<strong>City</strong> <strong>of</strong> <strong>Gladwin</strong>2010 Zoning Ordinance-----------------------------------------------------------------------------------------------------------------------------------------------------------------ARTICLE IIIGENERAL PROVISIONSSECTION 301.INTENT.This Article provides site regulations that apply to multiple zoning districts and thus aredetailed in this separate Article. These regulations may apply to only two or three districtsor may apply to all <strong>of</strong> them.SECTION 302.BUILDING REGULATIONS.1. ScopeNo building or structure, or part there<strong>of</strong>, shall hereafter be erected, constructed, used,reconstructed, altered or maintained, and no lot or land, or part there<strong>of</strong>, shall hereafter beused or maintained and no new use made <strong>of</strong> any building, structure or land, or partthere<strong>of</strong>, except in conformity with the provisions <strong>of</strong> this Ordinance.2. Unlawful BuildingIf any building, or part there<strong>of</strong>, is used, erected, occupied or altered contrary to law or theprovisions <strong>of</strong> this Ordinance, such building shall be deemed an unlawful structure and anuisance and may be required to be vacated, torn down or abated by any legal means,and shall not be used or occupied until it has been made to conform to the provisions <strong>of</strong>this Ordinance. Public expenditures toward abating such nuisance shall become a lienupon the land.3. Temporary BuildingNo temporary building shall be erected unless a valid building permit exists for apermanent building or a new use <strong>of</strong> land on the same site. Any temporary building shallbe removed from the site within thirty (30) days <strong>of</strong> issuance <strong>of</strong> a certificate <strong>of</strong> occupancy,whether the certificate is provided by the <strong>City</strong> <strong>of</strong> <strong>Gladwin</strong> or the County <strong>of</strong> <strong>Gladwin</strong>. Theapproval <strong>of</strong> a temporary building may not exceed one (1) year; however, the PlanningCommission may grant multiple extensions up to three (3) months each for good causeshown when the approval is due to expire.4. Building OccupancyNo dwelling shall be erected in a nonresidential district, except for the living quarters on asecond floor, which is incidental to principle use. In addition not more 10% <strong>of</strong> the existingground floor may have a residence.5. Frontage on a Public StreetNo building shall be erected on a lot unless said lot fronts no less than fifty (50) percent itsfull width, upon a street or road that has been dedicated to the public, except where a siteplan that provides for adequate vehicular access and circulation, and future traffic needs <strong>of</strong>the city has been approved by the Planning Commission. Multi-family developments, orcommercial, <strong>of</strong>fice, or industrial centers need not front each such structure within thedevelopment upon publicly dedicated streets or roads, provided that adequate interiorvehicular circulation and access can be assured in a site plan submitted for approval to thePlanning Commission.28
