<strong>City</strong> <strong>of</strong> <strong>Gladwin</strong>2010 Zoning Ordinance-----------------------------------------------------------------------------------------------------------------------------------------------------------------Nothing in this Ordinance shall be construed as prohibiting an owner, tenant, occupant, orland contract vendee from doing his or her own building, altering, plumbing, electricalinstallations, etc., provided it includes compliance with the minimum requirements andinspection per the Electrical and Plumbing Codes <strong>of</strong> the State <strong>of</strong> Michigan, and theapplicable County Health Department regulations.SECTION 304.1. IntentHUMAN SAFETY AND ENVIRONMENTAL PROTECTIONIt is the intent <strong>of</strong> this ordinance to protect the health, safety, and welfare <strong>of</strong> individualresidents, the overall community and the natural and built environment. Accordingly alluses <strong>of</strong> land, buildings, and structures in the zoning districts in this Ordinance shallconform to the following performance standards.a. SmokeA person or industry shall not discharge into the atmosphere from any single source <strong>of</strong>emission whatsoever any air contaminant smoke for a period or periods aggregating morethan three (3) minutes in any hour which is:(1) As dark or darker in shade as that designated as No. ½ on the Ringelmannchart as published by the United States Bureau <strong>of</strong> Mines, or(2) Of such density as to obscure and observer’s view to a degree equal orgreater than the level <strong>of</strong> smoke described in subsection (1) <strong>of</strong> this standard.(3) At no time shall smoke emissions be darker than Ringelmann No. 1b. Noxious GasesNo noxious or malodorous gases shall be allowed to escape into the atmosphere inconcentrations which are <strong>of</strong>fensive, which produces a public nuisance or hazard on anyadjoining lot or property, or which could be detrimental to human, plant, or animal life.c. Air ContaminantsA person or industry shall not discharge from any source whatsoever such quantities <strong>of</strong> aircontaminants or other material such as fly-ash, dust, vapor, or other air pollutants, whichwould cause injury or harm to health, animals, or vegetation, or other property, or whichcan cause excessive soiling. Dust, dirt, smoke, or fly-ash shall not be in excess <strong>of</strong> 0.3grams per cubic foot <strong>of</strong> flue gas at stack temperature <strong>of</strong> five hundred (500) degreesFahrenheit and not exceed fifty (50) percent excess air.d. Glare and HeatAny operation or activity producing glare shall be so positioned that direct and indirectillumination from the source <strong>of</strong> light shall not cause illumination in excess <strong>of</strong> one-half (1/2)<strong>of</strong> one (1) foot candle when measured at any property line. Flickering or intense source <strong>of</strong>light shall be controlled so as to not cause a nuisance across any property lines.If heat results from any industrial operation or other source, it shall be so insulated as tonot raise the temperature at any property line at any time.e. NoiseNo activity shall emit noise in excess <strong>of</strong> the standards specified in the <strong>City</strong> <strong>of</strong> <strong>Gladwin</strong>Code <strong>of</strong> Ordinances.30
