(Clause 3.1)<br />

Note 1. State <strong>Environmental</strong> <strong>Plan</strong>ning Policy (Exempt and Complying Development Codes)<br />

2008 specifies exempt development under that Policy. The Policy has State-wide application.<br />

This Schedule contains additional exempt development not specified in that Policy.<br />

Note 2. Exempt development may be carried out without the need for development consent<br />

under the Act. Such development is not exempt from any approval, licence, permit or authority<br />

that is required under any other Act and adjoining owners’ property rights and the common law<br />

still apply.<br />

Amusement devices<br />

Maximum 2 machines per premises.<br />

Charity and recycling bins<br />

Maximum 2 bins per premises.<br />

Replanting commercial vineyards in Zone RU4 Primary Production Small Lots<br />

(1) Must be located in Zone RU4 Primary Production Small Lots.<br />

(2) Replanting of vines must occur within 5 years of the date of vines<br />

having been removed from the land.<br />

Signage—general requirements<br />

(1) Must be non-moving.<br />

(2) Must be at least 600mm from any public road.<br />

(3) Must be at least 2.6m above any public footpath.<br />

(4) Must relate to the lawful use of the building (except for temporary<br />

signs).<br />

(5) Must not be detrimental to the character and functioning of the building.<br />

(6) Must not cover mechanical ventilation inlet or outlet vents.<br />

(7) Must not be on walls facing or adjoining residential premises.<br />

(8) Must not be located on land on which there is a building that is a<br />

heritage item or on land within a heritage conservation area, unless<br />

using existing approved fixings.<br />

(9) Must have the consent of the owner of the property on which the sign is<br />

located.<br />
