The <strong>Board</strong> foundMs. Shaffer in violation <strong>of</strong> several articles <strong>of</strong> WV Code, i.e., fraud,misrepresentation <strong>of</strong> services rendered, etc.Disciplinary Action: July 19, 2010 – Consent Decree SignedLicense suspended for a period <strong>of</strong> twelve (12) months – the suspension wasstayed and Ms. Shaffer was placed on probation for a period <strong>of</strong> one (1) year.During the probation period, she must comply as follows:- Rescind charges from the patient file for evaluations charged in April,May, and June, 2009- Cease and desist the practice <strong>of</strong> billing for two services on the samedate unless two services are provided and documented- Obtain two (2) hours <strong>of</strong> Continuing Education in the area <strong>of</strong> Ethicsduring the 2010-2012 licensing period.Case #31: - Not reportable to NPDBComplainant: Charles A. MordecaiDate: January 7, 2010Name <strong>of</strong> Licensee: Rene’ Donley, AudiologistNature <strong>of</strong> Complaint: Fraudulent information documented in his records. Patientclaims he as been previously diagnosed with vertigo by other doctors and istrying to get VA Disability Compensation. The diagnosis <strong>of</strong> vertigo is not in Mr.Mordecai’s VA medical records and he is claiming Dr. Donley purposely falsifiedhis records. Rene’ Donley’s response does not support the diagnosis <strong>of</strong> vertigoand claims the examination requested from VA Administration in Huntington, WVwas for Meniere’s Syndrome. The examination was a Compensation andPension Evaluation – not a medical examination but an administrative evaluationrequested by VA, Huntington, WV and standard VA protocol must be followed.The case against Dr. Rene’ Donley was dismissed. The <strong>Board</strong> is withoutjurisdiction to decide matters concerning VA compensation and pensionevaluation rules, regulations and procedures.
