students with a unique<br />

learning opportunity,” John says. “The trip<br />

opens their eyes to a new culture, gives<br />

them confidence in coping with different<br />

situations and shows them the opportunities<br />

that exist. It’s a brilliant experience –<br />

especially for our business and IT students<br />

who will work in a globalized economy.”<br />

Bachelor <strong>of</strong> <strong>Commerce</strong> student Melissa<br />

Withers is among those selected for the trip.<br />

The 24-year-old has never visited China but<br />

has been reading up about the country.<br />

“It’s going to be a really interesting and<br />

fun experience. China is such a rapidly<br />

expanding country with a fascinating culture<br />

- there’s so much to learn.”<br />

She is looking forward to experiencing a<br />

new culture and sharing her knowledge and<br />

expertise with her Chinese counterparts.<br />

The trip is paid for by NMIT at a cost <strong>of</strong><br />

around $3000 per student, including travel<br />

and accommodation expenses. As well as<br />

assisting with the management course the<br />

students will visit Shanghai and explore<br />

Hangzhou City, which has a population<br />

<strong>of</strong> about 8 million and is built around an<br />

expansive man-made lake.<br />

IT student Tim Macintosh is also <strong>of</strong>f to China<br />

for the first time. In his final year <strong>of</strong> a three<br />

year Bachelor in Information Technology<br />

degree, majoring in web and s<strong>of</strong>tware<br />

development, he hopes the experience will<br />

improve his chances <strong>of</strong> securing a job at the<br />

end <strong>of</strong> the year.<br />

“Employers will hopefully see it shows<br />

you’re prepared to go out <strong>of</strong> your<br />

comfort zone and see things from<br />

another perspective.”<br />

Zhejiang Water College is one <strong>of</strong> three<br />

Chinese universities that NMIT has<br />

established a successful international<br />

partnership with. NMIT delivers programmes<br />

at the universities and the Chinese students<br />

also come to New Zealand to study at NMIT’s<br />

<strong>Nelson</strong> and Marlborough campuses.<br />

“By developing strong relationships<br />

with these universities NMIT is helping<br />

bring Chinese students to the <strong>Nelson</strong><br />

Marlborough region,” John says. “As<br />

the global education market is highly<br />

competitive, these types <strong>of</strong> initiatives can<br />

give us an edge.”<br />

For Tim, one <strong>of</strong> the highlights <strong>of</strong> going<br />

to China will be having the opportunity<br />

to share everything he has learned so far<br />

through NMIT.<br />

“I hope to bring my knowledge, enthusiasm<br />

and a bit <strong>of</strong> fun to the lessons in China. I’ve<br />

really enjoyed my time at NMIT and feel<br />

Annual Report: 2011 in Review<br />

2011 has seen the <strong>Chamber</strong> position itself more<br />

closely at the centre <strong>of</strong> business activity in the<br />

region. As a result, membership has remained<br />

strong (at around 500 businesses), the levels<br />

<strong>of</strong> attendance at functions and events has<br />

remained high, and we introduced a new series<br />

<strong>of</strong> workshops and information sharing sessions<br />

for business owners.<br />

The attached graphs illustrate the strength <strong>of</strong> the <strong>Chamber</strong> – with<br />

a stable membership (44% <strong>of</strong> our members have been with the<br />

<strong>Chamber</strong> for over 5 years) representative <strong>of</strong> the businesses in our<br />

region (83% <strong>of</strong> members are true “SME” businesses, with less than 11<br />

full time staff). Levels <strong>of</strong> engagement by members continues to climb,<br />

with the attached graph showing average attendance levels at the<br />

BNZ Partners Business After Five reach 87 business people!<br />

There was plenty <strong>of</strong> fun last year, including over 700 businesses<br />

participating in the Long Lunch down the centre <strong>of</strong> Trafalgar<br />

Street. And there has been plenty <strong>of</strong> hard work on key issues<br />

facing the region. The refocusing <strong>of</strong> our advocacy work through an<br />

Infrastructure Group (chaired by Gary Stocker, Knapps Lawyers) and<br />

the on-going work <strong>of</strong> the Regional Issues Group (chaired by Mike<br />

McMellon, Pitt & Moore) has seen significant challenging <strong>of</strong> local<br />

government priorities and a clearer voice for business.<br />

A key issue has been the Local Government Commission’s<br />

examination <strong>of</strong> the call for a combined <strong>Nelson</strong> <strong>Tasman</strong> District. The<br />

benefits <strong>of</strong> amalgamation from a business point <strong>of</strong> view are clear –<br />

certainty and consistency <strong>of</strong> decision making based on one regional<br />

plan will lead to cost savings for business owners, better take up<br />

<strong>of</strong> regional opportunities and minimisation <strong>of</strong> duplication <strong>of</strong> effort.<br />

Whatever the final governance arrangements, the <strong>Chamber</strong> will<br />

continue to advocate strongly for business and work to achieve a<br />

more business friendly environment.<br />

The late Sir Paul Callaghan, the keynote speaker at Aspire 2011,<br />

inspired conference attendees to ensure our region is a place where<br />

talented people choose to live. That challenge has underpinned<br />

much <strong>of</strong> the <strong>Chamber</strong>’s advocacy role this year as we have focused<br />

on ensuring Council use <strong>of</strong> rate payer funds is focused on creating an<br />

environment conducive to business investment and prosperity.<br />

The redesign <strong>of</strong> our website in 2011, commerce.org.nz makes it easier<br />

for members and the wider business community to access the latest<br />

business information, identify where to go for advice and find out<br />

the services <strong>of</strong>fered by our members. The business directory has<br />

emerged as the most visited page and the upgrade listing available<br />

makes those members stand out.<br />

Another significant development in 2011 was the partnership with<br />

the Marlborough <strong>Chamber</strong> <strong>of</strong> <strong>Commerce</strong> and the <strong>Nelson</strong> Regional<br />

Economic Development Agency, to become the Regional Business<br />

Partner for the Top <strong>of</strong> the South. Our role is to work with business<br />

owners to improve their business capability and achieve their<br />

growth plans. Over 100 businesses took advantage <strong>of</strong> the free<br />

business assessment and the “Where to” Workshops and we issued<br />

38 vouchers for business capability training. Our sincere thanks to<br />

the experienced business people who have shared their expertise<br />

at these workshops – Mike McMellon, Rob Lane and Nick Mason<br />

Defamation in the Electronic Age<br />

Given the recent high pr<strong>of</strong>ile<br />

defamation claim by Chris<br />

Cairns against a Mr Lalit<br />

Modi arising from a single<br />

“tweet” sent by Mr Modi, it<br />

is worthwhile reviewing the<br />

risks <strong>of</strong> defamation in the<br />

electronic age. Some people<br />

have the misconception that<br />

the rules <strong>of</strong> defamation don’t<br />

apply to the Internet. Another<br />

common misconception is that<br />

defamation is only relevant to<br />

the rich and famous and need<br />

not concern ordinary folk.<br />

By way <strong>of</strong> general background a defamatory<br />

statement is one which falsely discredits<br />

a person and exposes them to ridicule. A<br />

business can also be defamed. One <strong>of</strong> the<br />

most common grounds <strong>of</strong> defamation<br />

actions arise from imputations that a person<br />

is incompetent or unfit for a job or role. Even<br />

claims that a person is lazy or shirks their<br />

duty have been found to be defamatory.<br />

One requirement for defamation is that the<br />

words are published. Some people think<br />

that this only refers to newspapers or the<br />

like and that statements disseminated<br />

over the Internet are somehow different<br />

because <strong>of</strong> the open culture <strong>of</strong> the Internet<br />

which protects more robust discussion<br />

and comments than traditional media. The<br />

Courts have been very clear in rejecting this.<br />

The rules <strong>of</strong> defamation apply every bit as<br />

much to comments posted online as on the<br />

printed page.<br />

In fact Internet based defamation can be<br />

a lot more dangerous than conventional<br />

sources given the almost infinite ability to<br />

republish and disseminate comments (as<br />

Mr Modi seems to have found out given<br />

the impact <strong>of</strong> his single tweet). Defamation<br />

on the net occurs at the time and in the<br />

place where the defamatory material is<br />

downloaded. Accordingly you can find<br />

yourself sued in any number <strong>of</strong> countries<br />

based on what you consider to be your New<br />

Zealand web page or forum. All <strong>of</strong> these<br />

issues apply equally to comments posted on<br />

Facebook and other social media.<br />

The other popular misconception is that<br />

defamation is some sort <strong>of</strong> rich man’s game<br />

that only applies to well known actors,<br />

politicians, or sports people. It is true that<br />

many actions do involve these players and<br />

that they seem to meander through the<br />

Courts for many years until everyone has<br />

forgotten about the original insult and<br />

everything is settled behind closed doors.<br />

However defamation can apply to everyone,<br />

and (as the comments above referring to<br />

incompetence or the like show) can apply<br />

to what might appear to be relatively<br />

innocuous comments.<br />

There can also be a real sting in the form<br />

<strong>of</strong> damages for actions between ordinary<br />

people. For example one New Zealand<br />

decision involved an argument between<br />

two taxi drivers where one taxi driver said,<br />

in the hearing <strong>of</strong> other drivers on the rank,<br />

that an innocent taxi driver had paedophile<br />

convictions. Even although it was only<br />

published to a very limited number <strong>of</strong><br />

people (those taxi drivers who overheard it)<br />

the defamer had to pay his innocent victim<br />

$40,000 in damages.<br />

Accordingly if you are ever tempted to post<br />

negative comments about anyone, or any<br />

business, on the Internet think long and<br />

hard about it. If you still want to do it, make<br />

sure that your facts are correct. If you are<br />

expressing an opinion, make sure you set<br />

out the facts that that opinion is based on,<br />

and that it is a reasonable expression <strong>of</strong> an<br />

opinion. Preferably take legal advice first.<br />

The Importance <strong>of</strong> Saving<br />

The fundamentals <strong>of</strong> banking<br />

are to gather in money from<br />

Savers, and loan it out sensibly<br />

to Borrowers.<br />

Banks / financial institutions pay interest to<br />

their Savers, and collect interest from their<br />

Borrowers - with the basic premise being<br />

that the differential between these 2 interest<br />

rates covers the running costs for the bank<br />

and returns a pr<strong>of</strong>it to the shareholders (just<br />

like any business!).<br />

Unfortunately, due to a historic lack <strong>of</strong><br />

savings culture in New Zealand there is a<br />

savings imbalance in New Zealand. So BNZ<br />

(like other banks in New Zealand) relies on<br />

finding nearly 40% <strong>of</strong> the money it lends to<br />

homeowners and businesses from overseas<br />

savers to help keep New Zealand working.<br />

The Reserve Bank <strong>of</strong> New Zealand (and<br />

the banks themselves) have recognised<br />

this reliance, which was bought to the fore<br />

during the Global Financial Crisis. Overseas<br />

savers that were willing to lend to New<br />

Zealand banks demanded a premium for<br />

doing so, which meant that there was a<br />

knock on impact <strong>of</strong> higher interest rates<br />

to New Zealanders with loans during this<br />

period.<br />

On the positive side Savers in New Zealand<br />

were rewarded more handsomely with<br />

attractive interest rates on Bank Term<br />

Deposits as banks encouraged New<br />

Zealanders to save more.<br />

Although the tide is turning with businesses<br />

and households deleveraging (paying <strong>of</strong>f<br />

debt) i.e. household debt has reduced from<br />

154% <strong>of</strong> GDP to 144% <strong>of</strong> GDP over the last<br />

3 years, there is still a need for an increase<br />

in savings.<br />

Why save?<br />

Savings need to be an important part <strong>of</strong><br />

everyday life because they allow businesses<br />

and households to accrue for unforeseen<br />

or emergency expenses, budget for large<br />

cash outflows (i.e. tax payments, family<br />

holidays, weddings), build the equity in your<br />

personal balance sheet or business, help<br />

contribute towards funding future projects<br />

(business expansion/home improvements),<br />

and provide a buffer or cushion to help you<br />

through the hard times.<br />

Ultimately savings are on-lent by banks to<br />

New Zealanders for new business ventures,<br />

expansions and hence contribute towards<br />

the growth <strong>of</strong> the New Zealand economy.<br />

It’s not just if we’re saving; it’s<br />

where we are saving…<br />

Another useful lesson that savers have<br />

learned from the spate <strong>of</strong> finance company<br />

collapses in New Zealand is not just to<br />

save per se, but to research more carefully<br />

where they choose to save their money.<br />

Credit Ratings are one signal <strong>of</strong> the<br />

financial capability or creditworthiness <strong>of</strong><br />

a bank / financial institution. These ratings<br />

demonstrate the capability <strong>of</strong> a bank /<br />

financial institution to meet its financial<br />

obligations as they fall due, for example;<br />

when savers want to withdraw their<br />

money the bank / financial institution has<br />

sufficient loan repayments coming in from<br />

its borrowers and available liquid assets<br />

to ensure this can happen. The strength<br />

<strong>of</strong> a financial institution can be used to<br />

give an approximate likelihood <strong>of</strong> default,<br />

and RBNZ’s ‘Know Your Credit Ratings’<br />

paper illustrates this succinctly. An AA<br />

rated institution (i.e. comparable to BNZ’s<br />

AA- rating) has a probability <strong>of</strong> a 1 in 300<br />

chance <strong>of</strong> defaulting over a 5 year timeframe.<br />

Comparing this to a BBB rated institution<br />

increases the probability <strong>of</strong> default to a 1 in<br />

30 chance over the same 5 year time period.<br />

So, as a saver, you’d be wise to think carefully<br />

about the risk involved in where you actually<br />

choose to keep your savings.<br />

How BNZ can help<br />

BNZ continues to drive a savings culture<br />

in New Zealand by <strong>of</strong>fering fee free<br />

savings accounts for businesses, PIE<br />

savings accounts and term deposits that<br />

are subject to lower tax rates (subject to<br />

income levels). Our Total Money <strong>of</strong>fset<br />

account bank account has helped New<br />

Zealanders save $101m in interest charges<br />
