Part 1 Authority<br />
The legal authority <strong>for</strong> this Rule is Chapter 16-5-71, Chapter 31-3-4 <strong>and</strong> Chapter 31-40 of the<br />
Official Code of Georgia Annotated. (O.C.G.A. Chapters 16-5-71, 16-5-71.1, 16-12-5, 31-<br />
40-1, 31-40-2, 31-40-3, 31-40-4, 31-40-5, 31-40-6, 31-40-7, 31-40-8, 31-40-9, <strong>and</strong> 31-5.)<br />
Part 2 Purpose<br />
The purpose of these rules <strong>and</strong> regulations is to establish reasonable st<strong>and</strong>ards <strong>for</strong> individuals<br />
per<strong>for</strong>ming body art procedures <strong>and</strong> <strong>for</strong> the facilities from which the procedures are provided.<br />
If followed, such st<strong>and</strong>ards should insure the health <strong>and</strong> safety of all individuals per<strong>for</strong>ming<br />
<strong>and</strong> receiving these services. Citations of criminal code within these rules <strong>and</strong> regulations<br />
are <strong>for</strong> reference only. The department does not prosecute violations of the Georgia Criminal<br />
Code.<br />
Part 3 Exemptions<br />
These regulations do not apply to a physician or osteopath licensed under Chapter 34 of Title<br />
43, or a technician acting under the direct supervision of such licensed physician or<br />
osteopath. Exemptions may include cosmetic reconstructive surgery or procedures per<strong>for</strong>med<br />
under the direct supervision of a physician or osteopath licensed under Chapter 34 of Title<br />
43, or a technician acting under the direct supervision of such licensed physician or<br />
osteopath.<br />
Part 4 Definitions<br />
“Administrative body” means the partnership, corporation, association, or the person or<br />
group of persons who maintain <strong>and</strong> control the body art studio <strong>and</strong> personnel <strong>and</strong> who are<br />
legally responsible <strong>for</strong> the operation of the studio.<br />
“Antimicrobial solution” means any solution used to retard the growth of microorganisms<br />
approved <strong>for</strong> application to human skin <strong>and</strong> includes all products labeled accordingly as<br />
approved by the Food <strong>and</strong> Drug Administration (FDA).<br />
“Antiseptic” means an agent or substance that will destroy or inhibit the growth <strong>and</strong><br />
development of infectious microorganisms on human skin or mucous membranes.<br />
“Applicant” means any person who applies <strong>for</strong> a body art license, guest body art license,<br />
body art establishment permit, or temporary body art establishment permit.<br />
