Chapter 8: Moving OutExceptions for TenantsServing in the Armed ForcesIf you are enlisting, serving, orending your service in the armedforces or member of a NationalGuard, or a member of the PublicHealth Service assigned towork with the Army or Navy, youmay terminate your rental agreementwithout suffering a penalty,fee, or loss of deposit based onthat termination. You must provideyour landlord with proof ofofficial orders, and you must givenotice that is the later of: reporting date on orders foractive service; ends, in the case that you areterminating your are endingyour service with the armedforces (90.475)Additionally, if you are a stateservice member who is calledinto active service by the Governoryou may end a rentalagreement without a fee, penaltyor loss of deposit by giving writtennotice of 30 days after thenext rent payment is due, or thelast day of the month after themonth in which you give notice,whichever is earlier. You mustprovide proof of official ordersshowing you are a state servicemember. (90.472)Exceptions for Survivors ofDomestic Violence, SexualAssault or StalkingIf you are a survivor of domesticviolence, sexual assault or stalking,you may be able to terminateyour rental agreement with14 days notice without havingto pay a fee due to that termination.To give notice in this situation,provide your landlord withwritten notice that includes: the rental agreement; to end;and either: a valid order of protection(restraining order); or52<strong>Oregon</strong> Renters’ <strong>Handbook</strong>
