Saskatoon doctor blackmailed by patient he allegedly had sex with14/08/12 8:00 PMSaskatoon doctor blackmailed by patient he allegedlyhad sex withBY HANNAH SPRAY, THE STARPHOENIX AUGUST 10, 2012The College of Physicians and Surgeons of Saskatchewan says it will look into the case of a doctor who allegedly had sex with a17-year-old patient.Photograph by: Joe Raedle, Getty ImagesThe College of Physicians and Surgeons of Saskatchewan says it will look into the case of a doctorwho allegedly had sex with a 17-year-old patient.The allegation came to light in Saskatoon provincial court when the young man was sentenced forblackmailing the doctor.“That (sexual relations) is a very, very serious allegation which, if proven, is likely to result in aphysician’s loss of their ability to practise medicine,” said Bryan Salte, the college’s associate registrar,when contacted about the court case.However, Salte noted there would be a difference in how the college would approach an incident thatinvolved a current patient versus one that involved a former patient. “The perspective on a sexualrelationship with a former patient is less clear and more nuanced,” he said.On Thursday, a young man, “Joe,” pleaded guilty to extortion, theft and assault in relation to Dr.Salvador Andres, a Saskatoon family doctor. The young man, now 20 years old, can’t be named underprovisions of the Youth Criminal Justice Act because he was 17 at the time of the first offence.When contacted by The StarPhoenix on Thursday, Andres said he didn’t want to comment. “I didn’teven know the case was going on (in court today),” he said.No criminal charges have been laid against Andres and Salte said the college had not received acomplaint against Andres.In court, Crown prosecutor Frank Impey described the case relating to Joe.On one occasion, Andres visited Joe’s apartment and engaged in a “serious sexual act,” said Impey.However, Joe’s girlfriend — who was also at the apartment — grabbed a camera and took a photo ofJoe and the doctor, after which the doctor ran out of the apartment.That encounter happened sometime prior to Feb. 20, 2010, which is when Joe and his girlfriend metAndres at a mall in the city where they agreed to hand over the photograph in exchange for him buyinga number of items for them such as a computer and iPod.Andres reported the incident to police, but didn’t tell them about the background to the story.There was no further contact between Joe and Andres until November 2010, when Joe, his girlfriendand a third person confronted Andres outside his clinic. They forced him into his Lexus and stole hismedical bag. During the scuffle, Andres was dragged on the pavement and suffered some scratches.The medical bag contained Andres’s wallet, which the trio stole. Andres again went to police“This is when Dr. Andres ’fesses up to what happened in February,” said Impey.Andres admitted the sexual encounter to police. Although Joe later told police there had been multiplesexual encounters, Andres admitted only to the one incident.Police traced the use of Andres’s credit card. It was used at London Drugs to buy a laptop and iPodand at McGuire’s to buy alcohol. It was also used at a Saskatoon hotel to rent two rooms for a week.When police went to the hotel, they found Joe and his girlfriend in one of the rooms. The third person,who had been staying in the other room, wasn’t located.Both Joe and his girlfriend were arrested and charged. The girlfriend, who also can’t be namedbecause she was a youth at the time of the offence, was sentenced previously in youth court for herrole in the incidents. Because Joe turned 18 prior to November 2010, he was charged as a youth forthe first extortion offence and as an adult for the later theft and assault.He was released from custody and his sentencing was set for Feb. 13 this year, but Joe didn’t come tocourt that day and a warrant was issued for his arrest. Joe had fled to Montreal, Impey said. Joe wasarrested in Montreal in June and has been in custody since then awaiting his sentencing.The Crown and defence jointly recommended an 18-month conditional sentence on the adult matters,“considering all of the circumstances” around the offences, said Impey.Defence lawyer Deb Hopkins said in court Thursday Joe came to Canada from Colombia and when hearrived in Saskatoon was looking for a doctor.Joe had a very traumatic childhood, Hopkins said. Both his parents were murdered by governmentforces in his home country — his father when Joe was six years old and his mother when Joe was 13years old. He was further traumatized by the incident with Andres, she said.“It’s very sad circumstances (Joe) found himself in,” she said.Judge Donna Scott said the case “certainly” involved unique circumstances, noting Joe came toCanada for a more secure life only to be taken advantage of by his family doctor.However, Scott said the charges against Joe were of a serious nature so a jail sentence wasappropriate, albeit one that will be served in the community.
