City of Gladwin2010 Zoning Ordinance-----------------------------------------------------------------------------------------------------------------------------------------------------------------Nothing in this Ordinance shall be construed as prohibiting an owner, tenant, occupant, orland contract vendee from doing his or her own building, altering, plumbing, electricalinstallations, etc., provided it includes compliance with the minimum requirements andinspection per the Electrical and Plumbing Codes of the State of Michigan, and theapplicable County Health Department regulations.SECTION 304.1. IntentHUMAN SAFETY AND ENVIRONMENTAL PROTECTIONIt is the intent of this ordinance to protect the health, safety, and welfare of individualresidents, the overall community and the natural and built environment. Accordingly alluses of land, buildings, and structures in the zoning districts in this Ordinance shallconform to the following performance standards.a. SmokeA person or industry shall not discharge into the atmosphere from any single source ofemission whatsoever any air contaminant smoke for a period or periods aggregating morethan three (3) minutes in any hour which is:(1) As dark or darker in shade as that designated as No. ½ on the Ringelmannchart as published by the United States Bureau of Mines, or(2) Of such density as to obscure and observer’s view to a degree equal orgreater than the level of smoke described in subsection (1) of this standard.(3) At no time shall smoke emissions be darker than Ringelmann No. 1b. Noxious GasesNo noxious or malodorous gases shall be allowed to escape into the atmosphere inconcentrations which are offensive, which produces a public nuisance or hazard on anyadjoining lot or property, or which could be detrimental to human, plant, or animal life.c. Air ContaminantsA person or industry shall not discharge from any source whatsoever such quantities of aircontaminants or other material such as fly-ash, dust, vapor, or other air pollutants, whichwould cause injury or harm to health, animals, or vegetation, or other property, or whichcan cause excessive soiling. Dust, dirt, smoke, or fly-ash shall not be in excess of 0.3grams per cubic foot of flue gas at stack temperature of five hundred (500) degreesFahrenheit and not exceed fifty (50) percent excess air.d. Glare and HeatAny operation or activity producing glare shall be so positioned that direct and indirectillumination from the source of light shall not cause illumination in excess of one-half (1/2)of one (1) foot candle when measured at any property line. Flickering or intense source oflight shall be controlled so as to not cause a nuisance across any property lines.If heat results from any industrial operation or other source, it shall be so insulated as tonot raise the temperature at any property line at any time.e. NoiseNo activity shall emit noise in excess of the standards specified in the City of GladwinCode of Ordinances.30

VibrationVibrations from industrial operations or other sources shall be controlled to the extent thatthey cannot be felt beyond any property line.g. Radio TransmissionRadio equipment required in industrial or other operation shall be so shielded that itsoperation will not interfere with radio, television, or other electronic equipment.h. Storage of Flammable MaterialsAny activity involving the use of or storage of flammable or explosive devices or materialsshall be protected by adequate fire-fighting and fire suppression equipment and suchsafety devices as are normally used in handling of any such material. Such hazards shallbe kept removed from adjacent activities to a distance which is compatible with thepotential danger involved. The City of Gladwin Fire Department may review the statusFlammable Material at any time.i. Radioactive MaterialsNo activity shall emit dangerous radioactivity at any point, or unreasonable electricaldisturbance adversely affecting the operation at any point of any equipment other than thatof the creator of such disturbance.j. Water PollutionPollution of water shall be subject to the requirements and regulations as are establishedby the Michigan Department of Community Health, the Michigan Department of NaturalResources, the Michigan Department of Environmental Quality, the Gladwin CountyHealth Department, and/or the City of Gladwin.K.No premises in the City of Gladwin, Michigan shall be used or occupied for the purpose ofa medical marijuana club, distribution facility or growing facility. Any use, cultivation ordistribution of medical marijuana shall be allowed only to the extent such is lawful underState or federal law and in conformity with this Ordinance.SECTION 305.1. IntentNONCONFORMING LOTS, USES OF LAND,STRUCTURES, AND USESOF STRUCTURES ORPREMISES.It is the intent of this Ordinance to permit existing, legal nonconforming lots, structures, oruses to continue until they are removed but not to encourage their long-term survival.It is recognized that there exists within the districts established by this Ordinance andsubsequent amendments, lots, structures, and use of land and structures which werelawful before this Ordinance was passed or amended which would be prohibited,regulated, or restricted under the terms of this Ordinance or future amendments.Such uses are declared by this Ordinance to be incompatible with permitted uses in thedistricts involved. It is further the intent of this Ordinance that nonconformities shall not beenlarged upon, expanded or extended, nor be used as grounds for adding other structuresor uses prohibited elsewhere in the same district.31
