Fuel-burning, combustion, or process equipment, process or device shall include, but shall not be<br />

limited to any furnace, incinerator, fuel-burning equipment, refuse-burning equipment, refuse disposal<br />

practices <strong>of</strong> any type including sanitary landfill and dumping <strong>of</strong> any type, boiler, apparatus, device,<br />

mechanism, fly ash collector, electrostatic precipitator, smoke arresting or prevention equipment, and all<br />

o<strong>the</strong>r types <strong>of</strong> environmental control equipment, stack, chimney, breeching, structure or process used for<br />

<strong>the</strong> burning <strong>of</strong> fuel or o<strong>the</strong>r combustible material, or for <strong>the</strong> emission <strong>of</strong> products <strong>of</strong> combustion or any<br />

o<strong>the</strong>r type <strong>of</strong> emission, or used in connection with any process which generates heat or may emit products<br />

<strong>of</strong> combustion, as well as any o<strong>the</strong>r emissions which can be considered pollutants, and shall include but<br />

not be limited to process furnaces such as heat treating furnaces, by-product coke plants, core baking<br />

ovens, mixing kettles, cupolas, blast furnaces, open hearth furnaces, heating and reheating furnaces,<br />

puddling furnaces, sintering plants, Bessemer converters, electric steel furnaces, ferrous foundries,<br />

nonferrous foundries, kilns, stills, dryers <strong>of</strong> all types, roasters, processes, sanitary landfills, disposal<br />

ponds, dumps and equipment used in connection <strong>the</strong>rewith, and all o<strong>the</strong>r methods or forms <strong>of</strong><br />

manufacturing, chemical, metallurgical, mechanical processing or any o<strong>the</strong>r type <strong>of</strong> process which may<br />

emit smoke, vapors, odors or particulate, liquid, gaseous, or o<strong>the</strong>r matter.<br />

Fuel-burning equipment means and includes any furnace, boiler, apparatus, device, mechanism, stack<br />

or structure used in <strong>the</strong> process <strong>of</strong> burning fuel for <strong>the</strong> primary purpose <strong>of</strong> producing heat.<br />

Fuel dealer means any person who sells or delivers any fuel directly or indirectly to <strong>the</strong> ultimate<br />

consumer, without regard to price, quantity, or frequency <strong>of</strong> delivery.<br />

Fugitive particulate matter means any particulate matter emitted into <strong>the</strong> atmosphere o<strong>the</strong>r than<br />

through a stack, provided that nothing in this definition or in Section 30-381(b) shall exempt any source<br />

from compliance with o<strong>the</strong>r provisions <strong>of</strong> Article II, Division 3 <strong>of</strong> this chapter o<strong>the</strong>rwise applicable<br />

merely because <strong>of</strong> <strong>the</strong> absence <strong>of</strong> a stack.<br />

Fumes means gases, vapors, particulate matter, or any combination <strong>the</strong>re<strong>of</strong> that are <strong>of</strong> such character<br />

as to cause atmospheric pollution.<br />

Garbage means refuse resulting from <strong>the</strong> handling, processing, preparation, cooking, and<br />

consumption <strong>of</strong> food or food products.<br />

Goal means level <strong>of</strong> air quality which is expected to be obtained.<br />

IEC means International Electro-technical Commission or its successor bodies.<br />

Impulsive noise means noise characterized by brief excursions <strong>of</strong> sound pressure (acoustic impulses)<br />

which significantly exceed <strong>the</strong> ambient environmental sound pressure. The duration <strong>of</strong> a single impulse is<br />

usually less than one second.<br />

Incinerator means a combustion apparatus for which an Installation Permit could be issued by <strong>the</strong><br />

Department, excluding fuel-burning equipment, in which solid, semi-solid, liquid, or gaseous combustible<br />

wastes are ignited and burned, from which <strong>the</strong> gaseous products <strong>of</strong> combustion are exhausted into <strong>the</strong><br />

atmosphere after first passing through a stack.<br />

Industrial sites mean any business or facility with a total BTU capacity <strong>of</strong> more than 1,000,000 BTU<br />

for all <strong>of</strong> <strong>the</strong> listed equipment and processes.<br />

Industrial wastes means solid, liquid, or gaseous wastes resulting from any process or excess energy<br />

<strong>of</strong> industry, manufacturing, trade, or business or from <strong>the</strong> development, processing, or recovering, except<br />

for agricultural crop raising, or any natural resource.<br />

Intermittent noise means noise whose sound pressure level equals <strong>the</strong> ambient environmental level<br />

two or more times during <strong>the</strong> period <strong>of</strong> observation. The time during which <strong>the</strong> level <strong>of</strong> <strong>the</strong> noise remains<br />

at an essentially constant value different from that <strong>of</strong> <strong>the</strong> ambient is on <strong>the</strong> order <strong>of</strong> one second or more.<br />

Internal combustion engine means an engine in which combustion <strong>of</strong> gaseous, liquid, or pulverized<br />

solid fuel takes place.<br />

IOS means <strong>the</strong> International Organization for Standardization or its successor bodies.<br />

Landscape wastes means any vegetable or plant refuse, except garbage and agricultural waste. The<br />

term includes trees, tree trimmings, branches, stumps, brush, weeds, leaves, grass, shrubbery, and yard<br />

trimmings.<br />

Maximum level continuous or semi-continuous vibration means <strong>the</strong> root mean square (rms) value <strong>of</strong><br />

<strong>the</strong> oscillatory particle motion <strong>of</strong> <strong>the</strong> structure or land area involved with <strong>the</strong> transducer oriented to<br />

produce a maximum indication.<br />

Motor vehicle means any passenger vehicle, truck, truck-trailer or semi-trailer that is propelled or<br />

drawn by mechanical power.<br />

New equipment means any fuel-burning, combustion, or process equipment, process, or device, <strong>the</strong><br />

construction <strong>of</strong> which was less than 50 percent complete on <strong>the</strong> date <strong>of</strong> enactment <strong>of</strong> this chapter.<br />

Nonsteady noise means a noise whose level shifts significantly during <strong>the</strong> period <strong>of</strong> observation.<br />

Noxious odors means any odors which are unwholesome, <strong>of</strong>fensive, harmful, or injurious to <strong>the</strong><br />

public health, its comfort or its welfare.<br />

Odors means that quality <strong>of</strong> an emission <strong>of</strong> any kind, whe<strong>the</strong>r it be solid, liquid or gaseous that<br />

renders it perceptible to <strong>the</strong> sense <strong>of</strong> smell.
