approximately 2 miles we<strong>st</strong> of <<strong>st</strong>rong>the</<strong>st</strong>rong> centre of Deeping St Nicholas and 3 miles ea<strong>st</strong> of Market Deeping. It is within<br />
convenient di<strong>st</strong>ance of Spalding, Bourne, Stamford and Peterborough.<br />
DESCRIPTION:<br />
The Farm extends to approximately 95.57 Hectares (236.15 Acres) in one very conveniently shaped parcel of arable<br />
land with easy access via internal <<strong>st</strong>rong>farm</<strong>st</strong>rong> roads to all enclosures toge<<strong>st</strong>rong>the</<strong>st</strong>rong>r with <<strong>st</strong>rong>the</<strong>st</strong>rong> benefit of modern buildings including<br />
1,000 tonne on-floor Grain Store and useful additional buildings, all located in a central yard with secure gated access<br />
from <<strong>st</strong>rong>the</<strong>st</strong>rong> A1175.<br />
LAND AND SOILS CLASSIFICATION:<br />
The land is classified Grade II on <<strong>st</strong>rong>the</<strong>st</strong>rong> Land Classification Map of England & Wales and is a mixture of <<strong>st</strong>rong>the</<strong>st</strong>rong><br />
Downholland 1 Series described as “deep <strong>st</strong>oneless humous clay soils, calcareous in places” with some peaty soils<br />
and deep humous calcareous silty soils suitable for cereals, sugar beet, potatoes and field vegetables and <<strong>st</strong>rong>the</<strong>st</strong>rong><br />
Clayhi<<strong>st</strong>rong>the</<strong>st</strong>rong> Series which is described as “deep humous fine loamy over sandy and fine loamy over clayey soils mainly<br />

FARM BUSINESS TENANCY AGREEMENT:<br />
The Farm will be let on a Farm Business Tenancy for 5 years from Autumn 2013 which will include <<strong>st</strong>rong>the</<strong>st</strong>rong> following<br />
main terms:<br />
1. Commencement date: 11th October 2013<br />
2. Term: 5 years<br />
3. Rent payable: Half yearly in advance, <<strong>st</strong>rong>the</<strong>st</strong>rong> fir<strong>st</strong> payment on <<strong>st</strong>rong>the</<strong>st</strong>rong> signing of <<strong>st</strong>rong>the</<strong>st</strong>rong> Agreement and<br />
<<strong>st</strong>rong>the</<strong>st</strong>rong>reafter on 6 April and 11 October each year.<br />
4. Maintenance: The tenant will be responsible for <<strong>st</strong>rong>the</<strong>st</strong>rong> full maintenance of <<strong>st</strong>rong>the</<strong>st</strong>rong> Farm including<br />
buildings, roadways, ditches and all o<<strong>st</strong>rong>the</<strong>st</strong>rong>r Landlord’s items including <<strong>st</strong>rong>the</<strong>st</strong>rong><br />
automatic <<strong>st</strong>rong>farm</<strong>st</strong>rong> entrance gate.<br />
5. Insurance: The tenant will be responsible for reimbursing <<strong>st</strong>rong>the</<strong>st</strong>rong> Landlord for <<strong>st</strong>rong>the</<strong>st</strong>rong> insurance<br />
premium on <<strong>st</strong>rong>the</<strong>st</strong>rong> <<strong>st</strong>rong>farm</<strong>st</strong>rong> buildings and will also be required to put in place Public<br />

6. Drainage Charges & O<<strong>st</strong>rong>the</<strong>st</strong>rong>r<br />
Normal Outgoings: To be <<strong>st</strong>rong>the</<strong>st</strong>rong> responsibility of <<strong>st</strong>rong>the</<strong>st</strong>rong> tenant.<br />

WAYLEAVES & EASEMENTS ETC:<br />
The land is subject to, and offered with <<strong>st</strong>rong>the</<strong>st</strong>rong> benefit of, all exi<strong>st</strong>ing rights, including rights of way, whe<<strong>st</strong>rong>the</<strong>st</strong>rong>r public or<br />
private, light, support, drainage, water, electricity and o<<strong>st</strong>rong>the</<strong>st</strong>rong>r rights, easements, quasi-easements and all wayleaves,<br />

RIGHTS OF WAY:<br />

DYKES & DITCHES:<br />
Certain dykes fall within <<strong>st</strong>rong>the</<strong>st</strong>rong> responsibility of <<strong>st</strong>rong>the</<strong>st</strong>rong> Welland & Deepings Internal Drainage Board and are subject to <<strong>st</strong>rong>the</<strong>st</strong>rong>ir<br />
normal byelaws. These dykes are highlighted in blue on <<strong>st</strong>rong>the</<strong>st</strong>rong> plans within <<strong>st</strong>rong>the</<strong>st</strong>rong>se Particulars. It will be a condition of <<strong>st</strong>rong>the</<strong>st</strong>rong><br />
tenancy that <<strong>st</strong>rong>the</<strong>st</strong>rong> dyke coloured in red on <<strong>st</strong>rong>the</<strong>st</strong>rong> plan should be cleaned out by <<strong>st</strong>rong>the</<strong>st</strong>rong> tenant (or <<strong>st</strong>rong>the</<strong>st</strong>rong> drainage board on <<strong>st</strong>rong>the</<strong>st</strong>rong>ir<br />

TENANTRIGHT:<br />
Tenantright for unexhau<strong>st</strong>ed manurial values and any po<strong>st</strong>-harve<strong>st</strong> cultivations will be payable by <<strong>st</strong>rong>the</<strong>st</strong>rong> incomer, such<br />
sum to be <strong>st</strong>ated by <<strong>st</strong>rong>the</<strong>st</strong>rong> Landlord’s Agents and payable at <<strong>st</strong>rong>the</<strong>st</strong>rong> time of signing of <<strong>st</strong>rong>the</<strong>st</strong>rong> Tenancy Agreement. Fur<<strong>st</strong>rong>the</<strong>st</strong>rong>r<br />
details will be available in due course.<br />
DILAPIDATIONS:<br />
There will be no claim allowed for dilapidations (if any) at <<strong>st</strong>rong>the</<strong>st</strong>rong> commencement of <<strong>st</strong>rong>the</<strong>st</strong>rong> tenancy but dilapidations will be<br />
charged if appropriate at <<strong>st</strong>rong>the</<strong>st</strong>rong> end of <<strong>st</strong>rong>the</<strong>st</strong>rong> tenancy.<br />
CONTRACTS & QUOTAS:<br />
There is a contract for sugar beet growing for 2013 for 1,036 tonnes. This will be transferred to <<strong>st</strong>rong>the</<strong>st</strong>rong> tenant for <<strong>st</strong>rong>the</<strong>st</strong>rong><br />
duration of <<strong>st</strong>rong>the</<strong>st</strong>rong> tenancy.<br />
RIGHT OF HOLDOVER:<br />
The majority, if not all, of <<strong>st</strong>rong>the</<strong>st</strong>rong> land will be cleared by 1<strong>st</strong> October 2013 but any temporary right of holdover as<br />
required will be retained by <<strong>st</strong>rong>the</<strong>st</strong>rong> Landlord until crops are harve<strong>st</strong>ed.<br />
USE OF BUILDINGS:<br />
The Grain Store will be required until 31<strong>st</strong> May 2014 for <<strong>st</strong>rong>the</<strong>st</strong>rong> <strong>st</strong>orage and out-loading of <<strong>st</strong>rong>the</<strong>st</strong>rong> 2013 harve<strong>st</strong>. Such<br />
electricity as may be used by <<strong>st</strong>rong>the</<strong>st</strong>rong> Landlord will be reimbursed to <<strong>st</strong>rong>the</<strong>st</strong>rong> incoming tenant on a basis to be agreed. The<br />
incoming tenant will be reque<strong>st</strong>ed to provide loading facilities for <<strong>st</strong>rong>the</<strong>st</strong>rong> Landlord’s outgoing crop upon reasonable notice<br />
and on terms to be agreed. The Landlord also reserves a Right of Holdover on <<strong>st</strong>rong>the</<strong>st</strong>rong> Workshop / Implement Store (in<br />
<<strong>st</strong>rong>the</<strong>st</strong>rong> north ea<strong>st</strong> corner of <<strong>st</strong>rong>the</<strong>st</strong>rong> yard) until 31<strong>st</strong> May 2014.<br />
LETTINGS ~ RESIDENTIAL ~ COMMERCIAL ~ AGRICULTURAL
MACHINERY SALE:<br />
The landlord will reserve <<strong>st</strong>rong>the</<strong>st</strong>rong> right to hold a dispersal sale of <<strong>st</strong>rong>farm</<strong>st</strong>rong> machinery and equipment in and around <<strong>st</strong>rong>the</<strong>st</strong>rong><br />
<<strong>st</strong>rong>farm</<strong>st</strong>rong>yard and buildings plus a dedicated area of <strong>st</strong>ubble land in Field No. TF1712 8060 on 26th October 2013.<br />

SPORTING RIGHTS:<br />
The Sporting Rights are let to a third party and are not available with <<strong>st</strong>rong>the</<strong>st</strong>rong> letting of <<strong>st</strong>rong>the</<strong>st</strong>rong> land. Fur<<strong>st</strong>rong>the</<strong>st</strong>rong>r information is<br />

SINGLE FARM PAYMENT:<br />
94.37 Entitlements will be transferred to <<strong>st</strong>rong>the</<strong>st</strong>rong> incoming tenant at no charge, who will be under an obligation to comply<br />
with Cross Compliance Regulations and to activate <<strong>st</strong>rong>the</<strong>st</strong>rong> Entitlements in each year of <<strong>st</strong>rong>the</<strong>st</strong>rong> tenancy. They are to be<br />
returned to <<strong>st</strong>rong>the</<strong>st</strong>rong> Landlord in <<strong>st</strong>rong>the</<strong>st</strong>rong>ir present form or any subsequent scheme that becomes appropriate under EU / RPA<br />
Regulations and which <<strong>st</strong>rong>the</<strong>st</strong>rong> tenant becomes entitled to as a result of occupation of <<strong>st</strong>rong>the</<strong>st</strong>rong> Farm. These are to be<br />
returned to <<strong>st</strong>rong>the</<strong>st</strong>rong> Landlord or <<strong>st</strong>rong>the</<strong>st</strong>rong> Landlord’s nominated successor at <<strong>st</strong>rong>the</<strong>st</strong>rong> end of <<strong>st</strong>rong>the</<strong>st</strong>rong> tenancy for <<strong>st</strong>rong>the</<strong>st</strong>rong> nominal sum of £1.<br />
The incoming tenant will indemnify <<strong>st</strong>rong>the</<strong>st</strong>rong> Landlord with regards to Cross Compliance Regulations from <<strong>st</strong>rong>the</<strong>st</strong>rong> date of<br />
completion of <<strong>st</strong>rong>the</<strong>st</strong>rong> tenancy or early entry (whichever is <<strong>st</strong>rong>the</<strong>st</strong>rong> sooner) until 31 December 2013. Copies of <<strong>st</strong>rong>the</<strong>st</strong>rong> RPA Land<br />
Regi<strong>st</strong>er plans are available upon reque<strong>st</strong> from Long<strong>st</strong>aff’s Agricultural Department - Spalding Office.<br />
ENTRY LEVEL STEWARDSHIP:<br />
The land is currently entered into an Entry Level Stewardship Scheme as part of a wider land holding. This<br />
commenced on 1<strong>st</strong> January 2012 and runs to 31/12/16. The tenant will be required to continue to have <<strong>st</strong>rong>the</<strong>st</strong>rong> land<br />
entered into <<strong>st</strong>rong>the</<strong>st</strong>rong> Scheme. Natural England have indicated that ei<<strong>st</strong>rong>the</<strong>st</strong>rong>r <<strong>st</strong>rong>the</<strong>st</strong>rong> land can be incorporated into an incoming<br />
tenant’s exi<strong>st</strong>ing scheme or alternatively, this land can be entered into The Scheme in isolation, subject to meeting <<strong>st</strong>rong>the</<strong>st</strong>rong><br />
points target. Prospective tenants are advised to satisfy <<strong>st</strong>rong>the</<strong>st</strong>rong>mselves in relation to <<strong>st</strong>rong>the</<strong>st</strong>rong> options, points target<br />

IRRIGATION LICENCE:<br />
There is an Ab<strong>st</strong>raction Licence (Licence No. 5/31/14/S/199) which will be made available to <<strong>st</strong>rong>the</<strong>st</strong>rong> tenant. The Licence<br />

apportioned accordingly from <<strong>st</strong>rong>the</<strong>st</strong>rong> date of <<strong>st</strong>rong>the</<strong>st</strong>rong> commencement of <<strong>st</strong>rong>the</<strong>st</strong>rong> tenancy. For <<strong>st</strong>rong>the</<strong>st</strong>rong> remainder of <<strong>st</strong>rong>the</<strong>st</strong>rong> tenancy <<strong>st</strong>rong>the</<strong>st</strong>rong><br />
Board will account direct to <<strong>st</strong>rong>the</<strong>st</strong>rong> tenant.<br />
CROPPING:<br />
No Potatoes have been grown on <<strong>st</strong>rong>the</<strong>st</strong>rong> <<strong>st</strong>rong>farm</<strong>st</strong>rong> since 1989. The tenant of <<strong>st</strong>rong>the</<strong>st</strong>rong> <<strong>st</strong>rong>farm</<strong>st</strong>rong> will be re<strong>st</strong>ricted to growing a<br />
maximum of 18.21 Hectares (45 Acres) of potatoes on <<strong>st</strong>rong>the</<strong>st</strong>rong> <<strong>st</strong>rong>farm</<strong>st</strong>rong> in any one year or alternatively an average to be<br />
spread over <<strong>st</strong>rong>the</<strong>st</strong>rong> whole five year term. The tenant will not be permitted to sublet any part of <<strong>st</strong>rong>the</<strong>st</strong>rong> Holding.<br />
