It is extremely riskyfor a landlord to try to use theabandoned property remedies tolock out a tenant.Recoveringthe PropertyThe tenant’s remedies vary withthe methods used in taking theproperty.Sheriff-Removed BelongingsThe tenant may recover some orall of the belongings by immediatelyfiling a Claim of Exemption(contained within a sheriff ’snotice). If any belongings arenot exempt, or even if no Claimof Exemption was filed, a tenantprobably may recover thebelongings by bidding at thesheriff ’s sale. Therefore, tenantsshould stay in touch with thesheriff ’s office to be informed ofthe time and place of the sale.Notice of Abandoned PropertyIf the tenant receives a noticefrom the landlord stating thatthe landlord considers the tenant’spersonal property to beabandoned, the tenant mustact to remove the property by aspecified date (no less than 15days after deliver of the notice),or the landlord may sell or disposeof the property.Landlord Storing PropertyThe Landlord may decide totake responsibility for the storageand disposition of a tenant’spersonal property after a sheriffhas removed a tenant underlegal order. The landlord’s noticeto the tenant must state that thetenant may pick up the property,by the specified deadline, withoutbeing charged removal andstorage costs.
