WHEREAS, renown for his ambition, business acumen, and political astuteness, he was also well known<br />

for his devotion to his family. Mayor Stephens was a loving husband to Ka<strong>the</strong>rine, a cherished fa<strong>the</strong>r to<br />

Donald, Gail, Mark and Bradley and a devoted grandfa<strong>the</strong>r to twelve grandchildren.<br />

NOW, THEREFORE, BE IT RESOLVED, that <strong>the</strong> President and <strong>Board</strong> <strong>of</strong> <strong>Commissioners</strong> <strong>of</strong> <strong>Cook</strong><br />

<strong>County</strong> do hereby extend <strong>the</strong>ir deepest sympathies to <strong>the</strong> Stephens family. Donald E. Stephens was “one<br />

<strong>of</strong> kind” and is truly irreplaceable. His presence will be sorely missed by not only his family, friends and<br />

residents <strong>of</strong> Rosemont, but by countless o<strong>the</strong>rs; and<br />

BE IT FURTHER RESOLVED, that a suitable copy <strong>of</strong> this Resolution be prepared for presentation to<br />

<strong>the</strong> Stephens family as evidence <strong>of</strong> <strong>the</strong> esteem in which he will always be held by this honorable body and<br />

that his memory may be ever so honored.<br />

In accordance with <strong>Cook</strong> <strong>County</strong> Code Section 2-108(h)(1), Commissioner Silvestri, seconded by<br />

Commissioner Daley, moved to suspend <strong>the</strong> rules so that this matter may be considered. The motion<br />

carried unanimously.<br />

Commissioner Silvestri, seconded by Commissioner Daley, moved that <strong>the</strong> Resolution be approved and<br />

adopted. The motion carried unanimously.<br />

PROPOSED ORDINANCE AMENDMENTS<br />

Submitting a Proposed Ordinance Amendment sponsored by<br />

TODD H. STROGER, President, <strong>Cook</strong> <strong>County</strong> <strong>Board</strong> <strong>of</strong> <strong>Commissioners</strong><br />

PROPOSED ORDINANCE AMENDMENT<br />

COOK COUNTY WASTE FEE ORDINANCE<br />

WHEREAS, <strong>the</strong> <strong>County</strong> <strong>of</strong> <strong>Cook</strong> is a home rule unit <strong>of</strong> local government pursuant to Article VII, Section<br />

6(a) <strong>of</strong> <strong>the</strong> 1970 Illinois Constitution; and<br />

WHEREAS, <strong>the</strong> Illinois Constitution provides that home rule units may exercise any power and perform<br />

any function pertaining to its government and affairs including, but not limited to, <strong>the</strong> power to regulate<br />

for <strong>the</strong> protection <strong>of</strong> <strong>the</strong> public health, safety, morals and welfare; to license; and to incur debt; and<br />

WHEREAS, Illinois law (55 ILCS 5/5-1009) permits home rule units to impose fees not based on <strong>the</strong><br />

selling or purchase price or gross receipts from <strong>the</strong> use, sale or purchase <strong>of</strong> tangible personal property;<br />

and<br />

WHEREAS, <strong>the</strong> proceeds from said fees or surcharges may be utilized for local solid waste management<br />

purposes, consistent with <strong>the</strong> Illinois Solid Waste Management Act; and<br />

WHEREAS, <strong>the</strong> <strong>Cook</strong> <strong>County</strong> is desirous <strong>of</strong> promoting <strong>the</strong> purposes <strong>of</strong> Illinois Solid Waste<br />

Management Act through <strong>the</strong> enactment <strong>of</strong> an Ordinance establishing and enforcing said fees or<br />

surcharges; and<br />

WHEREAS, <strong>the</strong> <strong>Board</strong> <strong>of</strong> <strong>Commissioners</strong> has determined that a <strong>County</strong> waste fee not based upon <strong>the</strong><br />

selling or purchase price or gross receipts from <strong>the</strong> use, sale or purchase <strong>the</strong>re<strong>of</strong> should be imposed upon<br />

<strong>the</strong> management <strong>of</strong> waste at any waste facility within <strong>Cook</strong> <strong>County</strong>, as provided herein.<br />

NOW, THEREFORE, BE IT ORDAINED by <strong>the</strong> <strong>Cook</strong> <strong>County</strong> <strong>Board</strong> <strong>of</strong> <strong>Commissioners</strong> that Chapter<br />

30, Article VII, Division 3, Sections 30-811 through 30-821 <strong>of</strong> <strong>the</strong> <strong>Cook</strong> <strong>County</strong> Code are hereby enacted<br />

as follows:
