Abstract<br />

My study; <strong>The</strong> <strong>Common</strong> <strong>European</strong> <strong>Asylum</strong> <strong>System</strong> <strong>in</strong> <strong>Poland</strong>; prospects for<br />

implementation and legitimacy is a case study of an EU member state, <strong>Poland</strong>,<br />

and its ability to implement lawfully and legitimately the second phase of the<br />

<strong>Common</strong> <strong>European</strong> <strong>Asylum</strong> <strong>System</strong>. <strong>The</strong> implementation prospects have been<br />

<strong>in</strong>vestigated through an empirical study on previous implementation performance,<br />

adm<strong>in</strong>istrative capacity and a theoretical analysis employ<strong>in</strong>g Christoph Knill’s<br />

theory on adm<strong>in</strong>istrative reform capacity. <strong>The</strong> f<strong>in</strong>d<strong>in</strong>gs <strong>in</strong>dicate that the prospects<br />

for implementation of the CEAS <strong>in</strong> <strong>Poland</strong> are favourable, s<strong>in</strong>ce the political will<br />

to adjust to EU requirements clearly is strong.<br />

<strong>The</strong>reafter the legitimacy of the second phase of the <strong>Common</strong> <strong>European</strong><br />

<strong>Asylum</strong> <strong>System</strong> <strong>in</strong> <strong>Poland</strong> has been <strong>in</strong>vestigated as a consequence analysis of the<br />

above results, together with a re-<strong>in</strong>terpretation of Oliver Danjoux’ concept of<br />

citizenship. I have found that the legitimacy of the reform is a dependent variable<br />

to the possibility of <strong>Poland</strong> to provide the refugees with the rights they are entitled<br />

to, and <strong>in</strong> order not to lower the liv<strong>in</strong>g standard of the <strong>asyl</strong>um seekers, I have<br />

argued that fund<strong>in</strong>g from the ERF should be granted. Beyond the above<br />

mentioned results, I also argue <strong>in</strong> my conclusions that these f<strong>in</strong>d<strong>in</strong>gs give rise for<br />

conceptual expansion on policy analysis on the area; the general evaluation of<br />

implementation through adm<strong>in</strong>istrative reform capacity analysis comb<strong>in</strong>ed with a<br />

legitimacy analysis.<br />
