Older Americans Act, as amended (Act). These requirements include:(1) Designati<strong>on</strong> and resp<strong>on</strong>sibilities of State agencies;(2) State plans and amendments;(3) Services delivery; and(4) Hearing procedures for applicants for planning and services areadesignati<strong>on</strong>.(b) The requirements of this part are based <strong>on</strong> <str<strong>on</strong>g>title</str<strong>on</strong>g> III of the Act.Title III provides for formula grants to State agencies <strong>on</strong> aging, underapproved State plans, to stimulate the development or enhancement ofcomprehensive and coordinated community-based systems resulting in ac<strong>on</strong>tinuum of services to <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s with special emphasis <strong>on</strong> <str<strong>on</strong>g>older</str<strong>on</strong>g>individuals with the greatest ec<strong>on</strong>omic or social need, withparticular attenti<strong>on</strong> to low-income minority individuals. A resp<strong>on</strong>sivecommunity-based system of services shall include collaborati<strong>on</strong> inplanning, resource allocati<strong>on</strong> and delivery of a comprehensive array ofservices and opportunities for all <str<strong>on</strong>g>older</str<strong>on</strong>g> Americans in the community. Theintent is to use <str<strong>on</strong>g>title</str<strong>on</strong>g> III funds as a catalyst in bringing togetherpublic and private resources in the community to assure the provisi<strong>on</strong> ofa full range of efficient, well coordinated and accessible services for<str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s.(c) Each State agency designates planning and service areas in theState, and makes a subgrant or c<strong>on</strong>tr<str<strong>on</strong>g>act</str<strong>on</strong>g> under an approved area plan to<strong>on</strong>e area agency in each planning and service area for the purpose ofbuilding comprehensive systems for <str<strong>on</strong>g>older</str<strong>on</strong>g> people throughout the State.Area agencies in turn make subgrants or c<strong>on</strong>tr<str<strong>on</strong>g>act</str<strong>on</strong>g>s to service providersto perform certain specified functi<strong>on</strong>s.Sec. 1321.3 Definiti<strong>on</strong>s.Act means the Older Americans Act of 1965 as amended.Altering or renovating, as used in secti<strong>on</strong> 307(a)(14) of the Actwith respect to multipurpose senior centers, means making modificati<strong>on</strong>sto or in c<strong>on</strong>necti<strong>on</strong> with an existing facility which are necessary forits effective use as a center. These may include renovati<strong>on</strong>, repair, orexpansi<strong>on</strong> which is not in excess of double the square footage of theoriginal facility and all physical improvements.C<strong>on</strong>structing, as used in secti<strong>on</strong> 307(a)(14) of the Act with respectto multipurpose senior centers, means building a new facility, includingthe costs of land acquisiti<strong>on</strong> and architectural and engineering fees, ormaking modificati<strong>on</strong>s to or in c<strong>on</strong>necti<strong>on</strong> with an existing facility whichare in excess of double the square footage of the original facility andall physical improvements.Department means the Department of Health and Human Services.Direct services, as used in this part, means any <str<strong>on</strong>g>act</str<strong>on</strong>g>ivity performedto provide services directly to an individual <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong> by the staffof a service provider, an area agency, or a State agency in a single3


planning and service area State.Fiscal year, as used in this part, means the Federal Fiscal Year.Frail, as used in this part, means having a physical or mentaldisability, including having Alzheimer's disease or a related disorderwith neurological or organic brain dysfuncti<strong>on</strong>, that restricts theability of an individual to perform normal daily tasks or whichthreatens the capacity of an individual to live independently.Human services, as used in Sec. 1321.41(a)(1) of this part, withrespect to criteria for designati<strong>on</strong> of a statewide planning and servicearea, means social, health, or welfare services.In-home service, as used in this part, includes: (a) Homemaker andhome health aides; (b) visiting and teleph<strong>on</strong>e reassurance; (c) choremaintenance; (d) in-home respite care for families, including adult daycare as a respite service for families; and (e) minor modificati<strong>on</strong> ofhomes that is necessary to facilitate the ability of <str<strong>on</strong>g>older</str<strong>on</strong>g> individualsto remain at home, and that is not available under other programs,except that not more than $150 per client may be expended under thispart for such modificati<strong>on</strong>.Means test, as used in the provisi<strong>on</strong> of services, means the use of an<str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>'s income or resource to deny or limit that pers<strong>on</strong>'s receiptof services under this part.Official duties, as used in secti<strong>on</strong> 307(a)(12)(J) of the Act withrespect to representatives of the L<strong>on</strong>g-Term Care Ombudsman Program,means work pursuant to the L<strong>on</strong>g-Term Care Ombudsman Program authorizedby the Act or State law and carried out under the auspices and generaldirecti<strong>on</strong> of the State L<strong>on</strong>g-Term Care Ombudsman.Periodic, as used in secti<strong>on</strong>s 306(a)(6) and 307(a)(8) of the Actwith respect to evaluati<strong>on</strong>s of, and public hearings <strong>on</strong>, <str<strong>on</strong>g>act</str<strong>on</strong>g>ivitiescarried out under State and area plans, means, at a minimum, <strong>on</strong>ce eachfiscal year.Reservati<strong>on</strong>, as used in secti<strong>on</strong> 305(b)(4) of the Act with respect tothe designati<strong>on</strong> of planning and service areas, means any federally orState recognized Indian tribe's reservati<strong>on</strong>, pueblo, or col<strong>on</strong>y,including former reservati<strong>on</strong>s in Oklahoma, Alaskan Native regi<strong>on</strong>s establishedpursuant to the Alaska Native Claims Settlement Act (85 Stat. 688), and Indianallotments.Service provider, as used in secti<strong>on</strong> 306(a)(1) of the Act withrespect to the provisi<strong>on</strong> of supportive and nutriti<strong>on</strong> services, means anentity that is awarded a subgrant or c<strong>on</strong>tr<str<strong>on</strong>g>act</str<strong>on</strong>g> from an area agency toprovide services under the area plan.Severe disability, as used to carry out the provisi<strong>on</strong>s of the Act,means a severe chr<strong>on</strong>ic disability attributable to mental and/or physicalimpairment of an individual that:(a) Is likely to c<strong>on</strong>tinue indefinitely; and(b) Results in substantial functi<strong>on</strong>al limitati<strong>on</strong> in 3 or more of thefollowing major life <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities:4


(1) Self-care,(2) Receptive and expressive language,(3) Learning,(4) Mobility,(5) Self-directi<strong>on</strong>,(6) Capacity for independent living, and(7) Ec<strong>on</strong>omic self-sufficiency.Sec. 1321.5 Applicability of other <str<strong>on</strong>g>regulati<strong>on</strong>s</str<strong>on</strong>g>.Several other <str<strong>on</strong>g>regulati<strong>on</strong>s</str<strong>on</strong>g> apply to all <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities under this part.These include but are not limited to:(a) 45 CFR part 16--Procedures of the Departmental Grant AppealsBoard;(b) 45 CFR part 74--<str<strong>on</strong>g>Administrati<strong>on</strong></str<strong>on</strong>g> of Grants, except subpart N;(c) 45 CFR part 80--N<strong>on</strong>discriminati<strong>on</strong> under Programs ReceivingFederal Assistance through the Department of Health and Human Services:Effectuati<strong>on</strong> of <str<strong>on</strong>g>title</str<strong>on</strong>g> VI of the Civil Rights Act of 1964;(d) 45 CFR part 81--Pr<str<strong>on</strong>g>act</str<strong>on</strong>g>ice and Procedures for Hearings Under Part80 of this <str<strong>on</strong>g>title</str<strong>on</strong>g>;(e) 45 CFR part 84--N<strong>on</strong>discriminati<strong>on</strong> <strong>on</strong> the Basis of Handicap inPrograms and Activities Receiving or Benefiting from Federal FinancialParticipati<strong>on</strong>;(f) 45 CFR part 91--N<strong>on</strong>discriminati<strong>on</strong> <strong>on</strong> the Basis of Age in HHSPrograms or Activities Receiving Federal Financial Assistance;(g) 45 CFR part 92--Uniform Administrative Requirements for Grantsand Cooperative Agreements to State and Local Governments;(h) 45 CFR part 100--Intergovernmental Review of Department ofHealth and Human Services Programs and Activities; and(i) 5 CFR part 900, subpart F, Standards for a Merit System ofPers<strong>on</strong>nel <str<strong>on</strong>g>Administrati<strong>on</strong></str<strong>on</strong>g>.Subpart B--State Agency Resp<strong>on</strong>sibilitiesSec. 1321.7 Missi<strong>on</strong> of the State agency.(a) The Older Americans Act intends that the State agency <strong>on</strong> agingshall be the leader relative to all aging issues <strong>on</strong> behalf of all <str<strong>on</strong>g>older</str<strong>on</strong>g>pers<strong>on</strong>s in the State. This means that the State agency shall pro<str<strong>on</strong>g>act</str<strong>on</strong>g>ivelycarry out a wide range of functi<strong>on</strong>s related to advocacy, planning,coordinati<strong>on</strong>, interagency linkages, informati<strong>on</strong> sharing, brokering,m<strong>on</strong>itoring and evaluati<strong>on</strong>, designed to lead to the development orenhancement of comprehensive and coordinated community based systems in,or serving, communities throughout the State. These systems shall bedesigned to assist <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in leading independent, meaningful anddignified lives in their own homes and communities as l<strong>on</strong>g as possible.5


complainant or resident of a l<strong>on</strong>g term care facility as prescribed insecti<strong>on</strong> 307(a)(12) of the Act shall be strictly adhered to.Sec. 1321.13 Advocacy resp<strong>on</strong>sibilities.(a) The State agency shall:(1) Review, m<strong>on</strong>itor, evaluate and comment <strong>on</strong> Federal, State andlocal plans, budgets, <str<strong>on</strong>g>regulati<strong>on</strong>s</str<strong>on</strong>g>, programs, laws, levies, hearings,policies, and <str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong>s which affect or may affect <str<strong>on</strong>g>older</str<strong>on</strong>g> individuals andrecommend any changes in these which the State agency c<strong>on</strong>siders to beappropriate;(2) Provide technical assistance to agencies, organizati<strong>on</strong>s,associati<strong>on</strong>s, or individuals representing <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s; and(3) Review and comment, up<strong>on</strong> request, <strong>on</strong> applicati<strong>on</strong>s to State andFederal agencies for assistance relating to meeting the needs of <str<strong>on</strong>g>older</str<strong>on</strong>g>pers<strong>on</strong>s.(b) No requirement in this secti<strong>on</strong> shall be deemed to supersede aprohibiti<strong>on</strong> c<strong>on</strong>tained in a Federal appropriati<strong>on</strong> <strong>on</strong> the use of Federalfunds to lobby the C<strong>on</strong>gress.Sec. 1321.15 Durati<strong>on</strong>, format and effective date of the State plan.(a) A State may use its own judgment as to the format to use for theplan, how to collect informati<strong>on</strong> for the plan, and whether the plan willremain in effect for two, three or four years.(b) An approved State plan or amendment, as identified inSec. 1321.17, becomes effective <strong>on</strong> the date designated by theCommissi<strong>on</strong>er.(c) A State agency may not make expenditures under a new plan oramendment requiring approval, as identified in Sec. 1321.17 andSec. 1321.19, until it is approved.Sec. 1321.17 C<strong>on</strong>tent of State plan.To receive a grant under this part, a State shall have an approvedState plan as prescribed in secti<strong>on</strong> 307 of the Act. In additi<strong>on</strong> tomeeting the requirements of secti<strong>on</strong> 307, a State plan shall include:(a) Identificati<strong>on</strong> by the State of the sole State agency that hasbeen designated to develop and administer the plan.(b) Statewide program objectives to implement the requirements underTitle III of the Act and any objectives established by the Commissi<strong>on</strong>erthrough the rulemaking process.(c) A resource allocati<strong>on</strong> plan indicating the proposed use of all<str<strong>on</strong>g>title</str<strong>on</strong>g> III funds administered by a State agency, and the distributi<strong>on</strong> of <str<strong>on</strong>g>title</str<strong>on</strong>g> IIIfunds to each planning and service area.(d) Identificati<strong>on</strong> of the geographic boundaries of each planning and7


service area and of area agencies <strong>on</strong> aging designated for each planningand service area, if appropriate.(e) Provisi<strong>on</strong> of prior Federal fiscal year informati<strong>on</strong> related tolow income minority and rural <str<strong>on</strong>g>older</str<strong>on</strong>g> individuals as required by secti<strong>on</strong>s307(a) (23) and (29) of the Act.(f) Each of the assurances and provisi<strong>on</strong>s required in secti<strong>on</strong>s 305and 307 of the Act, and provisi<strong>on</strong>s that the State meets each of therequirements under Secs. 1321.5 through 1321.75 of this part, and thefollowing assurances as prescribed by the Commissi<strong>on</strong>er:(1) Each area agency engages <strong>on</strong>ly in <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities which are c<strong>on</strong>sistentwith its statutory missi<strong>on</strong> as prescribed in the Act and as specified inState policies under Sec. 1321.11;(2) Preference is given to <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in greatest social orec<strong>on</strong>omic need in the provisi<strong>on</strong> of services under the plan;(3) Procedures exist to ensure that all services under this part areprovided without use of any means tests;(4) All services provided under <str<strong>on</strong>g>title</str<strong>on</strong>g> III meet any existing Stateand local licensing, health and safety requirements for the provisi<strong>on</strong> ofthose services;(5) Older pers<strong>on</strong>s are provided opportunities to voluntarilyc<strong>on</strong>tribute to the cost of services;(6) Area plans shall specify as submitted, or be amended annually toinclude, details of the amount of funds expended for each priorityservice during the past fiscal year;(7) The State agency <strong>on</strong> aging shall develop policies governing allaspects of programs operated under this part, including the manner inwhich the ombudsman program operates at the State level and the relati<strong>on</strong>of the ombudsman program to area agencies where area agencies have beendesignated;(8) The State agency will require area agencies <strong>on</strong> aging to arrangefor outreach at the community level that identifies individuals eligiblefor assistance under this Act and other programs, both public andprivate, and informs them of the availability of assistance. Theoutreach efforts shall place special emphasis <strong>on</strong> reaching <str<strong>on</strong>g>older</str<strong>on</strong>g>individuals with the greatest ec<strong>on</strong>omic or social needs with particularattenti<strong>on</strong> to low income minority individuals, including outreach toidentify <str<strong>on</strong>g>older</str<strong>on</strong>g> Indians in the planning and service area and inform such<str<strong>on</strong>g>older</str<strong>on</strong>g> Indians of the availability of assistance under the Act.(9) The State agency shall have and employ appropriate proceduresfor data collecti<strong>on</strong> from area agencies <strong>on</strong> aging to permit the State tocompile and transmit to the Commissi<strong>on</strong>er accurate and timely statewidedata requested by the Commissi<strong>on</strong>er in such form as the Commissi<strong>on</strong>erdirects; and(10) If the State agency proposes to use funds received undersecti<strong>on</strong> 303(f) of the Act for services other than those for preventivehealth specified in secti<strong>on</strong> 361, the State plan shall dem<strong>on</strong>strate the8


unmet need for the services and explain how the services are appropriateto improve the quality of life of <str<strong>on</strong>g>older</str<strong>on</strong>g> individuals, particularly thosewith the greatest ec<strong>on</strong>omic or social need, with special attenti<strong>on</strong> tolow-income minorities.(11) Area agencies shall compile available informati<strong>on</strong>, withnecessary supplementati<strong>on</strong>, <strong>on</strong> courses of post-sec<strong>on</strong>dary educati<strong>on</strong>offered to <str<strong>on</strong>g>older</str<strong>on</strong>g> individuals with little or no tuiti<strong>on</strong>. The assuranceshall include a commitment by the area agencies to make a summary of theinformati<strong>on</strong> available to <str<strong>on</strong>g>older</str<strong>on</strong>g> individuals at multipurpose seniorcenters, c<strong>on</strong>gregate nutriti<strong>on</strong> sites, and in other appropriate places.(12) Individuals with disabilities who reside in a n<strong>on</strong>-instituti<strong>on</strong>alhousehold with and accompany a pers<strong>on</strong> eligible for c<strong>on</strong>gregate mealsunder this part shall be provided a meal <strong>on</strong> the same basis that mealsare provided to volunteers pursuant to secti<strong>on</strong> 307(a)(13)(I) of the Act.(13) The services provided under this part will be coordinated,where appropriate, with the services provided under <str<strong>on</strong>g>title</str<strong>on</strong>g> VI of the Act.(14)(i) The State agency will not fund program development andcoordinated <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities as a cost of supportive services for theadministrati<strong>on</strong> of area plans until it has first spent 10 percent of the total of itscombined allotments under Title III <strong>on</strong> the administrati<strong>on</strong> of area plans;(ii) State and area agencies <strong>on</strong> aging will, c<strong>on</strong>sistent withbudgeting cycles (annually, biannually, or otherwise), submit thedetails of proposals to pay for program development and coordinati<strong>on</strong> asa cost of supportive services, to the general public for review andcomment; and(<str<strong>on</strong>g>iii</str<strong>on</strong>g>) The State agency certifies that any such expenditure by anarea agency will have a direct and positive imp<str<strong>on</strong>g>act</str<strong>on</strong>g> <strong>on</strong> the enhancement ofservices for <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in the planning and service area.(15) The State agency will assure that where there is a significantpopulati<strong>on</strong> of <str<strong>on</strong>g>older</str<strong>on</strong>g> Indians in any planning and service area that thearea agency will provide for outreach as required by secti<strong>on</strong>306(a)(6)(N) of the Act.Sec. 1321.19 Amendments to the State plan.(a) A State shall amend the State plan whenever necessary toreflect:(1) New or revised Federal statutes or <str<strong>on</strong>g>regulati<strong>on</strong>s</str<strong>on</strong>g>,(2) A material change in any law, organizati<strong>on</strong>, policy or Stateagency operati<strong>on</strong>, or(3) Informati<strong>on</strong> required annually by secti<strong>on</strong>s 307(a) (23) and (29)of the Act.(b) Informati<strong>on</strong> required by paragraph (a)(3) of this secti<strong>on</strong> shallbe submitted according to guidelines prescribed by the Commissi<strong>on</strong>er.(c) If a State intends to amend provisi<strong>on</strong>s of its plan requiredunder Secs. 1321.17 (a) or (f), it shall submit its proposed amendment9


to the Commissi<strong>on</strong>er for approval. If the State changes any of theprovisi<strong>on</strong>s of its plan required under Sec. 1321.17 (b) through (d), itshall amend the plan and notify the Commissi<strong>on</strong>er. A State need <strong>on</strong>lysubmit the amended porti<strong>on</strong>s of the plan.Sec. 1321.21 Submissi<strong>on</strong> of the State plan or plan amendment to theCommissi<strong>on</strong>er for approval.Each State plan, or plan amendment which requires approval of theCommissi<strong>on</strong>er, shall be signed by the Governor or the Governor's designeeand submitted to the Commissi<strong>on</strong>er to be c<strong>on</strong>sidered for approval at least45 calendar days before the proposed effective date of the plan or planamendment.Sec. 1321.23 Notificati<strong>on</strong> of State plan or State plan amendmentapproval.(a) The Commissi<strong>on</strong>er approves a State plan or State plan amendmentby notifying the Governor or the Governor's designee in writing.(b) When the Commissi<strong>on</strong>er proposes to disapprove a State plan oramendment, the Commissi<strong>on</strong>er notifies the Governor in writing, giving thereas<strong>on</strong>s for the proposed disapproval, and informs the State agency thatit has 60 days to request a hearing <strong>on</strong> the proposed disapprovalfollowing the procedures specified in subpart E of this part.Sec. 1321.25 Restricti<strong>on</strong> of delegati<strong>on</strong> of authority to other agencies.A State or area agency may not delegate to another agency theauthority to award or administer funds under this part.Sec. 1321.27 Public participati<strong>on</strong>.The State agency shall have a mechanism to obtain and shall c<strong>on</strong>siderthe views of <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s and the public in developing andadministering the State plan.Sec. 1321.29 Designati<strong>on</strong> of planning and service areas.(a) Any unit of general purpose local government, regi<strong>on</strong> within aState recognized for area wide planning, metropolitan area, or Indianreservati<strong>on</strong> may make applicati<strong>on</strong> to the State agency to be designated asa planning and service area, in accordance with State agency procedures.(b) A State agency shall approve or disapprove any applicati<strong>on</strong>submitted under paragraph (a) of this secti<strong>on</strong>.(c) Any applicant under paragraph (a) of this secti<strong>on</strong> whoseapplicati<strong>on</strong> for designati<strong>on</strong> as a planning and service area is denied by10


a State agency may appeal the denial to the State agency, underprocedures specified by the State agency.(d) If the State denies an applicant for designati<strong>on</strong> as a planningand service area under paragraph (a) of this secti<strong>on</strong>, the State shallprovide a hearing <strong>on</strong> the denial of the applicati<strong>on</strong>, if requested by theapplicant, as well as issue a written decisi<strong>on</strong>.Sec. 1321.31 Appeal to Commissi<strong>on</strong>er.This secti<strong>on</strong> sets forth the procedures the Commissi<strong>on</strong>er follows forproviding hearings to applicants for designati<strong>on</strong> as a planning andservice area, under Sec. 1321.29(a), whose applicati<strong>on</strong> is denied by theState agency.(a) Any applicant for designati<strong>on</strong> as a planning and service areaunder Sec. 1321.29(a) whose applicati<strong>on</strong> is denied, and who has beenprovided a hearing and a written decisi<strong>on</strong> by the State agency, mayappeal the denial to the Commissi<strong>on</strong>er in writing within 30 daysfollowing receipt of a State's hearing decisi<strong>on</strong>.(b) The Commissi<strong>on</strong>er, or the Commissi<strong>on</strong>er's designee, holds ahearing, and issues a written decisi<strong>on</strong>, within 60 days following receiptof an applicant's written request to appeal the State agency hearingdecisi<strong>on</strong> to deny the applicant's request under Sec. 1321.29(a).(c) When the Commissi<strong>on</strong>er receives an appeal, the Commissi<strong>on</strong>errequests the State Agency to submit:(1) A copy of the applicant's applicati<strong>on</strong> for designati<strong>on</strong> as aplanning and service area;(2) A copy of the written decisi<strong>on</strong> of the State; and(3) Any other relevant informati<strong>on</strong> the Commissi<strong>on</strong>er may require.(d) The procedures for the appeal c<strong>on</strong>sist of:(1) Prior written notice to the applicant and the State agency ofthe date, time and locati<strong>on</strong> of the hearing;(2) The required attendance of the head of the State agency ordesignated representatives;(3) An opportunity for the applicant to be represented by counsel orother representative; and(4) An opportunity for the applicant to be heard in pers<strong>on</strong> and topresent documentary evidence.(e) The Commissi<strong>on</strong>er may:(1) Deny the appeal and uphold the decisi<strong>on</strong> of a State agency;(2) Uphold the appeal and require a State agency to designate theapplicant as a planning and service area; or(3) Take other appropriate <str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong>, including negotiating between theparties or remanding the appeal to the State agency after initialfindings.(f) The Commissi<strong>on</strong>er will uphold the decisi<strong>on</strong> of the State agency ifit followed the procedures specified in Sec. 1321.29, and the hearing11


decisi<strong>on</strong> is not manifestly inc<strong>on</strong>sistent with the purpose of this part.(g) The Commissi<strong>on</strong>er's decisi<strong>on</strong> to uphold the decisi<strong>on</strong> of a Stateagency does not extend bey<strong>on</strong>d the period of the approved State plan.Sec. 1321.33 Designati<strong>on</strong> of area agencies.An area agency may be any of the types of agencies under secti<strong>on</strong>305(c) of the Act. A State may not designate any regi<strong>on</strong>al or localoffice of the State as an area agency. However, when a new area agency<strong>on</strong> aging is designated, the State shall give right of first refusal to aunit of general purpose local government as required in secti<strong>on</strong>305(b)(5)(B) of the Act. If the unit of general purpose local governmentchooses not to exercise this right, the State shall then give preferenceto an established office <strong>on</strong> aging as required in secti<strong>on</strong> 305(c)(5) ofthe Act.Sec. 1321.35 Withdrawal of area agency designati<strong>on</strong>.(a) In carrying out secti<strong>on</strong> 305 of the Act, the State agency shallwithdraw the area agency designati<strong>on</strong> whenever it, after reas<strong>on</strong>ablenotice and opportunity for a hearing, finds that:(1) An area agency does not meet the requirements of this part;(2) An area plan or plan amendment is not approved;(3) There is substantial failure in the provisi<strong>on</strong>s or administrati<strong>on</strong>of an approved area plan to comply with any provisi<strong>on</strong> of the Act or ofthis part or policies and procedures established and published by theState agency <strong>on</strong> aging; or(4) Activities of the area agency are inc<strong>on</strong>sistent with thestatutory missi<strong>on</strong> prescribed in the Act or in c<strong>on</strong>flict with therequirement of the Act that it functi<strong>on</strong> <strong>on</strong>ly as an area agency <strong>on</strong> aging.(b) If a State agency withdraws an area agency's designati<strong>on</strong> underparagraph (a) of this secti<strong>on</strong> it shall:(1) Provide a plan for the c<strong>on</strong>tinuity of area agency functi<strong>on</strong>s andservices in the affected planning and service area; and(2) Designate a new area agency in the planning and service area ina timely manner.(c) If necessary to ensure c<strong>on</strong>tinuity of services in a planning andservice area, the State agency may, for a period of up to 180 days afterits final decisi<strong>on</strong> to withdraw designati<strong>on</strong> of an area agency:(1) Perform the resp<strong>on</strong>sibilities of the area agency; or(2) Assign the resp<strong>on</strong>sibilities of the area agency to another agencyin the planning and service area.(d) The Commissi<strong>on</strong>er may extend the 180-day period if a Stateagency:(1) Notifies the Commissi<strong>on</strong>er in writing of its <str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong> underparagraph (c) of this secti<strong>on</strong>;12


(2) Requests an extensi<strong>on</strong>; and(3) Dem<strong>on</strong>strates to the satisf<str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong> of the Commissi<strong>on</strong>er a need forthe extensi<strong>on</strong>.Sec. 1321.37 Intrastate funding formula.(a) The State agency, after c<strong>on</strong>sultati<strong>on</strong> with all area agencies inthe State, shall develop and use an intrastate funding formula for theallocati<strong>on</strong> of funds to area agencies under this part. The State agencyshall publish the formula for review and comment by <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s, otherappropriate agencies and organizati<strong>on</strong>s and the general public. Theformula shall reflect the proporti<strong>on</strong> am<strong>on</strong>g the planning and serviceareas of pers<strong>on</strong>s age 60 and over in greatest ec<strong>on</strong>omic or social needwith particular attenti<strong>on</strong> to low-income minority individuals. The Stateagency shall review and update its formula as often as a new State planis submitted for approval.(b) The intrastate funding formula shall provide for a separateallocati<strong>on</strong> of funds received under secti<strong>on</strong> 303(f) for preventive healthservices. In the award of such funds to selected planning and serviceareas, the State agency shall give priority to areas of the State:(1) Which are medically underserved; and(2) In which there are large numbers of individuals who have thegreatest ec<strong>on</strong>omic and social need for such services.(c) The State agency shall submit its intrastate formula to theCommissi<strong>on</strong>er for review and comment. The intrastate formula shall besubmitted separately from the State plan.Sec. 1321.41 Single State planning and service area.(a) The Commissi<strong>on</strong>er will approve the applicati<strong>on</strong> of a State whichwas, <strong>on</strong> or before October 1, 1980, a single planning and service area,to c<strong>on</strong>tinue as a single planning and service area if the State agencydem<strong>on</strong>strates that:(1) The State is not already divided for purposes of planning andadministering human services; or(2) The State is so small or rural that the purposes of this partwould be impeded if the State were divided into planning and servicesareas; and(3) The State agency has the capacity to carry out theresp<strong>on</strong>sibilities of an area agency, as specified in the Act.(b) Prior to the Commissi<strong>on</strong>er's approval for a State to c<strong>on</strong>tinue asa single planning and service area, all the requirements and proceduresin Sec. 1321.29 shall be met.(c) If the Commissi<strong>on</strong>er approves a State's applicati<strong>on</strong> underparagraph (a) this secti<strong>on</strong>:(1) The Commissi<strong>on</strong>er notifies the State agency to develop a single13


State planning and service area plan which meets the requirements ofsecti<strong>on</strong> 306 and 307 of the Act.(2) A State agency shall meet all the State and area agency functi<strong>on</strong>requirements specified in the Act.(d) If the Commissi<strong>on</strong>er denies the applicati<strong>on</strong> because a State failsto meet the criteria or requirements set forth in paragraphs (a) or (b)of this secti<strong>on</strong>, the Commissi<strong>on</strong>er notifies the State that it shallfollow procedures in secti<strong>on</strong> 305(A)(1)(E) of the Act to divide the Stateinto planning and service areas.Sec. 1321.43 Interstate planning and service area.(a) Before requesting permissi<strong>on</strong> of the Commissi<strong>on</strong>er to designate aninterstate planning and service area, the Governor of each State shallexecute a written agreement that specifies the State agency proposed tohave lead resp<strong>on</strong>sibility for administering the programs within theinterstate planning and service area and lists the c<strong>on</strong>diti<strong>on</strong>s, agreedup<strong>on</strong> by each State, governing the administrati<strong>on</strong> of the interstateplanning and service area.(b) The lead State shall request permissi<strong>on</strong> of the Commissi<strong>on</strong>er todesignate an interstate planning and service area.(c) The lead State shall submit the request together with a copy ofthe agreement as part of its State plan or as an amendment to its Stateplan.(d) Prior to the Commissi<strong>on</strong>er's approval for States to designate aninterstate planning and service area, the Commissi<strong>on</strong>er shall determinethat all applicable requirements and procedures in Sec. 1321.29 andSec. 1321.33 of this part, shall be met.(e) If the request is approved, the Commissi<strong>on</strong>er, based <strong>on</strong> theagreement between the States, increases the allotment of the State withlead resp<strong>on</strong>sibility for administering the programs within the interstatearea and reduces the allotment(s) of the State(s) without leadresp<strong>on</strong>sibility by <strong>on</strong>e of these methods:(1) Re-allotment of funds in proporti<strong>on</strong> to the number of individualsage 60 and over for that porti<strong>on</strong> of the interstate planning and servicearea located in the State without lead resp<strong>on</strong>sibility; or(2) Re-allotment of funds based <strong>on</strong> the intrastate funding formula ofthe State(s) without lead resp<strong>on</strong>sibility.Sec. 1321.45 Transfer between c<strong>on</strong>gregate and home-delivered nutriti<strong>on</strong>service allotments.(a) A State agency, without the approval of the Commissi<strong>on</strong>er, maytransfer between allotments up to 30 percent of a State's separateallotments for c<strong>on</strong>gregate and home-delivered nutriti<strong>on</strong> services.(b) A State agency may apply to the Commissi<strong>on</strong>er to transfer from14


<strong>on</strong>e allotment to the other a porti<strong>on</strong> exceeding 30 percent of a State'sseparate allotments for c<strong>on</strong>gregate and home-delivered nutriti<strong>on</strong>services. A State agency desiring such a transfer of allotment shall:(1) Specify the percent which it proposes to transfer from <strong>on</strong>eallotment to the other;(2) Specify whether the proposed transfer is for the entire periodof a State plan or a porti<strong>on</strong> of a plan period; and(3) Specify the purpose of the proposed transfer.Sec. 1321.47 Statewide n<strong>on</strong>-Federal share requirements.The statewide n<strong>on</strong>-Federal share for State or area planadministrati<strong>on</strong> shall not be less than 25 percent of the funds usedunder this part. All services statewide, including ombudsman servicesand services funded under Title III-B, C, D, E and F, shall be funded <strong>on</strong>a statewide basis with a n<strong>on</strong>-Federal share of not less than 15 percent.Matching requirements for individual area agencies are determined by theState agency.Sec. 1321.49 State agency maintenance of effort.In order to avoid a penalty, each fiscal year the State agency, tomeet the required n<strong>on</strong>-federal share applicable to its allotments underthis part, shall spend under the State plan for both services andadministrati<strong>on</strong> at least the average amount of State funds it spent underthe plan for the three previous fiscal years. If the State agency spendsless than this amount, the Commissi<strong>on</strong>er reduces the State's allotmentsfor supportive and nutriti<strong>on</strong> services under this part by a percentageequal to the percentage by which the State reduced its expenditures.Sec. 1321.51 C<strong>on</strong>fidentiality and disclosure of informati<strong>on</strong>.(a) A State agency shall have procedures to protect thec<strong>on</strong>fidentiality of informati<strong>on</strong> about <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s collected in thec<strong>on</strong>duct of its resp<strong>on</strong>sibilities. The procedures shall ensure that noinformati<strong>on</strong> about an order pers<strong>on</strong>, or obtained from an <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong> by aservice provider or the State or area agencies, is disclosed by the provider oragency in a form that identifies the pers<strong>on</strong> without the informed c<strong>on</strong>sent of thepers<strong>on</strong> or of his or her legal representative, unless the disclosure is required bycourt order, or for program m<strong>on</strong>itoring by authorized Federal, State, orlocal m<strong>on</strong>itoring agencies.(b) A State agency is not required to disclose those types ofinformati<strong>on</strong> or documents that are exempt from disclosure by a Federalagency under the Federal Freedom of Informati<strong>on</strong> Act, 5 U.S.C. 552.15


(c) A State or area agency <strong>on</strong> aging may not require a provider oflegal assistance under this part to reveal any informati<strong>on</strong> that isprotected by attorney client privilege.Sec. 1321.52 Evaluati<strong>on</strong> of unmet need.Each State shall submit objectively collected and statisticallyvalid data with evaluative c<strong>on</strong>clusi<strong>on</strong>s c<strong>on</strong>cerning the unmet need forsupportive services, nutriti<strong>on</strong> services, and multipurpose senior centersgathered pursuant to secti<strong>on</strong> 307(a)(3)(A) of the Act to theCommissi<strong>on</strong>er. The evaluati<strong>on</strong>s for each State shall c<strong>on</strong>sider all servicesin these categories regardless of the source of funding for theservices. This informati<strong>on</strong> shall be submitted not later than June 30,1989 and shall c<strong>on</strong>form to guidance issued by the Commissi<strong>on</strong>er.Subpart C--Area Agency Resp<strong>on</strong>sibilitiesSec. 1321.53 Missi<strong>on</strong> of the area agency.(a) The Older Americans Act intends that the area agency <strong>on</strong> agingshall be the leader relative to all aging issues <strong>on</strong> behalf of all <str<strong>on</strong>g>older</str<strong>on</strong>g>pers<strong>on</strong>s in the planning and service area. This means that the areaagency shall pro<str<strong>on</strong>g>act</str<strong>on</strong>g>ively carry out, under the leadership and directi<strong>on</strong>of the State agency, a wide range of functi<strong>on</strong>s related to advocacy,planning, coordinati<strong>on</strong>, inter-agency linkages, informati<strong>on</strong> sharing,brokering, m<strong>on</strong>itoring and evaluati<strong>on</strong>, designed to lead to thedevelopment or enhancement of comprehensive and coordinated communitybased systems in, or serving, each community in the planning and servicearea. These systems shall be designed to assist <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in leadingindependent, meaningful and dignified lives in their own homes andcommunities as l<strong>on</strong>g as possible.(b) A comprehensive and coordinated community based system describedin paragraph (a) of this secti<strong>on</strong> shall:(1) Have a visible focal point of c<strong>on</strong>t<str<strong>on</strong>g>act</str<strong>on</strong>g> where any<strong>on</strong>e can go orcall for help, informati<strong>on</strong> or referral <strong>on</strong> any aging issue;(2) Provide a range of opti<strong>on</strong>s:(3) Assure that these opti<strong>on</strong>s are readily accessible to all <str<strong>on</strong>g>older</str<strong>on</strong>g>pers<strong>on</strong>s: The independent, semi-dependent and totally dependent, nomatter what their income;(4) Include a commitment of public, private, voluntary and pers<strong>on</strong>alresources committed to supporting the system;(5) Involve collaborative decisi<strong>on</strong>-making am<strong>on</strong>g public, private,voluntary, religious and fraternal organizati<strong>on</strong>s and <str<strong>on</strong>g>older</str<strong>on</strong>g> people in thecommunity;(6) Offer special help or targeted resources for the mostvulnerable <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s, those in danger of losing their independence;16


(7) Provide effective referral from agency to agency to assure thatinformati<strong>on</strong> or assistance is received, no matter how or where c<strong>on</strong>t<str<strong>on</strong>g>act</str<strong>on</strong>g> ismade in the community;(8) Evidence sufficient flexibility to resp<strong>on</strong>d with appropriateindividualized assistance, especially for the vulnerable <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>;(9) Have a unique char<str<strong>on</strong>g>act</str<strong>on</strong>g>er which is tailored to the specific natureof the community;(10) Be directed by leaders in the community who have the respect,capacity and authority necessary to c<strong>on</strong>vene all interested pers<strong>on</strong>s,assess needs, design soluti<strong>on</strong>s, track overall success, stimulate changeand plan community resp<strong>on</strong>ses for the present and for the future.(c) The resources made available to the area agency <strong>on</strong> aging underthe Older Americans Act are to be used to finance those <str<strong>on</strong>g>act</str<strong>on</strong>g>ivitiesnecessary to achieve elements of a community based system set forth inparagraph (b) of this secti<strong>on</strong>. For the purpose of assuring access toinformati<strong>on</strong> and services for <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s, the area agency shall work withelected community officials in the planning and service area to designate <strong>on</strong>e ormore focal points <strong>on</strong> aging in each community, as appropriate. The area agencyshall list designated focal points in the area plan. It shall be the resp<strong>on</strong>sibility ofthe area agency, with the approval of the State agency, to define ``community''for the purposes of this secti<strong>on</strong>. Since the Older Americans Act defines focalpoint as a ``facility'' established to encourage the maximum collocati<strong>on</strong>and coordinati<strong>on</strong> of services for <str<strong>on</strong>g>older</str<strong>on</strong>g> individuals, specialc<strong>on</strong>siderati<strong>on</strong> shall be given to developing and/or designating multipurposesenior centers as community focal points <strong>on</strong> aging. The areaagency <strong>on</strong> aging shall assure that services financed under the OlderAmericans Act in, or <strong>on</strong> behalf of, the community will be either basedat, linked to or coordinated with the focal points designated. The areaagency <strong>on</strong> aging shall assure access from the designated focal points toservices financed under the Older Americans Act. The area agency <strong>on</strong>aging shall work with, or work to assure that community leadership workswith, other applicable agencies and instituti<strong>on</strong>s in the community toachieve maximum collocati<strong>on</strong> at, coordinati<strong>on</strong> with or access to otherservices and opportunities for the elderly from the designated communityfocal points. The area agency may not engage in any <str<strong>on</strong>g>act</str<strong>on</strong>g>ivity which isinc<strong>on</strong>sistent with its statutory missi<strong>on</strong> prescribed in the Act orpolicies prescribed by the State under Sec. 1321.11.Sec. 1321.55 Organizati<strong>on</strong> and staffing of the area agency.(a) An area agency may be either:(1) An agency whose single purpose is to administer programs for<str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s; or(2) A separate organizati<strong>on</strong>al unit within a multi-purpose agencywhich functi<strong>on</strong>s <strong>on</strong>ly for purposes of serving as the area agency <strong>on</strong>aging. Where the State agency <strong>on</strong> aging designates, as an area agency <strong>on</strong>17


aging, a separate organizati<strong>on</strong>al unit of a multipurpose agency which hasbeen serving as an area agency, the State agency <str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong> shall not besubject to secti<strong>on</strong> 305(b)(5)(B) of the Act.(b) The area agency, <strong>on</strong>ce designated, is resp<strong>on</strong>sible for providingfor adequate and qualified staff to perform all of the functi<strong>on</strong>sprescribed in this part.(c) The designated area agency c<strong>on</strong>tinues to functi<strong>on</strong> in thatcapacity until either:(1) The area agency informs the State agency that it no l<strong>on</strong>gerwishes to carry out the resp<strong>on</strong>sibilities of an area agency; or(2) The State agency withdraws the designati<strong>on</strong> of the area agency asprovided in Sec. 1321.35.Sec. 1321.57 Area agency advisory council.(a) Functi<strong>on</strong>s of council. The area agency shall establish anadvisory council. The council shall carry out advisory functi<strong>on</strong>s whichfurther the area agency's missi<strong>on</strong> of developing and coordinatingcommunity-based systems of services for all <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in theplanning and service area. The council shall advise the agency relativeto:(1) Developing and administering the area plan;(2) C<strong>on</strong>ducting public hearings;(3) Representing the interest of <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s; and(4) Reviewing and commenting <strong>on</strong> all community policies, programs and<str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong>s which affect <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s with the intent of assuring maximumcoordinati<strong>on</strong> and resp<strong>on</strong>siveness to <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s.(b) Compositi<strong>on</strong> of council. The council shall include individualsand representatives of community organizati<strong>on</strong>s who will help to enhancethe leadership role of the area agency in developing community-basedsystems of services. The advisory council shall be made up of:(1) More than 50 percent <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s, including minorityindividuals who are participants or who are eligible to participate inprograms under this part;(2) Representatives of <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s;(3) Representatives of health care provider organizati<strong>on</strong>s, includingproviders of veterans' health care (if appropriate);(4) Representatives of supportive services providers organizati<strong>on</strong>s;(5) Pers<strong>on</strong>s with leadership experience in the private and voluntarysectors;(6) Local elected officials; and(7) The general public.(c) Review by advisory council. The area agency shall submit thearea plan and amendments for review and comment to the advisory councilbefore it is transmitted to the State agency for approval.18


Sec. 1321.59 Submissi<strong>on</strong> of an area plan and plan amendments to theState for approval.The area agency shall submit the area plan and amendments to theState agency for approval following procedures specified by the Stateagency in the State policies prescribed by Sec. 1321.11.Sec. 1321.61 Advocacy resp<strong>on</strong>sibilities of the area agency.(a) The area agency shall serve as the public advocate for thedevelopment or enhancement of comprehensive and coordinated communitybasedsystems of services in each community throughout the planning andservice area.(b) In carrying out this resp<strong>on</strong>sibility, the area agency shall:(1) M<strong>on</strong>itor, evaluate, and, where appropriate, comment <strong>on</strong> allpolicies, programs, hearings, levies, and community <str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong>s which affect<str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s;(2) Solicit comments from the public <strong>on</strong> the needs of <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s;(3) Represent the interests of <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s to local level andexecutive branch officials, public and private agencies ororganizati<strong>on</strong>s;(4) C<strong>on</strong>sult with and support the State's l<strong>on</strong>g-term care ombudsmanprogram; and(5) Undertake <strong>on</strong> a regular basis <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities designed to facilitatethe coordinati<strong>on</strong> of plans and <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities with all other public andprivate organizati<strong>on</strong>s, including units of general purpose localgovernment, with resp<strong>on</strong>sibilities affecting <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in theplanning and service area to promote new or expanded benefits andopportunities for <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s; and(c) Each area agency <strong>on</strong> aging shall undertake a leadership role inassisting communities throughout the planning and service area to targetresources from all appropriate sources to meet the needs of <str<strong>on</strong>g>older</str<strong>on</strong>g>pers<strong>on</strong>s with greatest ec<strong>on</strong>omic or social need, with particular attenti<strong>on</strong>to low income minority individuals. Such <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities may include locati<strong>on</strong>of services and specializati<strong>on</strong> in the types of services must needed bythese groups to meet this requirement. However, the area agency may notpermit a grantee or c<strong>on</strong>tr<str<strong>on</strong>g>act</str<strong>on</strong>g>or under this part to employ a means testfor services funded under this part.(d) No requirement in this secti<strong>on</strong> shall be deemed to supersede aprohibiti<strong>on</strong> c<strong>on</strong>tained in the Federal appropriati<strong>on</strong> <strong>on</strong> the use of Federalfunds to lobby the C<strong>on</strong>gress; or the lobbying provisi<strong>on</strong> applicable toprivate n<strong>on</strong>profit agencies and organizati<strong>on</strong>s c<strong>on</strong>tained in OMB CircularA-122.19


Subpart D--Service RequirementsSec. 1321.63 Purpose of services allotments under Title III.(a) Title III of the Older Americans Act authorizes the distributi<strong>on</strong>of Federal funds to the State agency <strong>on</strong> aging by formula for thefollowing categories of services:(1) Supportive services;(2) C<strong>on</strong>gregate meals services;(3) Home delivered meals services;(4) In-home services;(5) Ombudsman services;(6) Special needs services;(7) Elder abuse services;(8) Preventive health services; and(9) Outreach services.Funds authorized under these categories are for the purpose of assistingthe State and its area agencies to develop or enhance for <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>scomprehensive and coordinated community based systems as described inSec. 1321.53(b) throughout the State.(b) Except for ombudsman services, State agencies <strong>on</strong> aging willaward the funds made available under paragraph (a) of this secti<strong>on</strong> todesignated area agencies <strong>on</strong> aging according to the formula determined bythe State agency. Except where a waiver is granted by the State agency,area agencies shall award these funds by grant or c<strong>on</strong>tr<str<strong>on</strong>g>act</str<strong>on</strong>g> to communityservices provider agencies and organizati<strong>on</strong>s. All funds awarded to areaagencies under this part are for the purpose of assisting area agenciesto develop or enhance comprehensive and coordinated community basedsystems for <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in, or serving, communities throughout the planningand service area.Sec. 1321.65 Resp<strong>on</strong>sibilities of service providers under area plans.As a c<strong>on</strong>diti<strong>on</strong> for receipt of funds under this part, each areaagency <strong>on</strong> aging shall assure that providers of services shall:(a) Provide the area agency, in a timely manner, with statisticaland other informati<strong>on</strong> which the area agency requires in order to meetits planning, coordinati<strong>on</strong>, evaluati<strong>on</strong> and reporting requirementsestablished by the State under Sec. 1321.13;(b) Specify how the provider intends to satisfy the service needs oflow-income minority individuals in the area served, including attemptingto provide services to low-income minority individuals at least inproporti<strong>on</strong> to the number of low-income minority <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in thepopulati<strong>on</strong> serviced by the provider;20


(c) Provide recipients with an opportunity to c<strong>on</strong>tribute to the costof the service as provided in Sec. 1321.67;(d) With the c<strong>on</strong>sent of the <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>, or his or herrepresentative, bring to the attenti<strong>on</strong> of appropriate officials forfollow-up, c<strong>on</strong>diti<strong>on</strong>s or circumstances which place the <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>, orthe household of the <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>, in imminent danger;(e) Where feasible and appropriate, make arrangements for theavailability of services to <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in weather relatedemergencies;(f) Assist participants in taking advantage of benefits under otherprograms; and(g) Assure that all services funded under this part are coordinatedwith other appropriate services in the community, and that theseservices do not c<strong>on</strong>stitute an unnecessary duplicati<strong>on</strong> of servicesprovided by other sources.Sec. 1321.67 Service c<strong>on</strong>tributi<strong>on</strong>s.(a) For services rendered with funding under the Older AmericansAct, the area agency <strong>on</strong> aging shall assure that each service providershall:(1) Provide each <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong> with an opportunity to voluntarilyc<strong>on</strong>tribute to the cost of the service;(2) Protect the privacy of each <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong> with respect to his orher c<strong>on</strong>tributi<strong>on</strong>s; and(3) Establish appropriate procedures to safeguard and account forall c<strong>on</strong>tributi<strong>on</strong>s.(b) Each service provider shall use supportive services andnutriti<strong>on</strong> services c<strong>on</strong>tributi<strong>on</strong>s to expand supportive services andnutriti<strong>on</strong> services respectively. To that end, the State agency shall:(1) Permit service providers to follow either the additi<strong>on</strong>alternative or the cost sharing alternatives as stated in 45 CFR92.25(g) (2) and (3); or(2) A combinati<strong>on</strong> of the two alternatives.(c) Each service provider under the Older Americans Act may developa suggested c<strong>on</strong>tributi<strong>on</strong> schedule for services provided under this part.In developing a c<strong>on</strong>tributi<strong>on</strong> schedule, the provider shall c<strong>on</strong>sider theincome ranges of <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in the community and the provider's othersources of income. However, means tests may not be used for any servicesupported with funds under this part. State agencies, in developingState eligibility criteria for in-home services under secti<strong>on</strong> 343 of theAct, may not include a means test as an eligibility criteri<strong>on</strong>.(d) A service provider that receives funds under this part may notdeny any <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong> a service because the <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong> will not orcannot c<strong>on</strong>tribute to the cost of the service.21


Sec. 1321.69 Service priority for frail, homebound or isolated elderly.(a) Pers<strong>on</strong>s age 60 or over who are frail, homebound by reas<strong>on</strong> ofillness or incapacitating disability, or otherwise isolated, shall begiven priority in the delivery of services under this part.(b) The spouse of the <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>, regardless of age or c<strong>on</strong>diti<strong>on</strong>,may receive a home-delivered meal if, according to criteria determinedby the area agency, receipt of the meal is in the best interest of thehomebound <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>.Sec. 1321.71 Legal assistance.(a) The provisi<strong>on</strong>s and restricti<strong>on</strong>s in this secti<strong>on</strong> apply <strong>on</strong>ly tolegal assistance providers and <strong>on</strong>ly if they are providing legalassistance under secti<strong>on</strong> 307(a)(15) of the Act.(b) Nothing in this secti<strong>on</strong> is intended to prohibit any attorneyfrom providing any form of legal assistance to an eligible client, or tointerfere with the fulfillment of any attorney's professi<strong>on</strong>alresp<strong>on</strong>sibilities to a client.(c) The area agency shall award funds to the legal assistanceprovider(s) that most fully meet the standards in this subsecti<strong>on</strong>. Thelegal assistance provider(s) shall:(1) Have staff with expertise in specific areas of law affecting<str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s in ec<strong>on</strong>omic or social need, for example, public benefits,instituti<strong>on</strong>alizati<strong>on</strong> and alternatives to instituti<strong>on</strong>alizati<strong>on</strong>;(2) Dem<strong>on</strong>strate the capacity to provide effective administrative andjudicial representati<strong>on</strong> in the areas of law affecting <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s withec<strong>on</strong>omic or social need;(3) Dem<strong>on</strong>strate the capacity to provide support to other advocacyefforts, for example, the l<strong>on</strong>g-term care ombudsman program;(4) Dem<strong>on</strong>strate the capacity to provide legal services toinstituti<strong>on</strong>alized, isolated, and homebound <str<strong>on</strong>g>older</str<strong>on</strong>g> individualseffectively; and(5) Dem<strong>on</strong>strate the capacity to provide legal assistance in theprincipal language spoken by clients in areas where a significant numberof clients do not speak English as their principal language.(d) A legal assistance provider may not require an <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong> todisclose informati<strong>on</strong> about income or resources as a c<strong>on</strong>diti<strong>on</strong> forproviding legal assistance under this part.(e) A legal assistance provider may ask about the pers<strong>on</strong>'s financialcircumstances as a part of the process of providing legal advice,counseling and representati<strong>on</strong>, or for the purpose of identifyingadditi<strong>on</strong>al resources and benefits for which an <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong> may beeligible.(f) A legal assistance provider and its attorneys may engage inother legal <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities to the extent that there is no c<strong>on</strong>flict of22


interest nor other interference with their professi<strong>on</strong>al resp<strong>on</strong>sibilitiesunder this Act.(g) No provider shall use funds received under the Act to providelegal assistance in a fee generating case unless other adequaterepresentati<strong>on</strong> is unavailable or there is an emergency requiringimmediate legal <str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong>. All providers shall establish procedures for thereferral of fee generating cases.(1) ``Fee generating case'' means any case or matter which, ifundertaken <strong>on</strong> behalf of an eligible client by an attorney in privatepr<str<strong>on</strong>g>act</str<strong>on</strong>g>ice, reas<strong>on</strong>ably may be expected to result in a fee for legalservices from an award to a client, from public funds, or from theopposing party.(2) Other adequate representati<strong>on</strong> is deemed to be unavailable when:(i) Recovery of damages is not the principal object of the client; or(ii) A court appoints a provider or an employee of a providerpursuant to a statute or a court rule or pr<str<strong>on</strong>g>act</str<strong>on</strong>g>ice of equal applicabilityto all attorneys in the jurisdicti<strong>on</strong>; or(<str<strong>on</strong>g>iii</str<strong>on</strong>g>) An eligible client is seeking benefits under <str<strong>on</strong>g>title</str<strong>on</strong>g> II of theSocial Security Act, 42 U.S.C. 401, et seq., Federal Old Age, Survivors,and Disability Insurance Benefits; or <str<strong>on</strong>g>title</str<strong>on</strong>g> XVI of the Social SecurityAct, 42 U.S.C. 1381, et seq., Supplemental Security Income for Aged,Blind, and Disabled.(3) A provider may seek and accept a fee awarded or approved by acourt or administrative body, or included in a settlement.(4) When a case or matter accepted in accordance with this secti<strong>on</strong>results in a recovery of damages, other than statutory benefits, aprovider may accept reimbursement for out-of-pocket costs and expensesincurred in c<strong>on</strong>necti<strong>on</strong> with the case or matter.(h) A provider, employee of the provider, or staff attorney shallnot engage in the following prohibited political <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities:(1) No provider or its employees shall c<strong>on</strong>tribute or make availableOlder Americans Act funds, pers<strong>on</strong>nel or equipment to any political partyor associati<strong>on</strong> or to the campaign of any candidate for public or partyoffice; or for use in advocating or opposing any ballot measure,initiative, or referendum;(2) No provider or its employees shall intenti<strong>on</strong>ally identify the<str<strong>on</strong>g>title</str<strong>on</strong>g> III program or provider with any partisan or n<strong>on</strong>partisan political<str<strong>on</strong>g>act</str<strong>on</strong>g>ivity, or with the campaign of any candidate for public or partyoffice;(3) While engaged in legal assistance <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities supported under theAct, no attorney shall engage in any political <str<strong>on</strong>g>act</str<strong>on</strong>g>ivity;(i) No funds made available under the Act shall be used for lobbying<str<strong>on</strong>g>act</str<strong>on</strong>g>ivities, including but not limited to any <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities intended toinfluence any decisi<strong>on</strong> or <str<strong>on</strong>g>act</str<strong>on</strong>g>ivity by any n<strong>on</strong>-judicial Federal, State orlocal individual or body. Nothing in this secti<strong>on</strong> is intended toprohibit an employee from:23


(1) Communicating with a governmental agency for the purpose ofobtaining informati<strong>on</strong>, clarificati<strong>on</strong>, or interpretati<strong>on</strong> of the agency'srules, <str<strong>on</strong>g>regulati<strong>on</strong>s</str<strong>on</strong>g>, pr<str<strong>on</strong>g>act</str<strong>on</strong>g>ices, or policies;(2) Informing a client about a new or proposed statute, executiveorder, or administrative regulati<strong>on</strong>;(3) Resp<strong>on</strong>ding to an individual client's request for advice <strong>on</strong>lywith respect to the client's own communicati<strong>on</strong>s to officials unlessotherwise prohibited by the Older Americans Act, <str<strong>on</strong>g>title</str<strong>on</strong>g> III <str<strong>on</strong>g>regulati<strong>on</strong>s</str<strong>on</strong>g>or other applicable law. This provisi<strong>on</strong> does not authorize publicati<strong>on</strong>of lobbying materials or training of clients <strong>on</strong> lobbying techniques orthe compositi<strong>on</strong> of a communicati<strong>on</strong> for the client's use; or(4) Making direct c<strong>on</strong>t<str<strong>on</strong>g>act</str<strong>on</strong>g> with the area agency for any purpose;(5) Providing a client with administrative representati<strong>on</strong> inadjudicatory or rulemaking proceedings or negotiati<strong>on</strong>s, directlyaffecting that client's legal rights in a particular case, claim orapplicati<strong>on</strong>;(6) Communicating with an elected official for the sole purpose ofbringing a client's legal problem to the attenti<strong>on</strong> of that official; or(7) Resp<strong>on</strong>ding to the request of a public official or body fortestim<strong>on</strong>y, legal advice or other statements <strong>on</strong> legislati<strong>on</strong> or otherissues related to aging; provided that no such <str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong> will be takenwithout first obtaining the written approval of the resp<strong>on</strong>sible areaagency.(j) While carrying out legal assistance <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities and while usingresources provided under the Act, no provider or its employees shall:(1) Participate in any public dem<strong>on</strong>strati<strong>on</strong>, picketing, boycott, orstrike, except as permitted by law in c<strong>on</strong>necti<strong>on</strong> with the employee's ownemployment situati<strong>on</strong>;(2) Encourage, direct, or coerce others to engage in such<str<strong>on</strong>g>act</str<strong>on</strong>g>ivities; or(3) At any time engage in or encourage others to engage in:(i) Any illegal <str<strong>on</strong>g>act</str<strong>on</strong>g>ivity; or(ii) Any intenti<strong>on</strong>al identificati<strong>on</strong> of programs funded under the Actor recipient with any political <str<strong>on</strong>g>act</str<strong>on</strong>g>ivity.(k) N<strong>on</strong>e of the funds made available under the Act may be used topay dues exceeding $100 per recipient per annum to any organizati<strong>on</strong>(other than a bar associati<strong>on</strong>), a purpose or functi<strong>on</strong> of which is toengage in <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities prohibited under these <str<strong>on</strong>g>regulati<strong>on</strong>s</str<strong>on</strong>g> unless such duesare not used to engage in <str<strong>on</strong>g>act</str<strong>on</strong>g>ivities for which Older Americans Act fundscannot be used directly.Sec. 1321.73 Grant related income under Title III-C.States and sub-grantees must require that their subgrantees' grantrelated income be used in either the matching or cost sharingalternative in 45 CFR 92.25(g)(2) or the additive alternative in24


Sec. 92.25(g)(3) or a combinati<strong>on</strong> of the two. The deductive alternativedescribed in Sec. 92.25(g)(1) is not permitted.Sec. 1321.75 Licenses and safety.The State shall ensure:(a) That, in making awards for multipurpose senior center<str<strong>on</strong>g>act</str<strong>on</strong>g>ivities, the area agency will ensure that the facility complies withall applicable State and local health, fire, safety, building, z<strong>on</strong>ingand sanitati<strong>on</strong> laws, ordinances or codes; and(b) The technical adequacy of any proposed alterati<strong>on</strong> or renovati<strong>on</strong>of a multipurpose senior center assisted under this part, by requiringthat any alterati<strong>on</strong> or renovati<strong>on</strong> of a multipurpose senior center thataffects the load bearing members of the facility is structurally soundand complies with all applicable local or State ordinances, laws, orbuilding codes.Subpart E--Hearing Procedures for State AgenciesSec. 1321.77 Scope.(a) Hearing procedures for State plan disapproval, as provided forin secti<strong>on</strong> 307(c) and secti<strong>on</strong> 307(d) of the Act are subject to theprevisi<strong>on</strong>s of 45 CFR part 213 with the following excepti<strong>on</strong>s:(1) Secti<strong>on</strong> 213.1(a); Sec. 213.32(d); and Sec. 213.33 do not apply.(2) Reference to SRS Hearing Clerk shall be read to mean HHS HearingClerk.(3) References to Administrator shall be read to mean Commissi<strong>on</strong>er<strong>on</strong> <strong>Aging</strong>.(b) Instead of the scope described in Sec. 213.1(a), this subpartgoverns the procedures and opportunity for a hearing <strong>on</strong>:(1) Disapproval of a State plan or amendment:(2) Determinati<strong>on</strong> that a State agency does not meet the requirementsof this part:(3) Determinati<strong>on</strong> that there is a failure in the provisi<strong>on</strong>s or theadministrati<strong>on</strong> of an approved plan to comply substantially with Federalrequirements, including failure to comply with any assurance requiredunder the Act or under this part.Sec. 1321.79 When a decisi<strong>on</strong> is effective.(a) The Commissi<strong>on</strong>er's decisi<strong>on</strong> specifies the effective date forAoA's reducti<strong>on</strong> and withholding of the State's grant. This effectivedate may not be earlier than the date of the Commissi<strong>on</strong>er's decisi<strong>on</strong> orlater than the first day of the next calendar quarter.(b) The decisi<strong>on</strong> remains in effect unless reversed or stayed <strong>on</strong>25


judicial appeal, or until the agency or the plan is changed to meet allFederal requirements, except that the Commissi<strong>on</strong>er may modify or setaside his or her decisi<strong>on</strong> before the record of the proceedings underthis subpart is filed in court.Sec. 1321.81 How the State may appeal.A State may appeal the final decisi<strong>on</strong> of the Commissi<strong>on</strong>erdisapproving the State plan or plan amendment, finding of n<strong>on</strong>compliance,or finding that a State agency does not meet the requirements of thispart to the U.S. Court of Appeals for the circuit in which the State islocated. The State shall file the appeal within 30 days of theCommissi<strong>on</strong>er's final decisi<strong>on</strong>.Sec. 1321.83 How the Commissi<strong>on</strong>er may re-allot the State's withheldpayments.The Commissi<strong>on</strong>er disburses funds withheld from the State directly toany public or n<strong>on</strong>profit private organizati<strong>on</strong> or agency, or politicalsubdivisi<strong>on</strong> of the State that has the authority and capacity to carryout the functi<strong>on</strong>s of the State agency and submits a State plan whichmeets the requirements of this part and which c<strong>on</strong>tains an agreement tomeet the n<strong>on</strong>-federal share requirements.26
