planning and service area State.Fiscal year, as used in this part, means the Federal Fiscal Year.Frail, as used in this part, means having a physical or mentaldisability, including having Alzheimer's disease or a related disorderwith neurological or organic brain dysfuncti<strong>on</strong>, that restricts theability of an individual to perform normal daily tasks or whichthreatens the capacity of an individual to live independently.Human services, as used in Sec. 1321.41(a)(1) of this part, withrespect to criteria for designati<strong>on</strong> of a statewide planning and servicearea, means social, health, or welfare services.In-home service, as used in this part, includes: (a) Homemaker andhome health aides; (b) visiting and teleph<strong>on</strong>e reassurance; (c) choremaintenance; (d) in-home respite care for families, including adult daycare as a respite service for families; and (e) minor modificati<strong>on</strong> ofhomes that is necessary to facilitate the ability of <str<strong>on</strong>g>older</str<strong>on</strong>g> individualsto remain at home, and that is not available under other programs,except that not more than $150 per client may be expended under thispart for such modificati<strong>on</strong>.Means test, as used in the provisi<strong>on</strong> of services, means the use of an<str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>'s income or resource to deny or limit that pers<strong>on</strong>'s receiptof services under this part.Official duties, as used in secti<strong>on</strong> 307(a)(12)(J) of the Act withrespect to representatives of the L<strong>on</strong>g-Term Care Ombudsman Program,means work pursuant to the L<strong>on</strong>g-Term Care Ombudsman Program authorizedby the Act or State law and carried out under the auspices and generaldirecti<strong>on</strong> of the State L<strong>on</strong>g-Term Care Ombudsman.Periodic, as used in secti<strong>on</strong>s 306(a)(6) and 307(a)(8) of the Actwith respect to evaluati<strong>on</strong>s of, and public hearings <strong>on</strong>, <str<strong>on</strong>g>act</str<strong>on</strong>g>ivitiescarried out under State and area plans, means, at a minimum, <strong>on</strong>ce eachfiscal year.Reservati<strong>on</strong>, as used in secti<strong>on</strong> 305(b)(4) of the Act with respect tothe designati<strong>on</strong> of planning and service areas, means any federally orState recognized Indian tribe's reservati<strong>on</strong>, pueblo, or col<strong>on</strong>y,including former reservati<strong>on</strong>s in Oklahoma, Alaskan Native regi<strong>on</strong>s establishedpursuant to the Alaska Native Claims Settlement Act (85 Stat. 688), and Indianallotments.Service provider, as used in secti<strong>on</strong> 306(a)(1) of the Act withrespect to the provisi<strong>on</strong> of supportive and nutriti<strong>on</strong> services, means anentity that is awarded a subgrant or c<strong>on</strong>tr<str<strong>on</strong>g>act</str<strong>on</strong>g> from an area agency toprovide services under the area plan.Severe disability, as used to carry out the provisi<strong>on</strong>s of the Act,means a severe chr<strong>on</strong>ic disability attributable to mental and/or physicalimpairment of an individual that:(a) Is likely to c<strong>on</strong>tinue indefinitely; and(b) Results in substantial functi<strong>on</strong>al limitati<strong>on</strong> in 3 or more of thefollowing major life <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities:4
