Case #32: - Reported to NPDB 08/06/2010Complainant: WV Board of Speech and AudiologyDate: June 24, 2010Name: Lisa Ann Bosley, P/SLP-0225Nature of complaint: Discovered through the standard verification process, Ms.Bosley had been practicing without a license since January, 2002. She hadforged license documents and ASHA certification cards since January 4, 2002when her provisional license expired. She did not apply or receive a professionallicense to practice Speech-Language Pathology in the State of WV.Disciplinary Action: Since Ms. Bosley was practicing without a valid license, theWV Board does not have jurisdiction. A Cease and Desist letter was sent to Ms.Bosley on June 25, 2010 and all documents relating to the case were turned overto the WV State Police for investigation.U.S. Attorney’s Office prosecuted. Plea agreement reached – sentenced onApril 27, 2012. 5 Years Probation - $240,000 in restitution to GenesisRehabilitation Corp. @ $50 per month.Case #33 – Reported to NPDB 09/16/2011Complainant: WV Board of Speech and AudiologyNature of complaint: Unlicensed provisional (CFY) practiceName: Holly Hitt, SLP-1281The Board found Ms. Hitt to be in violation of WV Code and WV Code Rules bypracticing without a Provisional SLP License from June 21, 2010 thru September8, 2010.Ms. Hitt is in violation of WV Code §§30-32-17 (b)(4), (b)(9) and (b)(13), and WVCode Rule §§29-5-2.6.a.1 and 2.7.b.2Some leniency was given to Ms. Hitt for the following reasons:- Completed her Clinical Fellowship Year in the Kanawha County, WVschool system; WV licensure is not a requirement in the school system- Even though, she advised her employer that she did not have aprofessional license and was waiting for her CCC and would thenapply, the employer told her she could see patients and they wouldhave a licensed SLP co-sign her evaluations, treatments, etc.-Disciplinary Action: August 26, 2011 – Consent Decree SignedLicense # SLP-1281 – Letter of Reprimand valid for one (1) year and will beexpunged after the designated timeframe has expired. The following additionalrequirements also apply:- Complete a Board approved Ethics Seminar/Course in addition to thetwenty (20) Continuing Education Requirements for license renewal in2012. Completion of the course will be completed within ninety (90)days.- Write an article regarding experiences with the West Virginia licensingprocess; to include the importance of knowing the Legislative Lawsand Rules that regulate the Speech-Language Pathology professionaland the likely repercussions if ignored.- Pay a fine of $250.00
Case #34 – Reported to NPDB 09/15/2011Complainant: WV Board of Speech and AudiologyNature of complaint: Supervision and co-signing of unlicensed provisional (CFY)services providedName: Marianne LeDonne, SLP-0157The Board found Ms. LeDonne to be in violation of several articles of WV Codeand WV Code Rules, i.e., 1)aiding and abetting unlicensed practice, 2)fraud anddeceit, 3)dishonorable, immoral or unprofessional conduct, 4)”engage in anyscheme or artifice to defraud in connection with obtaining payment orreimbursement for services.” 5)dishonesty, fraud, deceit, misrepresentation, orany form of conduct that adversely reflects on the profession.Ms. LeDonne co-signed documents for evaluations, treatments, etc. provided byan unlicensed provisional Speech-Language Pathologist.Ms. LeDonne is in violation of the WV Code§§30-32-17 (b)(4). (b)(5), (b)(9) and(b)(13) and WV Code Rule §§29-5-2.6a.3 and 2.7.b.2.Disciplinary Action: August 22, 2011 – Consent Decree SignedLicense #SLP-0157 placed on probation for a period of two (2) years with thefollowing additional requirements:- Shall not provide supervision of, including but not limited to,CFY/Provisional licensees or speech assistants for a period of two (2)years.- Shall inform employer(s) of the probationary status of her Speech-Language Pathology license and show proof of the same to the Board.- Shall provide documentation to the Board of formal training insupervision- Shall provide quarterly self-reports to the Board- Pay a fine of $500.00Case #35 – DismissedComplainant: Mark HalburnNature of complaint: Patient had to wait ½ hour to be seen. Left without examand says was refused an appointment later in the day.Name: Gregory Simmerman, A-0062The Board dismissed this case for lack of probable cause.
