Chapter 9: Evictions And Other Landlord Remediesthe rental application within thepast year regarding a criminalconviction.These notices may beserved by “nail and mail”except the one for an illegal subtenant.(90.155(4)(a))Termination for “Drug andAlcohol Free Housing” Violation:The 48-Hour NoticeIf a tenant who has lived for lessthan 2 years in a certified drug andalcohol free housing violates theterms of the housing, the landlordmay deliver a 48-hour eviction notice,specifying the date and timethat the tenancy will end.The notice must state that thetenant can fix the violation within24 hours by changing conductor otherwise, in which case therental agreement will not end.If the same violation occurswithin 6 months, the landlordmay end the agreement with a24-hour written notice withoutgiving opportunity to fix theproblem again. (90.398)Illegal ActivityThe landlord must start theeviction process by a no-cause,for-cause, or 24-hour notice ifa tenant is involved in illegalactivity. (90.396) If a tenantis aware of illegal activity inthe premises, they should takesteps to notify the landlord andproper authorities. The tenantmay be considered part of theactivity unless they can provethey were trying to stop it.RetaliationMany tenants are hesitant totake actions to enforce theirrights because they fear that thelandlord will retaliate, either byevicting them, or by increasingrent or decreasing services(such as shutting off the power).The Act prohibits retaliatoryconduct, and retaliation mayserve as grounds for fighting aneviction.
