the member of the immediate family of a person who is affiliated with the University andwho shall provide representation for general community interests in the proper care andtreatment of animals. A single member of the Committee may fulfill more than one of theabove stated roles. No more than three (3) members of the Committee shall be from thesame administrative unit of the University.FunctionsThe Committee shall inspect at least semi-annually all vertebrate animal study areas andvertebrate animal facilities of the University, shall review, as part of the inspection,practices involving pain to animals and the condition of animals to ensure compliancewith the Animal Welfare Act, 7 U.S.C. §2143 et seq.; 9 C.F.R. 1, §2.31 and the standardsof the United States Public Health Service as set forth in the Guide for the Care and Useof Laboratory Animals, and shall do all other things necessary to effectuate its role as theUniversity’s Institutional Animal Care and Use Committee as that term is defined by theaforementioned regulations.ProceduresA quorum shall be required for all formal actions of the Committee. Upon completion ofthe semi-annual inspection, the Committee shall file with the Office of the Dean,Graduate School and Research a report of the inspection signed by a majority of theCommittee members involved in the inspection. The report shall include any findings ofviolation of the standards promulgated by the Secretary of Agriculture or the PublicHealth Service, shall include any minority views of the Committee, and shall remain onfile for at least three (3) years. If any deficiencies are discovered as a result of theinspection, the Dean and/or Director of the facility shall also be notified and given anopportunity to correct the deficiency. If the deficiency remains after the Dean and/orDirector of the facility has been notified of the deficiency and given a reasonableopportunity to correct the same, the Committee shall notify (in writing) the Animal andPlant Heath Inspection Service of the U.S. Department of Agriculture, the funding federalagency and the Office of Protection for Protection from Research Risks of the NationalInstitutes of Health. The Committee may also review and approve, or withhold approvalof those sections of Public Health Service applications or proposals related to the careand use of vertebrate animals.I. INTELLECTUAL PROPERTYThe University of Guam encourages and supports the development of intellectual property. TheUniversity Research Council will serve as an advisory body on matters pertaining to Universityintellectual property.1. INTELLECTUAL PROPERTY SUBCOMMITTEEMembership32
The Intellectual Property Committee shall consist of twelve (12) members. Six (6) shallbe faculty members chosen to reflect a diversity of expertise, appointed to three (3) yearstaggered terms. Three (3) members shall be appointed by the Vice President, AcademicAffairs; and three (3) by the Faculty Council. One (1) additional faculty member shall beappointed to a three (3) year term by the President. The remaining five (5) shall beadministrators appointed by the President. The Committee shall elect its Chair.FunctionsThe Intellectual Property Committee shall represent and act for the University inintellectual property policy matters subject to the approval of the President of theUniversity.INTELLECTUAL PROPERTY POLICYIntellectual Property is defined as any original idea or data subject to competingclaims and legal protection. It includes patents, copyrights, trade marks, trade secrets andplant protection certificates.All members of the University including faculty, research associates, staff,students, graduate assistants and research assistants in any combination of study, researchand teaching shall be subject to the provisions of this policy.Members of the University shall retain the right and responsibility to developintellectual property, and in every case complete freedom of publication by the creator inboth time and scope shall be maintained, unless agreements with outside sponsorsprovide otherwise. Three (3) separate relationships between the creator and theUniversity are recognized.Class IIf intellectual property is developed wholly with University support in time,personnel, money, materials, or facilities, said intellectual property is the property of theUniversity and the creator is responsible for disclosing in full to the IPC the nature of theinvention and for providing documentation as to those who participated in itsdevelopment. If the author of a manuscript believes that it contains legally protectablematerial and wishes University assistance in marketing it, a copy of the manuscriptshould be submitted to the IPC prior to its submission for publication. The IPC mayadvise deferral of publication to protect intellectual property rights of both the creatorand the University, but no prior submission of any manuscript nor any delay ofpublication shall be imposed by the University.Class II33
