TEEN COURT PROGRAM<br />

2.29.010 DEFINITIONS. As used in this Chapter, unless the context otherwise requires:<br />

A. “Minor <strong>of</strong>fense” means any <strong>of</strong>fense denominated a misdemeanor under Title 18, C.R.S.,<br />

or a violation <strong>of</strong> a municipal ordinance where the maximum penalty authorized does not<br />

exceed imprisonment for more than six (6) months.<br />

B. “Teen” means any person over the age <strong>of</strong> ten years and under the age <strong>of</strong> nineteen years<br />

who is enrolled in school.<br />

C. “Teen Court Judge” means a volunteer, who is approved by and is serving at the<br />

pleasure <strong>of</strong> the presiding <strong>Municipal</strong> Judge.<br />

D. “Teen Defendant” means a Teen ordered to participate in the Teen Court program under<br />

this Chapter.<br />

E. “Teen Defense Attorney” means a Teen who is chosen by a Teen Court Judge or the<br />

presiding <strong>Municipal</strong> Judge to speak on behalf <strong>of</strong> a Teen Defendant.<br />

F. “Teen Jury” means not less than three (3) Teens who have been chosen by a Teen Court<br />

Judge to decide what sentence should be imposed against a Teen Defendant.<br />

G. “Teen Prosecutor” means a teen who has been chosen by a Teen Court Judge or the<br />

presiding <strong>Municipal</strong> Judge to advocate on behalf <strong>of</strong> the community for any sentence to<br />

be imposed.<br />

2.29.020 TEEN COURT ESTABLISHED.<br />

A. There is hereby established in the <strong>City</strong> <strong>of</strong> <strong>Fruita</strong> a Teen Court program. Any Teen<br />

charged with a minor <strong>of</strong>fense may receive a deferred judgment, a condition <strong>of</strong> which is<br />

successful participation in the Teen Court program, as determined by the <strong>Municipal</strong><br />

Judge.<br />

B. The procedure for determining the eligibility for the imposition <strong>of</strong> such a deferred<br />

judgment shall be as follows:
