女 士 及 鄒 美 珠 女 士 亦 在 警 察 訓 練 學 校 的 模 擬 法 庭練 習 擔 任 導 師 。私 人 執 業 的 大 律 師 及 律 師 以 按 日 外 判 形 式 , 為 本科 擔 任 裁 判 法 院 的 檢 控 工 作 。 聘 用 外 判 律 師 在 裁判 法 院 擔 任 檢 控 工 作 , 目 的 有 二 :a) 在 法 庭 檢 控主 任 缺 乏 檢 控 人 手 時 , 提 供 所 需 的 專 業 法 律 服務 ; 以 及 b) 履 行 承 諾 , 為 只 有 少 許 甚 或 全 無 檢 控經 驗 的 年 輕 大 律 師 及 律 師 提 供 機 會 , 讓 他 們 掌 握所 需 的 技 能 。 資 深 的 法 庭 檢 控 主 任 憑 著 多 年 在 裁判 法 院 的 檢 控 經 驗 , 會 盡 力 協 助 新 晉 律 師 在 裁 判官 席 前 進 行 檢 控 。 刑 事 檢 控 科 致 力 為 新 晉 律 師 提供 檢 控 機 會 , 並 引 進 了 一 連 串 新 措 施 以 推 動 這 個目 標 。 沒 有 法 庭 檢 控 主 任 的 長 期 配 合 和 協 助 , 這些 措 施 恐 怕 推 行 不 了 。本 司 亦 鼓 勵 法 庭 檢 控 主 任 考 取 法 律 專 業 資 格 , 以提 高 其 專 業 水 平 。 目 前 , 共 有 5 名 法 庭 檢 控 主 任修 讀 法 學 士 課 程 。 要 順 利 完 成 法 學 士 課 程 , 必 須努 力 不 懈 、 堅 毅 不 拔 , 他 們 的 努 力 , 實 在 值 得 讚賞 。 多 年 以 來 , 越 來 越 多 法 庭 檢 控 主 任 修 畢 法 律課 程 。 部 分 人 員 更 完 成 大 律 師 實 習 期 或 律 師 實 習期 , 取 得 法 律 專 業 資 格 。 在 97 名 法 庭 檢 控 主 任中 ,6 人 是 獲 認 許 的 大 律 師 ,2 人 是 獲 認 許 律 師 ,以 及 47 人 取 得 了 法 律 學 位 。 在 2009-2010 年 ,本 司 給 予 法 庭 檢 控 主 任 梁 嘉 琪 女 士 全 薪 進 修 假期 , 以 資 助 她 完 成 法 學 專 業 證 書 課 程 。 梁 女 士 於2010 年 在 本 司 擔 任 見 習 律 政 人 員 , 以 完 成 其 大 律師 實 習 期 , 並 快 將 成 為 獲 認 許 大 律 師 。 本 司 會 繼續 實 行 這 個 資 助 計 劃 , 以 鼓 勵 法 庭 檢 控 主 任 考 取專 業 資 格 , 從 而 為 香 港 市 民 提 供 更 良 好 的 服 務 。法 庭 檢 控 主 任 林 素 芳 女 士 , 高 級 二 等 法 庭 檢 控 主 任 羅 嘉 麗 女 士 及 鄭 德 英 先 生 接 過 升 級 信 。Ms Irene Lam, CP, Ms Cora Lo, SCPII and Mr Edmund Cheng, SCPII receiving their promotion letters.number of senior court prosecutors, namely MrGeorge Man, Mr Vincent Lee, Ms Cora Lo, MsAngela Man, and Ms Lily Ho, volunteered theirtime to lecture and share their experienceswith other departmental prosecutors. Theirlectures covered practical and legal issuessuch as problems commonly encounteredin prosecuting cases in the Magistrates’Courts; techniques in collating evidence andtaking cautioned statements; and ways toimprove liaison with court prosecutors. Seniorcourt prosecutors Ms Fanny Tang and MsConstance Chow also participated as trainersin mock court exercises for police trainingschools.Barristers and solicitors from the private sectorconducted cases for the prosecution on fiat inthe Magistrates’ Courts on a daily basis. Thepurpose of engaging fiat counsel was two-fold.First, it supplied important additional manpowerto enable the work of our court prosecutors.Secondly, it provided valuable opportunitiesto relatively inexperienced barristers andsolicitors to work alongside our experiencedsenior court prosecutors. The ProsecutionsDivision is committed to providing prosecutingopportunities to newly admitted lawyers andhas introduced a number of new initiatives tothis end. Such new initiatives would not bepossible without the continued support andassistance of our court prosecutors.The Department has always encouragedcourt prosecutors to attain legal qualificationsto enhance their professionalism. Currently,five court prosecutors are undertaking parttimeLLB courses. It requires a lot of work andperseverance to successfully complete the LLBcourse and their efforts are to be applauded.Throughout the years, more and more courtprosecutors have completed their legalstudies. Some have even completed theirpupillage or traineeship and become legallyqualified. Amongst the 97 court prosecutors,six were called to the bar, two were admittedas solicitors and 47 have obtained lawdegrees. From 2009 to 2010, the Departmentsponsored Ms Karen Leung to complete herPostgraduate Certificate in Law course bygiving her full-time paid study leave. Ms Leungthen joined the Department to complete herpupillage and has now qualified as a barrister.The Department will continue the sponsorshipprogramme with a view to support courtprosecutors in developing their careers and tobetter serve the people of Hong Kong.57
