3. The Board of Education approves the following resolution: 

JACKSON TOWNSHIP MUNICIPAL UTILITIES AUTHORITY 

and 

JACKSON TOWNSHIP BOARD OF EDUCATION 

WHEREAS, the construction of the WaWa located at Block 58.01 Lot 1 made 

necessary improvements of an existing pump station at Block 61.02 Lot 1 in the Township 

of Jackson owned and operated by the Jackson Township Board of Education; and, 

WHEREAS, the Board of Education was paid $85,000 for the pump station 

improvements by WaWa in accordance with a negotiated agreement between both parties 

and in order for the project to be completed; and, 

WHEREAS, the Board of Education no longer wants the responsibility for the 

ownership, maintenance and repair of the pump station; and, 

WHEREAS, the Jackson Township Municipal Utilities Authority is desirous of 

utilizing the pump station to provide service to third party users; and, 

WHEREAS, the Jackson Township Municipal Utilities Authority will abide by the 

contract entered into between the Jackson Township Board of Education and Wawa, Inc., 

attached hereto as Exhibit “A”. 

IT IS on this 15th day of August, 2006 agreed as follows: 

1. In consideration for the $85,000.00 currently being held by the School 

Board, the Jackson Township Municipal Utilities Authority shall assume 

the ownership and responsibility for the operation, repair, maintenance and 

improvements of the pump station located at Block 61.02 Lot 1. 

2. The Jackson Township Board of Education makes no representations or 

warranties as to the condition of the pump station. 

3. This agreement will take effect upon receipt of the $85,000.00 by the 

Jackson Township Municipal Utilities Authority from the Board of 

Education.

3. Jackson Township Municipal Utilities Authority Resolution – continued: 

4. This agreement and the performance thereof shall be governed, interpreted, 

construed and regulated by laws of the State of New Jersey. 

5. This agreement sets forth all the promises, agreements, conditions and 

understandings between the parties relative to the subject matter hereof, and 

there are no promises, agreements, conditions or understandings, either 

written or oral, expressed or implied, between them other than as herein set 

forth. Except as herein otherwise specifically provided, no subsequent 

alterations, amendments, changes or additions to this Agreement shall be 

binding upon any of the parties unless reduced to writing and signed by all 

parties. 

6. The covenants, conditions and agreements contained in this Agreement 

shall bind and inure to the benefit of the parties and their successors and 

assigns. 

7. This agreement constitutes the entire agreement between the parties as to 

the subject matter hereof and no amendment shall be binding on either party 

unless it is approved by the respective governing bodies and signed on 

behalf of such party by an authorized official thereof. 

IN WITNESS WHEREOF, the parties hereto have hereunto set their hands and seals or 

caused these presents to be signed by their proper corporate officers and their proper 

corporate seal to be hereto affixed. 

4. The Board of Education approves the transportation routes and salaries for 2006-2007 

school year as on file in the Transportation Office.

1. The Board of Education approves the use of facilities for groups as filed. 

2. The Board of Education approves the temporary facilities and Change of Use Application 

for the 2006-2007 school year for various schools in the district.

2. The Board of Education approves the contract with Monmouth Ocean Educational Services 

Commission (MOESC) to participate in the Regional Professional Development Academy 

for the 2006-2007 school year at a cost of $1,900.00. 

3. The Board of Education approves the “Beyond the Bell” program for the 2006-2007 school 

year for nine teachers with a stipend not to exceed $2,760.00, funded by Child Care and 

grant funds. 

4. The Board of Education approves a shortened day schedule for Conference Week, 

November 27, 2006 – December 1, 2006 and the revision to the 2006-2007 District 

Calendar. 

5. The Board of Education approves the New Jersey After 3 Grant in the amount of 

$333,690.23 for the 2006-2007 school year.

3. The Board of Education approves the Fall 2006 Athletic Schedules for Jackson Liberty 

High School, Jackson Memorial High School, Carl W. Goetz Middle School and Christa 

McAuliffe Middle School. 

4. The Board of Education approves a trip for the Jackson Memorial High School and Jackson 

Liberty High School Girls’ Cross County Teams to the Walt Disney World Cross Country 

Classic in Orlando, Florida, October 5-9, 2006, cost to the Board being bus transportation to 

and from Newark Liberty Airport and race entry fees. 

5. The Board of Education approves educational field trips as filed with the Transportation 

Administrator.
