was dependent upon agreeing with the subjective morality beliefs of their employer,came up with a list of morality <strong>and</strong> lifestyle qualifications.[188] In my view, in imposing an onus on an employer to show that a proposedqualification is reasonably necessary, section 24(1)(a) requires evidence that theemployer put its mind to the issue in a meaningful way, with a recognition that there isan obligation to consider the fundamental rights of others. In this case the evidenceshows that Christian Horizons took the dicta of Professor Mendes in Parks <strong>and</strong>embarked on an exercise designed to ensure that it would meet the section 24(1)(a)exemption if a challenge was raised in the future.2008 HRTO 22 (CanLII)[189] Is it reasonably necessary <strong>for</strong> a support worker employed in an organizationsuch as Christian Horizons to comply with a Lifestyle <strong>and</strong> Morality Statement, whichprohibits homosexual relationships <strong>and</strong> discriminates against gay <strong>and</strong> lesbianindividuals? The evidence be<strong>for</strong>e the Tribunal is equivocal on this point.[190] Christian Horizons is unique as an organization <strong>and</strong> as a provider of animportant service to a population with very particular <strong>and</strong> complex needs. The job ofbeing a support worker to individuals with developmental disabilities can be amongstthe most challenging in the social <strong>and</strong> health care services sectors. Seen from theperspective of being members of a religious ministry, Christian Horizons’ staff arerequired to exemplify Christ, <strong>and</strong> show Christian love in all they do <strong>and</strong> in all theirinteractions with the residents. Religious commitment is seen by the organization ascritical to both its approach to service delivery <strong>and</strong> to the carrying out of the jobresponsibilities. The evidence shows that this deep religious commitment is displayedin excellent service <strong>and</strong> loving care provided to the residents, as well as support <strong>for</strong> theirfamilies.[191] But unlike the circumstances in Garrod, Caldwell <strong>and</strong> Trinity Western, ChristianHorizons’ purpose, <strong>and</strong> the service it provides, is not religious education <strong>and</strong>indoctrination. The primary role of a support worker is not to help all residents to adopta Christian way of life, or to carry out a mission of salvation, or to convert residents to57
