At such time as a district wants to have its annual allocation restored the district directors
should adopt a resolution stating their intent and notify the SCC in writing. The
allocation will be made to the conservation district in the next round for an amount equal
only to their annual allocation or less if requested. There will be no back payment to
conservation districts for years in which they requested zero allocation.
J. Program Closure
A conservation district may choose to end its Dirt and Gravel Road Maintenance
Program in one of two ways. At the end of the five-year contract the conservation district
may opt not to renew the contract. This action should be formalized at a conservation
district board of directors’ meeting and noted in the minutes of the board. The SCC
should be notified in writing by the conservation district that they no longer wish to
participate in the program.
The second method for a conservation district to close its program is in accordance with
Paragraph 1K of the Five Year Agreement. The conservation district directors must pass
a resolution stating the district’s intention to withdraw from the program. The action is
noted in the district directors’ meeting minutes. The conservation district then shall
notify the SCC in writing that they intend to terminate their agreement with the Dirt and
Gravel Road Maintenance Program. In accordance with Paragraph 1K the termination
will be effective thirty (30) days from the date of the letter. By the time the thirty days
has elapsed all unspent monies must be returned to the SCC.
Pursuant to Paragraph 1J of the five-year agreement, when the Commission can
document that the terms and conditions of the agreement are not materially being met, the
Commission may, after 30 day written notice, suspend the District’s authority to proceed
with work under this agreement until corrective action has been taken to the satisfaction
of the Commission or until the agreement is terminated and all unspent funds are returned
to the Commission.
K. Return of Funds
If for any reason Dirt and Gravel Road Maintenance Program funds need to be returned
to the state make the check payable to “Commonwealth of Pennsylvania”. Mail the
check to:
