Sec. 1321.59 Submissi<strong>on</strong> of an area plan and plan amendments to theState for approval.The area agency shall submit the area plan and amendments to theState agency for approval following procedures specified by the Stateagency in the State policies prescribed by Sec. 1321.11.Sec. 1321.61 Advocacy resp<strong>on</strong>sibilities of the area agency.(a) The area agency shall serve as the public advocate for thedevelopment or enhancement of comprehensive and coordinated communitybasedsystems of services in each community throughout the planning andservice area.(b) In carrying out this resp<strong>on</strong>sibility, the area agency shall:(1) M<strong>on</strong>itor, evaluate, and, where appropriate, comment <strong>on</strong> allpolicies, programs, hearings, levies, and community <str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong>s which affect<str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s;(2) Solicit comments from the public <strong>on</strong> the needs of <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s;(3) Represent the interests of <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s to local level andexecutive branch officials, public and private agencies ororganizati<strong>on</strong>s;(4) C<strong>on</strong>sult with and support the State's l<strong>on</strong>g-term care ombudsmanprogram; and(5) Undertake <strong>on</strong> a regular basis <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities designed to facilitatethe coordinati<strong>on</strong> of plans and <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities with all other public andprivate organizati<strong>on</strong>s, including units of general purpose localgovernment, with resp<strong>on</strong>sibilities affecting <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in theplanning and service area to promote new or expanded benefits andopportunities for <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s; and(c) Each area agency <strong>on</strong> aging shall undertake a leadership role inassisting communities throughout the planning and service area to targetresources from all appropriate sources to meet the needs of <str<strong>on</strong>g>older</str<strong>on</strong>g>pers<strong>on</strong>s with greatest ec<strong>on</strong>omic or social need, with particular attenti<strong>on</strong>to low income minority individuals. Such <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities may include locati<strong>on</strong>of services and specializati<strong>on</strong> in the types of services must needed bythese groups to meet this requirement. However, the area agency may notpermit a grantee or c<strong>on</strong>tr<str<strong>on</strong>g>act</str<strong>on</strong>g>or under this part to employ a means testfor services funded under this part.(d) No requirement in this secti<strong>on</strong> shall be deemed to supersede aprohibiti<strong>on</strong> c<strong>on</strong>tained in the Federal appropriati<strong>on</strong> <strong>on</strong> the use of Federalfunds to lobby the C<strong>on</strong>gress; or the lobbying provisi<strong>on</strong> applicable toprivate n<strong>on</strong>profit agencies and organizati<strong>on</strong>s c<strong>on</strong>tained in OMB CircularA-122.19
