complainant or resident of a l<strong>on</strong>g term care facility as prescribed insecti<strong>on</strong> 307(a)(12) of the Act shall be strictly adhered to.Sec. 1321.13 Advocacy resp<strong>on</strong>sibilities.(a) The State agency shall:(1) Review, m<strong>on</strong>itor, evaluate and comment <strong>on</strong> Federal, State andlocal plans, budgets, <str<strong>on</strong>g>regulati<strong>on</strong>s</str<strong>on</strong>g>, programs, laws, levies, hearings,policies, and <str<strong>on</strong>g>act</str<strong>on</strong>g>i<strong>on</strong>s which affect or may affect <str<strong>on</strong>g>older</str<strong>on</strong>g> individuals andrecommend any changes in these which the State agency c<strong>on</strong>siders to beappropriate;(2) Provide technical assistance to agencies, organizati<strong>on</strong>s,associati<strong>on</strong>s, or individuals representing <str<strong>on</strong>g>older</str<strong>on</strong>g> pers<strong>on</strong>s; and(3) Review and comment, up<strong>on</strong> request, <strong>on</strong> applicati<strong>on</strong>s to State andFederal agencies for assistance relating to meeting the needs of <str<strong>on</strong>g>older</str<strong>on</strong>g>pers<strong>on</strong>s.(b) No requirement in this secti<strong>on</strong> shall be deemed to supersede aprohibiti<strong>on</strong> c<strong>on</strong>tained in a Federal appropriati<strong>on</strong> <strong>on</strong> the use of Federalfunds to lobby the C<strong>on</strong>gress.Sec. 1321.15 Durati<strong>on</strong>, format and effective date of the State plan.(a) A State may use its own judgment as to the format to use for theplan, how to collect informati<strong>on</strong> for the plan, and whether the plan willremain in effect for two, three or four years.(b) An approved State plan or amendment, as identified inSec. 1321.17, becomes effective <strong>on</strong> the date designated by theCommissi<strong>on</strong>er.(c) A State agency may not make expenditures under a new plan oramendment requiring approval, as identified in Sec. 1321.17 andSec. 1321.19, until it is approved.Sec. 1321.17 C<strong>on</strong>tent of State plan.To receive a grant under this part, a State shall have an approvedState plan as prescribed in secti<strong>on</strong> 307 of the Act. In additi<strong>on</strong> tomeeting the requirements of secti<strong>on</strong> 307, a State plan shall include:(a) Identificati<strong>on</strong> by the State of the sole State agency that hasbeen designated to develop and administer the plan.(b) Statewide program objectives to implement the requirements underTitle III of the Act and any objectives established by the Commissi<strong>on</strong>erthrough the rulemaking process.(c) A resource allocati<strong>on</strong> plan indicating the proposed use of all<str<strong>on</strong>g>title</str<strong>on</strong>g> III funds administered by a State agency, and the distributi<strong>on</strong> of <str<strong>on</strong>g>title</str<strong>on</strong>g> IIIfunds to each planning and service area.(d) Identificati<strong>on</strong> of the geographic boundaries of each planning and7
