Development Assessment Panel Meeting Minutes 03 April 2012No person was heard by the Panel.P6829The Development Assessment Panel resolved that:1. The proposed development is not seriously at variance with the policies in theDevelopment Plan; and2. Development Application 180\0108\12, by City Of Burnside is grantedDevelopment Plan Consent subject to the following conditions:Conditions1. The development granted Development Plan Consent shall be undertaken inaccordance with the stamped approved plans, drawings, specifications andother documents submitted to the Council that are relevant to the consent to thereasonable satisfaction of the Council, except where varied by conditionsbelow.Reason:To ensure the development is undertaken in accordance with the plans anddetails submitted.2. The removal of the regulated tree shall be subject to the planting of tworeplacement trees in a suitable position greater than 10m distance from anyexisting dwelling or in-ground swimming pool. The replacement trees must beindigenous to the local area, not be an exempt species listed under regulation6A clause (5)(b) of the Development Regulations 2008, or a tree belonging to aclass of plant declared by the Minister under Chapter 8 Part 1 of the NaturalResources Management Act 2004. In accordance with the written confirmation received on behalf of the owner ofthe land, namely an email from the owner’s agent Mr Chris Vounassis ofConnor Holmes, dated 15 March 2012, forming part of the documentationsubmitted to the Council in relation to this application, the owner shall enter intoa Land Management Agreement with Council regarding the future developmentof the land in the terms agreed between the parties as set out in the draft LandManagement Agreement, as revised on or about 06 March 2012 and the ownershall note the said agreement against the Certificate of Title to the land prior tothe Council advising the Development Assessment Commission that acertificate may be issued pursuant to Section 51 of the Development Act 1993.Reason:To ensure the Land Management Agreement is entered into and registeredagainst the created Certificates of Title.3. The financial requirements of SA Water shall be met for the provision of watersupply and sewerage services.• For further processing of this application by SA Water, to establish the fullrequirements and costs of development, the developer will need to adviseSA Water of their preferred servicing option.
