National contact points are called upon to provide, in close cooperation with other national authorities, information to patients, particularly on cross-border healthcare and the “guarantees of quality and safety”. These contact points are to help patients protect their rights and seek appropriate redress in the event of harm. In addition, the EU requires the Member States to facilitate the development of European reference networks intended to help realize the potential of European cooperation regarding highly specialized healthcare for patients and for healthcare systems from innovations in medical science and health technologies. In addition, the networks are intended to “help to promote access to high quality and cost-effective healthcare for all patients with a medical condition requiring a particular concentration of resources or expertise” and to promote the effective use of resources by concentrating them where appropriate. What does this mean? Will there be a European policy of subsidies supporting centralized structures within the EU, comparable with the agricultural sector? Even if the objective were merely to provide quality and safety references that assist member states to “provide a full range of highly specialized services of the highest quality”, it is easy to imagine the type of regulatory machinery this would entail. The same is true of the development and operation of a network for health technology assessment, which the European Commission wants to require of the Member States. The requirement to collect statistical data needed for monitoring purposes on the provision of cross-border healthcare, the care provided, its providers and patients, the cost and the outcomes (!) and to provide them to the European Commission on an annual basis already afford a glimpse of the new bureaucracy about to be born. Introduction of quality standards It has been estimated that approximately one percent of all Europeans currently obtain cross-border health services, not including those who require treatment on holidays or while working in a different EU Member State. This cost is borne by the national health care systems anyway, and the corresponding rules go back to as far as 1971 (Regulation 1408/71/ EEC), as symbolized by the E 111 form or the European health insurance card. It appears doubtful that such comprehensive requirements encased in a Directive, dealing with issues as diverse as patient information, national contact points, European reference centres, information technology or statistics, should really be necessary. However, Community institutions are given broad discretion when it comes to applying a high level of protection. Quite adroitly, the draft Directive would require the Member States to introduce, e.g., certain quality standards, with the European Commission restricting itself to “merely” issuing guidelines. Obviously, the intention is to resolve the contradiction between the sovereignty of the Member States in the healthcare sector on one hand and the common market strategy of the EU on the other – a path that may be juridically feasible but may well prove politically difficult. Conclusions The Patients’ Rights Directive not only determines that patients may obtain cross-border inpatient and outpatient medical (elective) services, largely without prior authorization by the national administrations or health insurance institutions in their home countries, and that they may demand reimbursement for these services from their home social security system. If the proposed Directive were to be enacted by the European Parliament, the national healthcare systems would be increasingly harmonized, since the Member States would be obliged to cooperate and to implement EU healthcare to a larger extent than previously. They would ultimately have to adapt their healthcare policy to the European regime – subsidiarity or no subsidiarity. What seems to be so problematic is that Europe is not moving in the direction of liberalization but instead seems to seek redemption by regulation – in a manner similar to the national healthcare systems. This is just what we feared when the European Parliament decided to exclude healthcare services from the scope of the general Services Directive in 2006. We can look forward to the discussions within the European Parliament and the European Council over the next few months regarding the European Commission’s new approach to regulating healthcare services. Should the Directive fail, the verdict by the ECJ prevails: Free movement of services includes healthcare services – no restrictions allowed. Brussels
