Used for shall include <strong>the</strong> phrases "arranged for," "designed for." "intended for," "occupied for" and<br />

"maintained for."<br />

Vehicle means any type <strong>of</strong> land, rail, or water conveyance whatsoever operated within <strong>the</strong> <strong>County</strong>.<br />

Vibration means a vibration is <strong>the</strong> oscillatory motion <strong>of</strong> <strong>the</strong> particles <strong>of</strong> a solid, propagated as a wave,<br />

which is felt through physical contact ra<strong>the</strong>r than heard. Any vibration can, however, under proper<br />

conditions produce a radiated audible sound wave, but this is to be considered a secondary, separate<br />

consequence herein, unless specifically cited.<br />

Visible emissions means emissions <strong>of</strong> greater than five percent opacity or one-fourth Ringelmann.<br />

Volatile matter means <strong>the</strong> gaseous constituents <strong>of</strong> solid fuels as determined by <strong>the</strong> standard ASTM<br />

procedure as amended or revised to date.<br />

Volatile organic material means any organic material which has a vapor pressure <strong>of</strong> 2.5 pounds per<br />

square inch absolute (psia) or greater at 70 degrees Fahrenheit.<br />

Watercraft means every type <strong>of</strong> boat, ship, or barge used or capable <strong>of</strong> being used as a means <strong>of</strong><br />

transportation on water.<br />

Zoning district means those districts established by Appendix A, Zoning.<br />

Subdivision III. Annual Inspection and Certificate <strong>of</strong> Operation<br />

An annual inspection shall be made by <strong>the</strong> Department <strong>of</strong> all fuel-burning, combustion or process<br />

equipment or devices coming under <strong>the</strong> provisions <strong>of</strong> this chapter, whe<strong>the</strong>r or not a certificate <strong>of</strong><br />

operation or allowable fuel certificate allowing use <strong>of</strong> such equipment or process has been previously<br />

issued by <strong>the</strong> Director to see that such equipment or process can be so managed and operated that no<br />

smoke, particulate, or o<strong>the</strong>r matter shall be emitted <strong>the</strong>refrom in violation <strong>of</strong> any emission limitation or<br />

o<strong>the</strong>r requirement provided under this chapter; provided, however, that no annual inspection shall be<br />

required <strong>of</strong> locomotives, ships, boats, tugs, internal combustion engines, domestic heating plants, or<br />

domestic refuse-burning equipment; and provided, also, that where any fuel-burning combustion or<br />

process equipment or device has been installed, erected, constructed, reconstructed, altered, added to, or<br />

repaired pursuant to a permit issued under Section 30-151, has been inspected in accordance with <strong>the</strong><br />

requirements <strong>of</strong> Section 30-232 here<strong>of</strong>, and has been in operation less than six months, an annual<br />

inspection will not be required until six months from <strong>the</strong> date such equipment was first put under fire after<br />

<strong>the</strong> completion <strong>of</strong> such work. Commercial Sites will not require an annual inspection. Inspection <strong>of</strong> <strong>the</strong><br />

fuel burning equipment and processes for Commercial Sites will be conducted on a random schedule as<br />

designated by <strong>the</strong> Director. Upon notice that <strong>the</strong> equipment has been found to comply with <strong>the</strong> provisions<br />

<strong>of</strong> <strong>the</strong> chapter, and after payment <strong>of</strong> <strong>the</strong> prescribed fee, <strong>the</strong> Director shall issue a certificate <strong>of</strong> operation,<br />

which shall be posted in a conspicuous place within <strong>the</strong> plant. If, at <strong>the</strong> time <strong>of</strong> <strong>the</strong> annual inspection, it is<br />

found that <strong>the</strong> equipment is in such condition that it cannot be operated within <strong>the</strong> provisions <strong>of</strong> <strong>the</strong><br />

chapter, <strong>the</strong> Director shall give notice in writing to <strong>the</strong> person owning, operating, or in charge <strong>of</strong> such<br />

equipment <strong>of</strong> <strong>the</strong> defects found and order <strong>the</strong> person to correct, repair, or replace <strong>the</strong> defective equipment.<br />

Failure to comply with this order within 30 days from its date shall be a violation <strong>of</strong> this section, and <strong>the</strong><br />

Director is hereby authorized to seal <strong>the</strong> equipment. No person shall violate <strong>the</strong> seal on any equipment<br />

that has been sealed at <strong>the</strong> direction <strong>of</strong> <strong>the</strong> Director unless authorized by <strong>the</strong> Director in writing to do so.<br />
