time Mr Tanner had worked for <strong>DPI</strong> for approximately 13 years. 38<br />

2.3.1.1 Public Hearing <strong>and</strong> Investigative Material<br />

[112] At a Commission public hearing on 27 January 2009 Mr Tanner admitted<br />

that he knew Mr Badih (George) Raphael, the proprietor of a vehicle<br />

wrecking yard, panel shop <strong>and</strong> mechanical workshop in O’Connor,<br />

Western Australia, trading as Safeway Auto Recyclers (“Safeway”). Mr<br />

Tanner also admitted that he had visited the Safeway premises in<br />

O’Connor. 39 When Mr Tanner was asked how he knew Mr Raphael he<br />

said:<br />

I've been - even before I was in the department I was in mechanical<br />

workshops <strong>and</strong> garages myself <strong>and</strong> I've actually bought parts off him, I'm<br />

sure. I can't give you an exact time I've known him. I'm sure I actually had<br />

dealings with him before I come into the department …<br />

I couldn't tell you when I first met him but I have known him for a number of<br />

years.<br />

More than 13 years obviously because you have been working - - -?---I'm<br />

sure. I'm sure. To be - I can't be certain. 40<br />

[113] At the public hearing Mr Tanner also admitted that he passed cars for Mr<br />

Raphael without inspecting them, as is evidenced <strong>by</strong> the following<br />

extracts.<br />

All right. I will go back to the question I was asking you earlier. You have<br />

told us that initially you did the pre-inspections followed <strong>by</strong> actual<br />

inspections, then it evolved into a situation where you would do on-site<br />

inspections. Did the arrangement evolve into a situation where you would<br />

fill out the paperwork, passing a vehicle or whatever, without seeing the<br />

vehicle at all?---There was a few vehicles done like that, not very many.<br />

Yes - yeah, there were some done like that. The majority of the vehicles<br />

though, I looked at the vehicles. 41<br />

You would look at them <strong>and</strong> after you passed them or not, then he would<br />

pay you the $50. Is that - - -?---The majority - no. The majority of the<br />

vehicles I wouldn't pass there <strong>and</strong> then. It'd be the next day after I'd - either<br />

come over the pits - as I said, there were some cars that I passed that<br />

didn't come over the pits <strong>and</strong> there were a few cars that I didn't inspect.<br />

Of the 200 to 250 that you say you examined in 2008, how many do you<br />

think you would have passed without seeing at all?---No more than 10, I'm<br />
