2.3 Milestones on the road to the <strong>Common</strong> <strong>European</strong><br />

<strong>Asylum</strong> <strong>System</strong><br />

<strong>The</strong> thought of a <strong>Common</strong> <strong>European</strong> <strong>Asylum</strong> <strong>System</strong> has developed s<strong>in</strong>ce the<br />

1997 Treaty of Amsterdam 8 came <strong>in</strong>to force on the 1 st of May 1999, and the<br />

thought of a framework for common legislative action on the <strong>asyl</strong>um area<br />

emerged for the first time. <strong>The</strong> nature of the EU project with the borderless <strong>in</strong>ner<br />

market has made <strong>asyl</strong>um matters a necessary collaboration area for the member<br />

states. This section aims at clarify<strong>in</strong>g the contents of the development of the<br />

Treaty of Amsterdam that has basically been brought up at the Tampere and<br />

Hague <strong>European</strong> Council Summits.<br />

2.3.1 <strong>The</strong> <strong>European</strong> Council meet<strong>in</strong>g <strong>in</strong> Tampere <strong>in</strong> 1999<br />

In the presidency conclusions from the Council Summit <strong>in</strong> Tampere, the <strong>European</strong><br />

leaders determ<strong>in</strong>ed that a free Europe requires a “genu<strong>in</strong>e area of justice, where<br />

people can approach courts and authorities <strong>in</strong> any Member State as easily as <strong>in</strong><br />

their own” (<strong>in</strong>troduction, the Tampere milestones, article five). Bear<strong>in</strong>g this basic<br />

idea <strong>in</strong> m<strong>in</strong>d common policies on the <strong>asyl</strong>um area appear as natural cont<strong>in</strong>uation,<br />

as cooperation <strong>in</strong> a genu<strong>in</strong>e common area of justice will have to cover all legal<br />

areas. At the Tampere meet<strong>in</strong>g the cooperation on <strong>asyl</strong>um issues was pronounced<br />

as an important policy area. A political strategy was identified and a five-year<br />

program <strong>in</strong>itiated on common EU policy on <strong>asyl</strong>um and migration, where the<br />

<strong>Common</strong> <strong>European</strong> <strong>Asylum</strong> <strong>System</strong> was one of the four key elements.<br />

<strong>The</strong> meet<strong>in</strong>g “agreed to work towards establish<strong>in</strong>g a <strong>Common</strong> <strong>European</strong><br />

<strong>Asylum</strong> <strong>System</strong>, based on the full and <strong>in</strong>clusive application of the Geneva<br />

Convention” (Statement two, preface of the Council Directive 2004/83/EC). <strong>The</strong><br />

CEAS is to be implemented <strong>in</strong> two phases: the aim the first phase was that<br />

common standards for a fair and efficient <strong>asyl</strong>um process should be implemented<br />

<strong>in</strong> the member states. <strong>The</strong> contents of the first phase of the CEAS are stipulated <strong>in</strong><br />

the follow<strong>in</strong>g documents: the Directive on m<strong>in</strong>imum standards for the<br />

qualification of refugees 9 , the Reception Conditions Directive 10 , the Directive on<br />

M<strong>in</strong>imum Standards on Procedures <strong>in</strong> Member States 11 and the "Dubl<strong>in</strong> II"<br />

Council Regulation of 2003 12 . <strong>The</strong> second phase of the CEAS was to lead to a<br />

common <strong>asyl</strong>um procedure. (Presidency conclusions, Tampere <strong>European</strong> Council,<br />

section A. Ardittis et al, 2005:13ff) May 2004 was established as the deadl<strong>in</strong>e for<br />
