country of <strong>asyl</strong>um. <strong>The</strong> 1990 Dubl<strong>in</strong> Convention 1 and the 2003 Council<br />
Regulation 2 stipulate the obligation of the <strong>asyl</strong>um seeker to seek <strong>asyl</strong>um <strong>in</strong> the<br />
first safe country she or he enters, and thereafter, put simply, no other country <strong>in</strong><br />
the <strong>European</strong> Union will handle the matter. A decision <strong>in</strong> one member country<br />
after a completed <strong>asyl</strong>um <strong>in</strong>vestigation therefore counts as valid <strong>in</strong> all EU member<br />
states.<br />
Regard<strong>in</strong>g these exist<strong>in</strong>g practices and others on the same area, a high degree<br />
of uniform implementation of the <strong>asyl</strong>um state practice is required <strong>in</strong> order for<br />
these measures to be veritably legitimate. Thus it is of utmost importance from a<br />
human rights perspective to br<strong>in</strong>g up and analyse the implementation prospects on<br />
the <strong>asyl</strong>um area.<br />
1.2.2 Popular trust perspective<br />
“[E]ffective implementation is important because <strong>in</strong> the long run <strong>in</strong>sufficient<br />
implementation will underm<strong>in</strong>e the credibility and legitimacy of both the member<br />
states and the EU” (Bursens 2002:178). <strong>Asylum</strong> policy is at the heart of what I<br />
believe that politics mean to many people; the ability of a prosperous country to<br />
help and shelter human be<strong>in</strong>gs <strong>in</strong> need of protection. This is someth<strong>in</strong>g that cannot<br />
be done at an <strong>in</strong>dividual level, nor at a local or municipal level – the state itself<br />
has to handle the refugee reception <strong>in</strong> such a way as that no person <strong>in</strong> need of<br />
protection is left without. <strong>The</strong> issue of <strong>asyl</strong>um policy is of great <strong>in</strong>terest to popular<br />
op<strong>in</strong>ion, has been shown lately by the public debate on Swedish <strong>asyl</strong>um policy,<br />
with far-reach<strong>in</strong>g public and political demands for a general amnesty for <strong>asyl</strong>um<br />
seekers resid<strong>in</strong>g illegally <strong>in</strong> Sweden. <strong>The</strong>refore I mean that a failure <strong>in</strong> the<br />
implementation <strong>in</strong> the common <strong>European</strong> <strong>asyl</strong>um directives could cause a serious<br />
public confidence deficit for the entire EU political sphere.<br />
1.3 Key concepts<br />
This thesis is concerned with the function<strong>in</strong>g of the <strong>asyl</strong>um processes of the<br />
<strong>European</strong> Union. <strong>The</strong> concept <strong>asyl</strong>um process could employ several mean<strong>in</strong>gs;<br />
visa policy, carrier sanctions, reception facilities, the process of determ<strong>in</strong><strong>in</strong>g<br />
refugee status or subsidiary protection, repatriation programmes as well as social<br />
