Contract Call Centres Award 2010 (MA000023)to the employee, a sum equal to the annual leave granted in advance less anyamounts subsequently accrued.27.7 Annual close-downNotwithstanding s.33 of the NES, an employer may close down an establishment orsection or sections, for the purpose of allowing annual leave to all or the majority ofthe employees concerned, provided that:(a)(b)(c)(d)(e)the employer gives at least one month’s notice to the affected employees. Thenotice must advise employees of the commencement date and duration of theclose-down;an employer may close down for one or two periods;an employer and the majority of employees concerned may agree to closedown for more than two periods;an employee who has accrued sufficient leave to cover the period of the closedown,is allowed leave and also paid for that leave at the appropriate wage inaccordance with clauses 27.3 and 27.4; andan employee who has not accrued sufficient leave to cover part or all of theclose-down, is allowed paid leave for the period for which they have accruedsufficient leave and given unpaid leave for the remainder of the close-down.28. Personal/carer’s leave and compassionate leavePersonal/carer’s leave and compassionate leave are provided for in the NES.29. Community service leaveCommunity service leave is provided for in the NES.30. Public holidays30.1 Public holidays are provided for in the NES.30.2 Public holidays which fall on a weekend(a)(b)(c)Where Christmas Day falls on a Saturday or a Sunday, 27 December will beobserved as the public holiday instead of the prescribed day.Where Boxing Day falls on a Saturday or a Sunday, 28 December will beobserved as the public holiday instead of the prescribed day.Where New Year’s Day or Australia Day falls on a Saturday or a Sunday, thefollowing Monday will be observed as the public holiday instead of theprescribed day.MA000023 This award does not come into force until 1 January 2010 31
