T<strong>he</strong> young man, now 20 years old, can’t be named underprovisions of t<strong>he</strong> Youth Criminal Justice Act because <strong>he</strong> was 17 at t<strong>he</strong> time of t<strong>he</strong> first offence.W<strong>he</strong>n contacted <strong>by</strong> T<strong>he</strong> StarPhoenix on Thursday, Andres said <strong>he</strong> didn’t want to comment. “I didn’teven know t<strong>he</strong> case was going on (in court today),” <strong>he</strong> said.No criminal charges have been laid against Andres and Salte said t<strong>he</strong> college had not received acomplaint against Andres.In court, Crown prosecutor Frank Impey described t<strong>he</strong> case relating to Joe.On one occasion, Andres visited Joe’s apartment and engaged in a “serious sexual act,” said Impey.However, Joe’s girlfriend — who was also at t<strong>he</strong> apartment — grabbed a camera and took a photo ofJoe and t<strong>he</strong> <strong>doctor</strong>, after which t<strong>he</strong> <strong>doctor</strong> ran out of t<strong>he</strong> apartment.That encounter happened sometime prior to Feb. 20, 2010, which is w<strong>he</strong>n Joe and his girlfriend metAndres at a mall in t<strong>he</strong> city w<strong>he</strong>re t<strong>he</strong>y agreed to hand over t<strong>he</strong> photograph in exchange for him buyinga number of items for t<strong>he</strong>m such as a computer and iPod.Andres reported t<strong>he</strong> incident to police, but didn’t tell t<strong>he</strong>m about t<strong>he</strong> background to t<strong>he</strong> story.T<strong>he</strong>re was no furt<strong>he</strong>r contact between Joe and Andres until November 2010, w<strong>he</strong>n Joe, his girlfriendand a third person confronted Andres outside his clinic. T<strong>he</strong>y forced him into his Lexus and stole hismedical bag. During t<strong>he</strong> scuffle, Andres was dragged on t<strong>he</strong> pavement and suffered some scratc<strong>he</strong>s.T<strong>he</strong> medical bag contained Andres’s wallet, which t<strong>he</strong> trio stole. Andres again went to police“This is w<strong>he</strong>n Dr. Andres ’fesses up to what happened in February,” said Impey.Andres admitted t<strong>he</strong> sexual encounter to police. Although Joe later told police t<strong>he</strong>re had been multiplesexual encounters, Andres admitted only to t<strong>he</strong> one incident.Police traced t<strong>he</strong> use of Andres’s credit card. It was used at London Drugs to buy a laptop and iPodand at McGuire’s to buy alcohol. It was also used at a <strong>Saskatoon</strong> hotel to rent two rooms for a week.W<strong>he</strong>n police went to t<strong>he</strong> hotel, t<strong>he</strong>y found Joe and his girlfriend in one of t<strong>he</strong> rooms. T<strong>he</strong> third person,who had been staying in t<strong>he</strong> ot<strong>he</strong>r room, wasn’t located.Both Joe and his girlfriend were arrested and charged. T<strong>he</strong> girlfriend, who also can’t be namedbecause s<strong>he</strong> was a youth at t<strong>he</strong> time of t<strong>he</strong> offence, was sentenced previously in youth court for <strong>he</strong>rrole in t<strong>he</strong> incidents. Because Joe turned 18 prior to November 2010, <strong>he</strong> was charged as a youth fort<strong>he</strong> first extortion offence and as an adult for t<strong>he</strong> later t<strong>he</strong>ft and assault.He was released from custody and his sentencing was set for Feb. 13 this year, but Joe didn’t come tocourt that day and a warrant was issued for his arrest. Joe had fled to Montreal, Impey said. Joe wasarrested in Montreal in June and has been in custody since t<strong>he</strong>n awaiting his sentencing.T<strong>he</strong> Crown and defence jointly recommended an 18-month conditional sentence on t<strong>he</strong> adult matters,“considering all of t<strong>he</strong> circumstances” around t<strong>he</strong> offences, said Impey.Defence lawyer Deb Hopkins said in court Thursday Joe came to Canada from Colombia and w<strong>he</strong>n <strong>he</strong>arrived in <strong>Saskatoon</strong> was looking for a <strong>doctor</strong>.Joe had a very traumatic childhood, Hopkins said. Both his parents were murdered <strong>by</strong> governmentforces in his home country — his fat<strong>he</strong>r w<strong>he</strong>n Joe was six years old and his mot<strong>he</strong>r w<strong>he</strong>n Joe was 13years old. He was furt<strong>he</strong>r traumatized <strong>by</strong> t<strong>he</strong> incident with Andres, s<strong>he</strong> said.“It’s very sad circumstances (Joe) found himself in,” s<strong>he</strong> said.Judge Donna Scott said t<strong>he</strong> case “certainly” involved unique circumstances, noting Joe came toCanada for a more secure life only to be taken advantage of <strong>by</strong> his family <strong>doctor</strong>.However, Scott said t<strong>he</strong> charges against Joe were of a serious nature so a jail sentence wasappropriate, albeit one that will be served in t<strong>he</strong> community.
