Risk assessment of new psychoactive substances: operating guidelinesprovided. Thus, a description of various types of measures could be included(see box below).Examples of types of measures• Prevention/education• Legally bound labelling• Establishing an age limit for users• Active monitoring• Intervention in production chain (precursors)• Legislation on medicines, poisons, food or consumer products• Control measures in accordance with 1961 and 1971 UN conventions(g) Options for control and possible consequences of the control measuresUnder Article 9.1 of the Decision, the available control options are for the MemberStates to submit a new psychotropic substance to control measures and criminalpenalties, as provided under their legislation, by virtue of their obligations underthe 1971 United Nations Convention on Psychotropic Substances or the 1961United Nations Single Convention on Narcotic Drugs. However, Article 6.4 (g)requires the Risk Assessment Report to include the options for control and thepossible consequences of the control measures.In assessing the possible consequences of control measures, it is appropriate toexamine a range of control models (e.g. administrative or public health regulatoryframeworks for alcohol, tobacco, medicines or poisons). The assessment shouldexamine the consequences of different control options on the factors listed in thefollowing box.40
Elements for examining the consequences of control options• Production, trafficking and organised crime• Distribution and availability• Quality and price of the substance on the market• Impact on the market and on the use of other substances (including thelikelihood of alternative new substances emerging)• Prevalence and patterns of use of the substance• Health consequences• Social consequences• Other uses of the substance in pharmaceutical research, medicine, industry,trade, etc.• Existing legislation, law enforcement, judicial and other control systems• Specific cost implications (e.g. additional costs of product testing or forensicanalysis)(h) Chemical precursors used within the manufacturing processInformation on the chemical precursors that are used for the manufacture of thesubstance should be provided. Such information may come from analyses ofchemicals found at production sites or from the literature.
