A Public Meeting was held at 7:05 p.m. to consider a proposed<br />

Site Plan affecting property described as Part Lot 27, Plan 159,<br />

Listowel Ward. Patricia Berfelz, Clerk reviewed the report and<br />

indicated that notices had been mailed to landowners within 60 m<br />

of the subject property on October 3 rd , 2012. No one spoke in<br />

favour of the proposal. Douglas Pratt spoke in opposition. He<br />

indicated that the front yard parking be moved to the rear yard.<br />

Tom Kerr, applicant indicated that the proposed site plan<br />

complies with the zoning by-law. Kriss Snell, CAO indicated that<br />

all applicable law must be in place before a building permit can be<br />

issued. There being no more comments the meeting was closed<br />

at 7:26 p.m.<br />

Strategic Plan<br />

Christel Ivanyshyn, Perth County CEMC was present to address<br />

concerns or questions arising from the report.<br />

The Council of the Municipality of North Perth include a Stratford-<br />

Perth Region Interoperability Program addendum to the<br />

Municipality of North Perth Strategic Plan:<br />

Goal 1: Ensure residents are being served by an efficient,<br />

cohesive and comprehensive service delivery model.<br />

Strategic Objective: Investment in and support of community<br />

infrastructure that reflects our rate of growth and rural nature.<br />

• Action 4 – Develop a Stratford-Perth Regional<br />

Interoperability Program so that member and partner<br />

emergency response agencies have the ability to<br />

share data and information, on demand, in real time,<br />

when needed, and as authorized; by addressing the<br />

key elements of governance, standard operating<br />

procedures/guidelines, technology, training and<br />

exercises, and usage.<br />

5.1.2. 2012 Semi-Annual Contract Policing Costs - Ontario Provincial<br />

Police (OPP)<br />

Kriss Snell CAO reviewed the report regarding 2012 semi-annual<br />

contract policing costs which indicate that the budget will be met.<br />

5.1.3. Class Environmental Assessment Public Meeting<br />

Kriss Snell CAO noted that the proposed date for the Public<br />

Meeting has been scheduled for November 14, 2012.<br />

Kriss Snell, CAO informed Council that the external audit for the North<br />

Perth Drinking Water systems was completed on August 22, 2012 and<br />

indicated that official accreditation will be received. Mr. Snell applauded<br />

the efforts of the Public Works Department.<br />

to provide fundraising campaign design and related printed<br />

materials for the Recreation Complex Project fundraising<br />

campaign at a cost of $2,770.00 plus applicable taxes.<br />

5.5.1. Landfill Survey Results<br />

Mark Hackett, Manager of Environmental Services reviewed the<br />

results of the landfill survey.<br />

5.6. Manager of Operations<br />

5.6.1. Listowel City Ford<br />

Jamie Morgan, Manager of Operations reviewed a report<br />

regarding a request from Listowel City Ford to improve the<br />

entrance from Fairlane Rd and driveway which crosses municipal<br />

land into the rear of the Listowel City Ford property. It was noted<br />

that all costs would be the responsibility of Listowel City Ford.<br />

Discussion followed regarding the need for an encroachment<br />

agreement to address concerns. Council directed staff to provide<br />

additional information including a more accurate drawing<br />

indicating where the driveway will be located over municipal<br />

lands.<br />

5.6.2. Elizabeth St. E./Argyle St. Construction update<br />

6. <strong>COUNCIL</strong> REPORTS<br />

Jamie Morgan, Manager of Operations provided an update<br />

regarding the Elizabeth St. E. Construction project and noted that<br />

the project would not be completed this year. However, he<br />

indicated that the first layer of asphalt will be put down prior to the<br />

Remembrance Day Service.<br />

Jamie Morgan, Manager of Operations indicated that the Public<br />

Information Centre was held regarding the Argyle St. construction<br />

project. He noted that concerns that were raised by landowners<br />

have been addressed.<br />

FOR IMMEDIATE RELEASE<br />

October 16, 2012<br />

Liberals trying to duck accountability, says MPP Pettapiece<br />

(Queen’s Park) – By shutting down the legislature, the Liberal government is once again putting its own<br />

political interest above the public interest, charges Perth-Wellington MPP Randy Pettapiece.<br />

"The Premier has the right to step down whenever he wants," Pettapiece acknowledged. "Certainly, he<br />

deserves our gratitude for so many years of public service.”<br />

"But the Premier's stepping down is no reason to suspend the legislature. My constituents rightly expect<br />

that MPPs should be at work at Queen's Park dealing with critical issues facing Ontario. We can't afford to<br />

ignore the serious problems facing the province until it's convenient for the Liberals."<br />

Until Premier McGuinty prorogued the legislature, opposition MPPs had been trying to get to the bottom of<br />

the hundreds of millions of dollars wasted on cancelled power plants in Oakville and Mississauga, and the<br />

government's refusal to turn over all the related documents.<br />

"The premier’s timing in shutting down the legislature is irresponsible and extremely disappointing," said<br />

Pettapiece.<br />

He continued: "The government shut down the legislature at a time when about 600,000 people don't have<br />

jobs and when the province has a deficit of $14 billion. They don't want to be held accountable for that<br />

record, or for their power plant scandals or for their Ornge ambulance scandal."<br />

Under the rules of the legislature, the government must, when proroguing the House, announce the<br />

approximate date on which the Assembly will be reconvened. The Liberal government has not done that,<br />

Pettapiece noted, which again puts the government at odds with the rules of the legislature.<br />

Even though the legislature is shut down until further notice, Pettapiece will be working from his<br />

constituency office and meeting with constituents throughout Perth-Wellington.<br />

Recently Pettapiece has advocated strongly for the horse-racing industry and for those affected by the<br />

Liberal government's wind farms policy. He has also spoken in the legislature on behalf of first responders<br />

and successfully passed a motion calling attention to issues affecting rural Ontario and the rural-urban<br />

divide. In early October, he hosted two agriculture open houses in celebration of Ontario Agriculture Week.<br />

TAKE NOTICE that the Council of the Corporation of the Municipality of North Perth will hold a public<br />

meeting on October 22, 2012 at 7:00 p.m. in the Council Chambers at the North Perth Municipal<br />

Offices (330 Wallace Ave. North, Listowel) to consider a proposed Zoning By-law Amendment under<br />

Section 34 of the Planning Act, R.S.O. 1990.<br />

The proposed Zoning By-law Amendment (ZBA) application (which the Municipality has deemed to be<br />

complete) affects property in the Municipality of North Perth (Listowel Ward) described as Part of Lots 22<br />

and 23, Concession 1 formerly in Wallace Township, now in the Listowel Ward. The subject property is<br />

owned by W. Leon Perkin and Helen E. Perkin.<br />

The proposed Zoning By-law Amendment will not change the zone classification of the subject property<br />

(shown in hatching on the attached map) from the “Future Development Zone (FD-10)” of By-law No. 6-<br />

ZB-1999 but rather will amend the “FD-10” zone provisions to delete references to any new building or<br />

structure being permitted on the subject property. In addition, the proposed revised provisions will<br />

recognize the reduced lot area of the subject property.<br />

The proposed Zoning By-law Amendment will change the zone classification of the subject property<br />

(shown in stippling on the attached map) from the “Future Development Zone (FD-10)” to the<br />

“Residential Zone One (R1)” of By-law No. 6-ZB-1999. The “R1” zone permits: single-detached<br />

dwellings; home occupations; and accessory buildings and structures.<br />

The proposed Zoning By-law Amendment is being considered by North Perth Council on the basis of an<br />

application submitted by the property owners. The property owners wish to amend the Zoning By-law to<br />

fulfill one of the conditions imposed by the County of Perth’s Land Division Committee (application<br />

B15/12) to sever the subject parcel from the balance of the property (shown in hatching on the attached<br />

map). It should be noted that the Land Division Committee’s decision has been appealed to the Ontario<br />

Municipal Board.<br />

ANY PERSON may attend the public meeting and/or make written or verbal representation either in<br />

support of or in opposition to the proposed Zoning By-law Amendment.<br />

If a person or public body does not make oral submissions at a public meeting or make written<br />

submissions to the Council of the Corporation of the Municipality of North Perth before the by-law is<br />

passed, the person or public body is not entitled to appeal the decision of the Council of the Corporation<br />

of the Municipality of North Perth to the Ontario Municipal Board.<br />

If a person or public body does not make oral submissions at a public meeting or make written<br />

submissions to the Council of the Corporation of the Municipality of North Perth before the by-law is<br />

passed, the person or public body may not be added as a party to the hearing of an appeal before the<br />

Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.<br />

BY-LAW No. 115-2012<br />

Being a By-law to amend By-law No. 6-ZB-1999, as amended, which may be cited as "The<br />

Zoning By-law of the Municipality of North Perth", and which is a By-law to regulate the use of<br />

land and the character, erection, location and use of buildings and structures and to prohibit<br />

certain buildings, structures and uses in various defined areas of the Corporation of the<br />

Municipality of North Perth.<br />

WHEREAS the Council of the Corporation of the Municipality of North Perth deems it<br />

necessary in the public interest to pass a By-law to amend By-law No. 6-ZB-1999, as<br />

amended;<br />

AND WHEREAS pursuant to the provisions of Section 34 of the Planning Act, as amended,<br />

By-laws may be passed by Councils of municipalities for prohibiting or regulating the use of<br />

land and the erection, location, or use of buildings or structures within the municipality for or<br />

except for such purposes as may be set out in the By-law, and for regulating in certain<br />

respects buildings or structures to be erected or located within the municipality;<br />

NOW <strong>THE</strong>REFORE <strong>THE</strong> <strong>COUNCIL</strong> <strong>OF</strong> <strong>THE</strong> CORPORATION <strong>OF</strong> <strong>THE</strong> <strong>MUNICIPALITY</strong> <strong>OF</strong><br />

<strong>NORTH</strong> <strong>PERTH</strong> ENACTS AS FOLLOWS:<br />

1. The area shown in hatching on the attached map, Schedule "A", and described Part of<br />

Lots 22 and 23, Concession 1 (former Wallace Township, now in the Listowel Ward) of the<br />

Municipality of North Perth shall remain in the “Future Development Zone (FD-10)” of Bylaw<br />

No. 6-ZB-1999, but shall be subject to the revised provisions of Section 29.3.10 of Bylaw<br />

No. 6-ZB-1999, as hereinafter set forth. The Zoning on this land shall be shown as<br />

“FD-10” on Key Map 17 of Schedule “A” to By-law No. 6-ZB-1999, as amended.<br />

2. Section 29.3.10 of By-law No. 6-ZB-1999 is hereby amended to read as follows:<br />

“29.3.10 FD-10 (a) Location: Part of Lots 22 and 23, Concession 1<br />

(former Wallace Township, now in the Listowel Ward)<br />

(b) Notwithstanding the provisions of Section 29 of this By-law to the contrary, no new<br />

buildings may be constructed on the land located in the “FD-10” zone as shown on<br />

Key Map 17 of Schedule “A” to this By-law (also shown on Schedule “A” to By-law No.<br />

115-2012).<br />

(c)<br />

The minimum lot area, and minimum lot frontage shall remain as they lawfully existed<br />

on the date of the passing of By-law No. 115-2012 (October 22, 2012).<br />

(d) All other applicable provisions of this By-law, as amended, shall apply.”<br />

3. The area shown in stippling on the attached map, Schedule "A", and described Part of Lots<br />

22 and 23, Concession 1 (former Wallace Township, now in the Listowel Ward) of the<br />

Municipality of North Perth shall be removed from the “Future Development Zone (FD)” of<br />

By-law No. 6-ZB-1999, and placed in the “Residential Zone One (R1)” of By-law No. 6-ZB-<br />

1999. The Zoning on this land shall be shown as “R1” on Key Map 17 of Schedule “A” to<br />

By-law No. 6-ZB-1999, as amended.<br />

4. Schedule "A", attached hereto, shall form part of this By-law.<br />

5. All other provisions of By-law No. 6-ZB-1999, as amended, shall apply.<br />

6. The Clerk is hereby authorized and directed to proceed with the giving of notice of the<br />

passing of this By-law in accordance with the Planning Act, as amended, and to<br />

Regulations thereto.<br />

7. This By-law shall come into force on the date that it was passed, pursuant to the Planning<br />

SUBJECT: North Perth Industrial Park Lot Concept<br />

PURPOSE <strong>OF</strong> REPORT:<br />

To provide Council with information and recommendation regarding the North Perth Industrial Park<br />

proposed lot concept.<br />

BACKGROUND:<br />

Potential industrial businesses and developers are currently looking for lots in the range of half an<br />

acre to 2 acres. The current inventory of municipally owned industrial lands is larger lots ranging from<br />

2 acres up to 20 acres. MHBC Planning was retained to provide concepts dividing the 20 acre parcel<br />

into a variety of smaller parcels. Five concepts were presented to Council on July 9, 2012. Based on<br />

the initial feedback from Council, MHBC has created Lotting Concept 5.<br />

COMMENTS:<br />

The Concept offers a variety of lot sizes and provides for internal road access and servicing. The<br />

downside to Option 5 is a long and expensive street with many lots having frontage on two or more<br />

streets. Storm water facilities will be required for Lots E and F. A plan of subdivision will be required<br />

to add a new road. Engineering plans need be completed by Gamsby and Mannerow Limited who<br />

worked on the initial industrial park.<br />

FINANCIAL IMPACT:<br />

To date the sale of land from the Hoover property has covered all the expenses, including, but not<br />

limited to, original purchase price, legal fees, development cost. It is anticipated that all future<br />

expenses will be covered by land sales.<br />

i.e.<br />

+/- 24 acres (total land available) X $42,000 per acre = $1,008,000 plus $161,000 from existing<br />

offer agreement.<br />

Preliminary construction estimate is approx. $900,000 plus area pre-grading ($200,000) and hydro<br />

estimated at $50,000.<br />

A detailed budget will be presented to Council once engineering is complete.<br />

That the Council accept “Lotting Concept Option 5” for the North Perth Industrial Park and that<br />

expected to work surrounding the holidays in December.<br />

Policy:<br />

a) The North Perth Administration Building and all departmental operations will remain open<br />

until 12:00 noon on December 24, should it occur on a weekday. If December 24 should<br />

occur on a Saturday or Sunday, the Administration Building will remain open for its regular<br />

operating hours the Friday prior to the weekend.<br />

b) The North Perth Administration Building will be open for its regular operating hours on<br />

December 31, if occurring on a weekday.<br />

c) If staff would like to participate in noon dismissal on December 24, they must ensure that they<br />

have enough remaining vacation hours or banked time to cover the remainder of the day, or<br />

take the time off without pay.<br />

d) All staff that participate in essential/emergency operations, or whose scheduling determines<br />

that they must work December 24, are required to attend and be available for work as<br />

organization. Recognition will be given to permanent full-time and permanent part-time employees with<br />

uninterrupted service, excluding students, seasonal and casual staff.<br />

markers and a gift certificate for a North Perth business to be presented routinely throughout the<br />

SUBJECT: Perth Meadows Long Term Debenture #35-12<br />

PURPOSE <strong>OF</strong> REPORT:<br />

To seek Council’s approval to transition the financing debenture with Infrastructure<br />

Ontario from short term to long term for the Perth Adult Life Care Residents project.<br />

BACKGROUND<br />

The Municipality of North Perth acquired the Perth Meadows project last fall with of<br />

the provision of short term financing from Infrastructure Ontario. At this time, the<br />

financing has to be transitioned to long-term or repaid.<br />

The long term debenture parameters are set for 25 years at the current interest rate<br />

provided by Infrastructure Ontario on October 29 th , 2012. Currently, the interest rate<br />

is 3.61% for the 25 year term.<br />

At this time, the transition process requires the completion of various documents by<br />

the Mayor and Treasurer. On October 29 th , the municipality will receive an interest<br />

rate offer from Infrastructure Ontario that has to be accepted, signed and sealed by<br />

the Mayor and Treasurer. An example copy of the form is attached.<br />

BUDGET IMPLICATIONS<br />

To receive the reduced interest rate for the 25 year term to adequately manage the<br />

annual repayment, the term has to be locked in for the term provided. In the event<br />

that the units are all occupied or the project is transferred to a not for profit<br />

corporation in the future, the loan financing would have to remain with the<br />

municipality but could be repurposed to another municipal project such at<br />

bridge/road work, sewage plant, arena, etc.<br />

In light of the financing required and future infrastructure work facing the<br />

municipality, the long term commitment and favourable interest rate presents itself as<br />

a good long term financing arrangement for the municipality.<br />

RECOMMENDATION<br />

Motion:<br />

That the Council of the Municipality of North Perth authorize the Mayor and Treasurer<br />

to accept the interest rate provided by Infrastructure Ontario for long term debenture<br />

financing of the Perth Adult Life Care Residence project on October 29 th and that the<br />

debenture financing by-law be tabled for final consideration at the November 5 th<br />

meeting of Council.<br />

SUBJECT: Water/Sewer Rate Adjustment for 2013 #36-12<br />

PURPOSE <strong>OF</strong> REPORT:<br />

To seek Council’s approval to adjust the Water/Sewer Rates for 2013 as per the Water and Water<br />

and Wastewater Rates – 2012-2016.<br />

BACKGROUND<br />

The financial review with Peter Harrison and Jane Simmon from BM Ross was an excellent process<br />

completed in 2011. The significant increases required in the water and wastewater rates, to ensure<br />

the municipality achieves ongoing sustainability and compliance under the Ontario Regulation<br />

453/07, was outlined in a report to Council at the end of the study.<br />

Staff reworked the rate recommendation presented by BMRoss and revised the rates to phase in the<br />

financial impact to our customers over a four to seven year period. Proposed 2012 rates and rate<br />

estimates for 2013-2016 were approved by Council last year and attached for review. The phasing<br />

moves towards a single ICI block and modifies connection sizing to ranges: < 25mm, 26mm-50mm,<br />

> 51mm.<br />

Staff is seeking Council’s approval to ratify the 2013 rates to be brought back under by-law<br />

November 5 th , 2012 to be effective for the February 28 th , 2013 billing (December 20 th , 2012 to<br />

February 21 st , 2013 usage).<br />

BUDGET IMPLICATIONS<br />

To maintain financial sustainability for both services, a revenue increase is required as per the<br />

Financial Plan developed. The proposed rate increases required were modified by Council to phase<br />

in the financial impact. It is proposed to implement the second year of the 5 year plan as attached.<br />

RECOMMENDATION<br />

Motion:<br />

That the Council of the Municipality of North Perth approve the 2013 Water and Wastewater Rates,<br />

both volumetric and base, as presented, for implementation as of the February 28 th , 2013 billing<br />

covering December 20 th , 2012 to February 21 st , 2013 usage and further that the rates and fees bylaw<br />

be amended as such.<br />

Upon reviewing the routes and schedule we have found a serious imbalance on<br />

Wednesday that is causing our vehicles to be later than desired. As a result, we will be<br />

moving the Hamlets of Atwood and Newry to Monday instead of Wednesday effective<br />

November 5.<br />

We will notify all the affected residents of the upcoming change.<br />

We don't like making changes anymore than you do. In this case, the imbalance is such<br />

that with the winter weather or any breakdowns could affect our ability to complete the<br />

route within the legal allowable timeframe.<br />

We agree that mass mail out has not been that successful in recent years and we are<br />

equally concerned with the reach of the newspapers.<br />

In this case here, we are simply changing the day from Wednesday to Monday for two<br />

very defined urban areas. The collection frequency (weekly/biweekly) and schedule<br />

(green week) remains the same. We intend to produce a removable sticker announcing<br />

the change to be affixed to all affected containers in those areas. An updated calendar<br />

will be available for those who need one (see enclosure).<br />

If someone misses the change and places their container out on Wednesday, they will<br />

not be collected that day. We can collect their materials the following Monday.<br />

Starting April 30th, the new automated collection program will be introduced in your<br />

community. As a result, your collection day will change so please refer to the calendar<br />

and legend below to identify your new collection schedule. In the rural areas, waste and<br />

recyclables will be collected at the same time with the same vehicle in a two compartment<br />

truck. In the urban areas, it is more likely that your waste bin will be collected<br />

first, while your recycling bin will be collected later in the day. We recommend that you<br />

still set out both containers at the same time to ensure collection as we may use a two<br />

compartment truck in certain areas from time to time. Keep this schedule on your fridge!<br />

• Please start using your bins in accordance with the schedule in this pamphlet.<br />

• Place your bins out for collection in the same location as they were delivered. How you place your bins at the curb is very important.<br />

Unless you have been contacted with special instructions, please place your bins at the curb as follows:<br />

• Park it – Place your bins just off the roadway on the shoulder, grass, or driveway.<br />

• Point it – The arrow on the bin lid must point to the centre of the road.<br />

• Space it – Leave at least 1 meter of clearance between each bin and any obstacles such as parked cars, poles & mailboxes.<br />

• Separating your bins one arms length is ideal. Bins improperly spaced may not be emptied.<br />

• Prepare your bins. All material must fit within the bin and the lid must be closed.<br />

• No extra materials will be collected. Recycle all you can. Breakdown boxes. Flatten containers.<br />

• Have your bins out by 7:00 a.m. This will ensure they are picked up on your scheduled collection day.<br />

• Mix all recyclables and leave materials loose in the bin. Do NOT place recyclables in bags, except shredded paper and plastic bags. 75<br />

During the development of the automated collection program in North Perth, efforts<br />

were made to implement a waste bin fee that would adequately meet the needs of the<br />

solid waste management budget. As noted in my report to council on September 10,<br />

2012, Waste Diversion Ontario (WDO) grant money is not being distributed this year by<br />

BRA. The budgeted 2012 WDO grant money amounted to $89,000, which is seventyfive<br />

percent of the full allocation available. At a BRA Technical Committee meeting on<br />

October 18, 2012, it was announced that there would be no WDO funding distributed in<br />

2013.<br />

The proposed adjustment of the waste bin rates will absorb some of the impact of the<br />

WDO grant money not being distributed by BRA.<br />

BUDGET/STAFF IMPLICATIONS:<br />

The proposed waste bin fee adjustment will provide additional revenue of approximately<br />

$19,500 annually.<br />

the Legion parking lot on Elizabeth Street East to the Cenotaph and back on Sunday,<br />

November 11, 2012.<br />

The parade, which will leave the Legion at approx. 10:20am will travel west along<br />

Elizabeth to Davidson Avenue, south on Davidson to Inkerman Street, west on Inkerman<br />

to Wallace Avenue, and north on Wallace to the cenotaph, where it will pause for the<br />

Remembrance Day Wreath laying. Upon return, the parade will travel along Elizabeth<br />

Street East to the Legion parking lot. (This route is contingent upon the completion of the<br />

construction along Elizabeth Street.)<br />

Agreement with the Huron-Perth Catholic District School Board for the<br />

provision of the North Perth Best Start Program;<br />

AND WHEREAS, this agreement will authorize the Huron-Perth Catholic<br />

District School Board to accommodate the Best Start Program and the<br />

Municipality of North Perth will provide payment for the service as set out<br />

in the terms and conditions of the Agreement;<br />

A By-law to Provide for the Regulation and Control of Traffic on<br />

the Highways of the Municipality of North Perth.<br />

WHEREAS it is deemed necessary and expedient to regulate traffic on the highways of the<br />

Municipality;<br />

AND WHEREAS Section 11(1) of the Municipal Act 2001, S.O. 2001 c.25, as amended,<br />

permits Municipalities to pass By-laws for regulating traffic on the highways, subject to the<br />

provisions of the Highway Traffic Act;<br />

NOW, IT IS HEREBY ENACTED by the Municipal Council of the Municipality of North<br />

Perth as follows:<br />

1. For the purpose of this By-law, where no definition is made herein and definition is<br />

“Authorized Emergency Vehicle” means a vehicle of the Fire Department, Police vehicle,<br />

ambulance and such emergency vehicles of Municipal departments as are designated or<br />

authorized by the Administrator or North Perth O.P.P;<br />

“Bicycle” means any device which has two wheels and is propelled by muscular power<br />

and upon which any person may ride;<br />

“Boulevard” shall mean the portion of the street allowance lying between the travelled<br />

portion of the street and the limit of the street allowance;<br />

“By-law Enforcement Officer” a law enforcement employee of a municipality, county or<br />

regional district, appointe enforce non-criminal bylaws, rules, laws, codes or regulations<br />

enacted by local governments;<br />

“Commercial Vehicle” means a motor vehicle having permanently attached thereto a<br />

truck or delivery body, and includes an ambulance, hearse, casket wagon, fire apparatus,<br />

police vehicle, motor bus and tractors used for hauling purposes on the highway;<br />

"Community Safety Zone" means a part of a roadway so designated under the Highway<br />

Traffic Act where public safety is a special concern;<br />

“Controlled Access Highway” – Every highway, street or roadway in respect to which<br />

owners or occupants of abutting lands and other persons have legal right of access to or<br />

from the same except at such points only and in such manner as may be determined by<br />

the Municipality of North Perth;<br />

“Corner” means the point of intersection of curbs or edges of the portion of the Highway<br />

used for vehicular traffic;<br />

“Council” shall mean the Council of the Municipality of North Perth.<br />

“Crossover” means that portion of a roadway ordinarily included within the prolongation<br />

or connection of the lateral lines of sidewalks or any portion of a roadway distinctly<br />

indicated for pedestrian crossing by lines or marks;<br />

“Curb” shall mean where a curb is constructed, the line thereof. Where no curb is<br />

constructed it shall be construed to mean the edge of the travelled portion of the roadway;<br />

“Driver” means a person who drives, operates or is in actual physical control of a vehicle;<br />

“Double Parking” shall mean permitting any part of a vehicle to remain stationary along<br />

side or parallel to another vehicle already properly parked or standing at the curb on the<br />

same side of the street;<br />

“Footpath” (also pedestrian way, walking trail, nature trail) is a type of thoroughfare<br />

that is intended for use by pedestrians but not other forms of traffic, such as motorized<br />

vehicles;<br />

“Footbridge” means a bridge designed to be used by persons on foot;<br />

“Gross Weight” means the combined weight of vehicle and load;<br />

“Heavy Truck” means a commercial motor vehicle having a weight, when unloaded, of<br />

three tonnes or more or, when loaded six tonnes or more, but does not include a<br />

passenger vehicle, an ambulance or any vehicle of a police service or fire department;<br />

“Highway” shall have the same meaning as prescribed under the Highway Traffic Act<br />

RSO 1990. Without limitation, HIGHWAY includes unassumed and unopened road<br />

allowances;<br />

“Intersection” shall have the same meaning as prescribed under the Highway Traffic Act<br />

RSO 1990, c.H.8;<br />

“Laned Roadway” means a roadway which is divided into two or more clearly marked<br />

lanes for vehicular traffic;<br />

“Loading Zone” means a space adjacent to a curb for the exclusive use of vehicles during<br />

the loading or unloading of freight or person as designated by signage;<br />

“Motorized Snow Vehicle” means a self-propelled vehicle designed to be driven<br />

primarily on snow;<br />

“Municipally-Owned Commercial Vehicle” means any vehicle owned or operated for and<br />

on behalf of the Municipality of North Perth, or such vehicles as are from time to time<br />

hired or used for the purposes of carrying out civic works under the instructions and<br />

supervision of the Manager of Operations, and without limiting the generality of the<br />

foregoing, shall include vehicles as operated by the North Perth O.P.P., all Fire<br />

Department equipment or vehicles, Town sweepers, Town flushers, snow ploughs,<br />

garbage collectors, vehicles of the Public Works and Recreation Departments of the said<br />

Municipality, or the vehicles of any other Board or Commission operating under the<br />

authority or control of the Municipality of North Perth;<br />

“Officer” means a police officer, police constable, bailiff, constable, or other person<br />

employed for the preservation and maintenance of the public peace or for the service or<br />

execution of civil process;<br />

“Off-Road Vehicle” means a vehicle propelled or driven otherwise than by muscular<br />

power or wind and designed to travel on not more than four wheels and not considered to<br />

be licensed for highway use in the Province of Ontario;<br />

“Official Time Standard”. Whenever certain hours are named herein they shall mean<br />

standard time or daylight saving time as may be in current use in this Municipality;<br />

“One Way Street” means a street upon which vehicular traffic is limited to movement in<br />

one direction;<br />

“Operator” shall mean any person who operates or is in charge of a vehicle upon a street;<br />

“Park” or “Parking”, when prohibited, means the standing of a vehicle, whether occupied<br />

or not, except when standing temporarily for the purpose of and while actually engaged<br />

in loading or unloading merchandise, or passengers;<br />

“Parking Space” means a portion of the surface of a roadway designated by suitable<br />

markings, designed and intended for the parking of motor vehicles;<br />

“Pedestrian” means a person afoot, and includes physically challenged persons and<br />

children in wheeled carriages;<br />

“Pedestrian Crossover” means any portion of a roadway designated by by-law of this<br />

municipality, at an intersection or elsewhere distinctly indicated for pedestrian crossing<br />

by signs on the highway and lines or other markings on the surface of the roadway as<br />

prescribed by the regulations under the Highway Traffic Act R.S.O. 1990;<br />

“Person” shall mean every natural person, firm, co-partnership, association or<br />

corporation;<br />

“Police” shall mean the North Perth O.P.P. of the Municipality of North Perth;<br />

“Police officer” means a member of the North Perth O.P.P;<br />

“Roadway” means that portion of a Highway that is improved, designated or ordinarily<br />

used for vehicular traffic, and shall include all streets but does not include the shoulder,<br />

and where a Highway includes two or more separate roadways, the term "roadway" refers<br />

to all the roadways collectively;<br />

“Rural Roadways” means all roadways outside of the settlements of Listowel, Atwood,<br />

Monkton, Trowbridge and Gowanstown, but shall not apply to roadways under the<br />

jurisdiction of Perth County or the Province of Ontario;<br />

(mm) “Sidewalk” means that portion of a street between the curb lines or the lateral lines of a<br />

roadway and the adjacent property lines intended for the use of pedestrians;<br />

“Stand” or “Standing”, when prohibited, means the halting of a vehicle, whether<br />

occupied or not, except for the purpose of and while actually engaged in receiving or<br />

discharging passengers;<br />

"Stop” or “Stopping”, when prohibited, means the halting of a vehicle, even<br />

momentarily, whether occupied or not, except when necessary to avoid conflict with<br />

other traffic or in compliance with the directions of a constable or other police officer or<br />

of a traffic control sign or signal;<br />

“Tax Collector” means the Tax Collector for the Municipality of North Perth;<br />

“Traffic” includes pedestrians, ridden or herded animals, vehicles, and other conveyances<br />

used singularly or together while using any street for purpose or travel;<br />

“Traffic Control Device” means any sign; or roadway, curb or sidewalk mark; or other<br />

device erected or placed under the authority of Municipal Council or as authorized and<br />

provided for under the direction of the North Perth O.P.P., for the purpose of regulating,<br />

warning or guiding traffic;<br />

“Traffic Control Signal”, means any device, manually, electrically or mechanically<br />

operated for the regulation of traffic;<br />

“Trailer” means any vehicle that is at any time drawn upon a Highway by a motor<br />

vehicle, except an implement of husbandry, another motor vehicle or any device or<br />

apparatus not designated to transport persons or property temporarily drawn, propelled,<br />

or moved upon such Highway except a side car attached to a motorcycle, and shall be<br />

considered a separate vehicle and not part of the motor vehicle by which it is drawn;<br />

“Two Hour Parking Zone” means the street or parts of streets designated by this by-law<br />

as constituting a time-limited parking zone;<br />

“U Turn” means to turn a vehicle within the roadway so as to proceed in the opposite<br />

direction from that which the vehicle previously faced;<br />

(ww) “Urban Roadways” means all roadways within the settlement areas of Listowel, Atwood,<br />

Monkton, Trowbridge, and Gowanstown;<br />

(xx)<br />

“Vehicle” includes a motor vehicle (includes snow machines), trailer, traction engine,<br />

farm tractor, road-building machine and any vehicle drawn, propelled or driven by any<br />

kind of power, including muscular power.<br />

Part II – GENERAL PROVISIONS<br />

1. DUTIES <strong>OF</strong> POLICE AND BY-LAW ENFORCEMENT <strong>OF</strong>FICER<br />

The North Perth O.P.P. and/or other By-law Enforcement Officers as appointed from<br />

time to time by the Municipality of North Perth shall enforce the provisions of this Bylaw.<br />

2. OBEDIENCE TO TRAFFIC CONTROL DEVICES OR SIGNALS<br />

Every person shall promptly obey all signals or directions given either by a Police Officer<br />

or by a Traffic Control device, or a traffic signal or traffic sign.<br />

3. DIRECTION <strong>OF</strong> TRAFFIC BY POLICE OR BY-LAW ENFORCEMENT <strong>OF</strong>FICER<br />

Where an officer reasonably considers it necessary<br />

a) to ensure orderly movement of traffic; or<br />

b) to prevent injury or damage to persons or property; or<br />

c) to permit proper action in an emergency, he may direct traffic according to his<br />

discretion, notwithstanding the provisions of the By-law, and every person shall<br />

obey his instructions.<br />

4. TRAFFIC CONTROL DEVICES OR SIGNALS<br />

a) Authority is hereby given to the Manager of Operations, with the approval of the<br />

Ministry of Transportation of Ontario, where required by law, to place or erect<br />

and to maintain such signs and traffic control signals authorized by Council as are<br />

required to give effect to the provisions of this By-law, or as are required to<br />

regulate, warn or guide traffic for the safety or convenience of the public.<br />

b) The Manager of Operations, upon direction by Council, is hereby given authority<br />

to place such pavement markings as they deem advisable for the purpose of<br />

directing and guiding traffic and the parking of vehicles.<br />

c) No person shall place, maintain or display upon or in view of any Highway or<br />

street allowance any unauthorized sign, signal, marking or device which purports<br />

to be or is an imitation of or resembles a traffic control device or railroad sign or<br />

signal, or which attempts to direct the movement of traffic, or which hides from<br />

view or interferes with the effectiveness of any traffic control device or any<br />

railroad sign or signal, and no person shall place or maintain upon any Highway<br />

or street allowance any traffic sign or signal bearing thereon any commercial<br />

advertising.<br />

This shall not be deemed to prohibit the erecting upon private property adjacent to<br />

Highways of signs giving useful directional information and of a type that cannot<br />

be mistaken for traffic control.<br />

Notwithstanding, where conflict exists between this section and the<br />

Municipality’s Sign By-Law, the requirements of the Sign By-Law shall prevail.<br />

d) Any unauthorized sign, signal, marking or device so erected shall be forthwith<br />

removed by the person or persons responsible for the placing of same, after<br />

notice, verbal or written, by the Manager of Operations, Officer in Charge or<br />

Police Constable.<br />

e) Stop signs shall be erected and maintained by the Manager of Operations at all<br />

intersections.<br />

5. PEDESTRIAN CROSSOVERS<br />

Pedestrian crossovers, as defined, are hereby authorized on the roadways or portions of<br />

roadways as set out in Column 1 of Schedule “F” to this By-law at the locations set out in<br />

Column 2 of the said Schedule.<br />

6. DESIGNATED PARKING SPACES FOR <strong>THE</strong> PHYSICALLY CHALLENGED<br />

The parking spaces identified by signs as defined in Schedule “D” to this By-law on<br />

public and private roads and parking lots, at the locations set out in Schedule “D” to this<br />

By-law shall be designated parking spaces to be used exclusively by persons who have a<br />

properly displayed Disabled Permit.<br />

7. FIRE ROUTES<br />

The roads, lanes, driveways and private roadways described in Schedule “H” to this Bylaw<br />

are hereby designated as fire routes.<br />

8. NO PARKING AREAS<br />

No person shall park a vehicle, except when necessary to avoid conflict with other traffic<br />

or in compliance with a traffic control signal, sign or device or the direction of a police<br />

officer, in any of the following places:<br />

a) on a bridge or approaches thereto;<br />

b) on any street, in such manner as to obstruct traffic;<br />

c) in such a position as will prevent the convenient removal of any other vehicle<br />

previously parked or standing;<br />

(d) in a fire route being within six and a half (6.5) meters of a point in the edge of the<br />

roadway and nearest to a public entrance to a hotel as defined by the Hotel Fire<br />

Safety Act, a theatre as defined by the Theatre's Act, or a Public Hall or<br />

Auditorium as defined in the Public Halls Act where such theatre, hall or<br />

auditorium is open to the public;<br />

(e) in front of a public or private driveway or opposite thereto;<br />

(f) in an area indicated by “NO PARKING BETWEEN SIGNS”;<br />

(g) in an area where signs have been erected indicating “NO PARKING HERE TO<br />

CORNER”;<br />

(h) in an area designated by pavement markings or signs as being for physically<br />

challenged parking only.<br />

(i) within eight (8) meters of the lot on which a Fire Hall is located on that side of the<br />

street which such Fire Hall is located, or on the opposite side of said street so as to<br />

obstruct or interfere with the means of ingress or egress from such Fire Hall;<br />

(j) on any roadway or street right-of-way, having regard for the traffic requirements<br />

on such roadway, and in no case for a longer period than six (6) consecutive<br />

hours;<br />

(k) on a sidewalk;<br />

(l) within four (4) meters of a fire hydrant;<br />

(m) on a pedestrian crossover;<br />

(n) within nine (9) metres of an Intersection, unless there is a parking spot designated<br />

and painted as such.<br />

9. SCHEDULES<br />

Any part of the Schedules hereto annexed may be altered by adding thereto other streets<br />

or parts of streets therein mentioned, and by substituting different hours and periods of<br />

time other than therein mentioned but any such alteration shall be made only by By-law<br />

of the Council in that behalf, and duly passed at a regular or special meeting of the<br />

Council, to take effect when approved by the Ministry of Transportation of Ontario when<br />

necessary, provided, for the purpose of guiding, directing and regulating, or limiting or<br />

otherwise altering the traffic regulations. Temporary regulations may be put into effect<br />

by the North Perth O.P.P. for the Municipality of North Perth or the Manager of<br />

Operations and such temporary regulations to be valid only when properly worded signs<br />

have been erected and are on display, and for a period of thirty days only, unless<br />

confirmed by By-law enacted by the Council and approved by the Ministry of<br />

Transportation of Ontario where necessary.<br />

10. PARADES<br />

No person shall take part in any parade or other procession on any of the streets or<br />

sidewalks in the Municipality of North Perth unless that person has first obtained written<br />

permission from the Council to do so. This requirement may be waived by Council<br />

where deemed appropriate.<br />

11. TIME LIMITED PARKING AREAS<br />

Parking of vehicles shall be allowed on the roads set out in Schedule “G” subject to the<br />

time limits set out in this by-law (two hour maximum parking).<br />

Part III - GENERAL <strong>OF</strong>FENCES<br />

1. DEPOSITING SNOW ON HIGHWAY OR MAINTAINED SIDEWALK<br />

No person shall throw, deposit, or cause to be deposited, any snow, ice or mud as to<br />

interfere with the movement of pedestrian or vehicular traffic.<br />

2. DRIVING OVER FIRE HOSES<br />

No vehicle shall be driven over any unprotected hose of the Fire Department when laid<br />

down in any roadway, street, private driveway or lane, which is used or intended to be<br />

used at any fire or alarm of fire.<br />

3. PEDESTRIAN <strong>OF</strong>FENCES<br />

No person, while a pedestrian, shall<br />

(a) cross a road at a place other than a pedestrian crossover or at road intersections<br />

when such crossing interferes with the movement of vehicles; or,<br />

(b) fail to yield the right of way to a vehicle upon the road, except when authorized<br />

by a traffic signal or by a police officer.<br />

(c) proceed over or go under a barrier permanently installed at a safety zone or on a<br />

sidewalk.<br />

(d) obstruct the flow of traffic on any roadway.<br />

4. BICYCLE <strong>OF</strong>FENCES<br />

No person shall:<br />

(a) leave a bicycle unattended on a roadway;<br />

(b) ride or leave a bicycle in such a manner as to obstruct a sidewalk or footpath;<br />

(c) operate a bicycle at a speed greater than is reasonable and prudent or in a manner<br />

which is unsafe.<br />

(d) Any bicycle found obstructing pedestrians may be taken into possession by an<br />

officer and removed and stored, and any storage charges shall be a lien upon such<br />

bicycle, and such costs and charges shall be in addition to any penalty imposed<br />

under this By-law. There shall be no liability to the owner of such bicycle on the<br />

part of the Municipality of North Perth, or the Officer, for any damages occurring<br />

to the bicycle while in the custody of the Police, the Municipality or in storage.<br />

5. DRIVING ON SIDEWALK<br />

No person shall permit a vehicle, without the permission of the North Perth O.P.P., Bylaw<br />

Enforcement Officer, or the Manager of Operations, to be drawn, hauled, driven,<br />

propelled or used on, over or along any boulevard, sidewalk, footpath or footbridge being<br />

in or upon any boulevard, garden or other place for public use within the municipality.<br />

6. STANDING OR PARKING FOR DISPLAY OR MAINTENANCE<br />

No person shall stand or park a vehicle upon a Highway for the purpose of:<br />

(a) displaying it for sale;<br />

(b) washing, greasing or repairing such vehicle, except repairs necessitated by<br />

emergency;<br />

(c) allowing a vehicle to discharge any fluid or substance onto the Highway;<br />

(d) advertising or promotion purposes unless such parking has been specifically<br />

authorized by Council.<br />

7. MOTORIZED VEHICLES<br />

(a) No person shall drive a motor vehicle or a motorized snow vehicle or a motor<br />

assisted bicycle upon a sidewalk or footpath except for the purpose of directly<br />

crossing such a sidewalk or footpath.<br />

(b) No person shall drive a motor vehicle or a motorized snow vehicle or a motor<br />

assisted bicycle over a raised curb except at a place where there is a ramp.<br />

8. MISCELLANEOUS DRIVING RULES<br />

No person shall, except under the direction of a police officer, drive a vehicle on a road<br />

between the vehicles comprising a funeral or other procession recognizable as such by<br />

the display of pennants, lights or other identifying insignia while the vehicles in such<br />

procession are in motion.<br />

9. IMPROPER USE <strong>OF</strong> PARKING PERMITS FOR <strong>THE</strong> PHYSICALLY CHALLENGED<br />

No person shall use a disabled person's parking permit in a manner other than that<br />

provided in law.<br />

HEAVY TRUCKS<br />

10. No person shall drive a Heavy Truck on any portion of any roadway listed in Schedule<br />

‘J’. Municipally-Owned Commercial Vehicles shall be exempt from this section.<br />

Part IV – PARKING <strong>OF</strong>FENCES<br />

1. GENERAL STOPPING AND PARKING REGULATION<br />

No person shall park, or stop a vehicle on any street other than a one-way street, unless<br />

on the right hand side of the street, having regard for the direction in which the vehicle<br />

had been proceeding, and unless the right front and right rear wheels or runners of the<br />

vehicle are parallel to and distant respectively not more than thirty (30) centimetres from<br />

the edge of the roadway, without stopping or parking over a sidewalk or footpath or over<br />

any part of the Highway where grass has grown or which is not intended for the use of<br />

vehicles.<br />

2. ONE WAY STREETS<br />

Where parking is permitted on a one-way street, vehicles may be parked only on the<br />

designated side of the street, with the front and rear wheels parallel to and distant not<br />

more than thirty (30) centimetres from the edge of the roadway or within the limits or<br />

lines of parking space marked on such a street. One way streets are as designated on<br />

Schedule “E” of this By-law.<br />

3. OUTSIDE MARKED PARKING SPACES<br />

Where angle or parallel parking spaces are designated by lines painted on the roadway,<br />

no person shall stop or park any vehicle except within an area designated as a parking<br />

space.<br />

4. MOTORCYCLE PARKING<br />

Notwithstanding the provisions of this By-law with regard to the parking of vehicles in<br />

certain areas of streets in the Municipality of North Perth where parallel parking in areas<br />

is permitted, motorcycles shall be parked on an angle of (45) forty-five degrees to the<br />

curb, with the front wheel or hindmost rear wheel within thirty (30) centimetres of the<br />

curb, and within the limits of the parking space as designated by pavement markings on<br />

the street, and so placed that when leaving the space the motorcycle shall proceed in the<br />

direction of the flow of traffic.<br />

5. LISTOWEL MEMORIAL ARENA AND MUNICIPAL PARKS<br />

(a) No person shall park a vehicle on the west side of Maitland Avenue North<br />

opposite any part of the front of the Listowel Memorial Arena. This prohibition<br />

does not apply to police, ambulance and fire vehicles when engaged in emergency<br />

use.<br />

(b) No person shall operate an off-road vehicle in any municipally owned or cared-for<br />

park, or on any municipally owned property in the Municipality of North Perth.<br />

6. STOPPING AND PARKING RESTRICTIONS AND PROHIBITIONS ON CERTAIN<br />

ROADS<br />

Where signs to that effect are displayed, no person shall park a vehicle on any roadway at<br />

the side and between the limits set out respectively in Columns 1, 2 and 3 of Schedule<br />

"A” to this By-law during the prohibited times or days set out in column 4 of the said<br />

Schedule.<br />

7. LOADING ZONES<br />

(a) Where signs to that effect are displayed, no person shall park any vehicle other<br />

than for the purpose of loading or unloading the vehicle, in any loading zone as<br />

set out respectively in Columns 1, 2 and 3 of Schedule “C” (ii) to this By-law<br />

during the days or times set out in Column 4 of the said Schedule.<br />

(b) Where signs to that effect are displayed, no person shall park any commercial<br />

vehicle in any commercial vehicle loading zone as set out respectively in<br />

Columns 1, 2 and 3 of Schedule “C” (i) to this By-law for any purposes other than<br />

the expeditious unloading and delivery or pickup and loading of materials or<br />

goods during the days or times set out in Column 4 of the said Schedule. In no<br />

case shall the stop for loading or unloading of materials or goods exceed five (5)<br />

minutes.<br />

8. NO STOPPING OR STANDING<br />

Where signs to that effect are displayed no person shall stop or stand a vehicle on any<br />

roadway or public laneway at the side and between the limits set out respectively in<br />

Columns 1, 2 and 3 of Schedule “B” to the By-law during the times or days set out in<br />

Column 4 of the said Schedule.<br />

9. OVERNIGHT PARKING – WINTER MONTHS<br />

Between the hours of two a.m. and six a.m. no motor vehicle shall be allowed to park on<br />

any or all streets, roadways or Municipal parking lots of the Municipality of North Perth,<br />

between the months of December 1 st to March 31 st , without prior approval of the North<br />

Perth O.P.P. or By-law Enforcement Officer.<br />

10. PARKING RESTRICTED ADJACENT TO SCHOOL GROUNDS & PLAYGROUNDS<br />

Where signs are erected and are on display no person shall park any vehicle on any road<br />

or any side roadway or a portion of a roadway, abutting school property or a playground.<br />

11. NO PARKING OR DRIVING ON BOULEVARDS<br />

No person shall drive or park any vehicle on any boulevard within the Municipality of<br />

North Perth except for the purpose of directly crossing a boulevard at a driveway or other<br />

designated crossing.<br />

12. REGULATIONS <strong>OF</strong> PARKING IN ALL PARKING LOTS OWNED AND<br />

OPERATED BY <strong>THE</strong> <strong>MUNICIPALITY</strong> <strong>OF</strong> <strong>NORTH</strong> <strong>PERTH</strong><br />

When authorized signs have been erected and are on display, no person shall at any time<br />

park a vehicle in a municipal parking lot owned and operated by the Municipality of<br />

North Perth between the hours of two a.m. to six a.m. December 1 st , to March 31 st .<br />

In addition to the penalties provided herein the North Perth O.P.P. or an authorized Bylaw<br />

Enforcement Officer may order the removal of any unlawfully parked vehicle to a<br />

suitable place of storage and all costs and charges for the removal, care and storage<br />

thereof shall be a lien on such vehicle. Any parking spot listed in Schedule “I”,<br />

designated parking spots, shall be exempted from this section.<br />

13. STOP AT RIGHT HAND CURB<br />

The operator of a vehicle used for the purpose of delivering goods, wares or merchandise,<br />

or any other commodity shall stop their vehicle only at the right hand curb in the<br />

direction it is facing and shall not leave their vehicle standing in the street except at the<br />

said right hand curb.<br />

14. OVER DESIGNATED TIME LIMITS<br />

No person shall park a vehicle where traffic control signs to that effect are situate on any<br />

road at the side and between the limits set out respectively on Schedule “G” to this By-<br />

Law for a longer period of time than that set out on the traffic control sign.<br />

15. DESIGNATED TENANT PARKING<br />

No person shall park a vehicle in a designated tenant parking spot as set out in Schedule<br />

“I”,. In addition to the penalties provided herein, any vehicle parked in a designated spot<br />

may be removed by the police or an authorized By-law Enforcement Officer to a place of<br />

storage and all costs for the removal, care and storage thereof shall be a lien on such<br />

vehicle.<br />

16. COMMERCIAL VEHICLE IN RESIDENTIAL ZONE<br />

No person shall park, except as permitted by council, a commercial vehicle in on a street<br />

or roadway in a residential zone within the Municipality of North Perth.<br />

Part V - ENFORCEMENT AND PENALTY PROVISIONS<br />

1. ENFORCEMENT<br />

This by-law may be enforced by issuing tickets for regulating traffic and providing for<br />

voluntary payment for parking violations, pursuant to the procedure set out in Section<br />

3(b) hereto, or under the provisions of the Provincial Offences Act, R.S.O. 1990, C.33.<br />

2. REPORTING PROVISIONS<br />

Persons responsible for the enforcement of this by-law by issuing Provincial Offence<br />

Notices for regulating traffic and providing for voluntary payment for parking violations,<br />

shall report:<br />

(a) the license plate number which indicates the vehicle or person violating any of the<br />

provisions of this By-Law;<br />

(b) the complete address indicating where such vehicle is in violation of any of the<br />

provisions of this By-law;<br />

(c) the date and time during which such vehicle is in violation of any of the<br />

provisions of this By-Law;<br />

(d) any other facts, the knowledge of which is necessary to a thorough understanding<br />

of the circumstances attending such violation. Persons responsible for enforcing<br />

this by-law pursuant to this paragraph shall also attach to such vehicle, or hand to<br />

the driver or operator of such vehicle or person, a serially-numbered notice that<br />

such vehicle or person has been in violation of any of the provisions of this Bylaw,<br />

and instruction to the driver or person regarding the making of payment.<br />

3. PENALTIES<br />

(a) GENERAL<br />

Subject to the penalty provisions contained in the Highway Traffic Act, which<br />

provisions shall take precedence over the matters contained in this By-law, any<br />

person who contravenes any of the provisions described above shall be guilty of<br />

an offence and upon conviction shall be subject to a fine as prescribed in the<br />

Provincial Offences Act, R.S.O. 1990, c. P.33, as amended.<br />

(b)<br />

EARLY VOLUNTARY PAYMENTS <strong>OF</strong> PENALTIES<br />

(i) Notwithstanding any other provisions of this Part in respect to penalties<br />

for violation of the provisions of this By-law, any person may, upon<br />

presentation of a parking infraction notice issued by a police officer or a<br />

By-law Enforcement Officer alleging commission of any of the offences<br />

under this By-law set out in Schedule “K” and “L”, pay out of Court<br />

within the time limit specified on the said parking infraction notice, the<br />

penalty set out opposite such offence as indicated in Schedule “K” and<br />

“L” to this By-law. Upon such payment no further proceedings shall be<br />

taken under this By-law in respect to the said alleged offence.<br />

(ii)<br />

If a voluntary payment is not made in accordance with the procedure<br />

provided in Subsection (b)(i) of this section, the procedures of the<br />

Provincial Offences Act, or any successors thereof, shall apply.<br />

(c)<br />

The owner and/or operator of a vehicle shall incur the penalties provided for any<br />

violation of this By-law or of any regulations thereunder unless at this time of<br />

such violation the vehicle was in the possession of some person other than the<br />

owner or his chauffeur without the owner’s consent, and the driver of a motor<br />

vehicle not being the owner shall also incur the penalties provided for any<br />

violation of the terms of this By-law or the regulations thereunder.<br />

4. TOWING - UNLAWFULLY PARKED VEHICLES<br />

(a) In addition to the penalties provided in this By-law the North Perth O.P.P., a Bylaw<br />

Enforcement Officer, the Clerk, the Cheif Administrative Officer or the<br />

Manager of Operations may order the removal of any unlawfully parked vehicle<br />

to a suitable place of storage and all costs and charges for the removal, care and<br />

storage thereof, if any, are the responsibility of the registered owner of the<br />

vehicle.<br />

(b)<br />

(c)<br />

Any damage done to any vehicle moved or taken to and placed or stored in<br />

a suitable place as aforesaid shall be the sole responsibility of the owner of the<br />

said vehicle.<br />

No liability for any damage shall attach to the municipality or to the<br />

operator or owner of any vehicle used to move a vehicle parked or standing in<br />

such a manner as to interfere with traffic or with the clearing of snow from the<br />

highway as aforesaid.<br />

5. HIGHWAY TRAFFIC ACT<br />

This By-law shall be subject to the provisions of the Highway Traffic Act, R.S.O. 1990,<br />

Chapter H.8 and all amendments and regulations thereto.<br />

6. COURT RULING<br />

When a court of competent jurisdiction declares any section or part of a section of this<br />

By-law invalid, the remainder of this By-law shall continue in force unless the court<br />

makes an order to the contrary.<br />

Part VI - ENACTMENT<br />

1. REPEAL <strong>OF</strong> PREVIOUS BY-LAW<br />

North Perth By-law 78-2006 and any or all other North Perth By-laws heretofore passed<br />

by the Municipality of North Perth inconsistent with the provisions of this By-law are<br />

hereby repealed.<br />

2. MINISTRY <strong>OF</strong> TRANSPORTATION<br />

The provisions of this By-law which affect Highways designated as connecting links<br />

pursuant to the Public Transportation and Highway Improvement Act, R.S.O. 1990,<br />

Chapter P. 50 shall not take effect until approved by the Ministry of Transportation.<br />

3. EFFECTIVE DATE<br />

This By-law shall come into force and take effect upon the day of its passing.<br />
