Some leniency was given to Ms. MCCullough for the following reasons:- Information received from her SLP supervisor was incorrect. Thesupervisor, who is licensed in PA and WV, thought a Clinical Fellowworked under the supervisor’s license. This is true in PA but aprovisional license is required in WV. Even though, the <strong>Board</strong> foundfault with Ms. McCullough, they felt the biggest part <strong>of</strong> the culpabilitywas the supervisor’s.- Ms. McCullough completed her Clinical Fellowship Year and receivedher CCC from ASHA. Because she received her CCC, per our Lawand Rules her pr<strong>of</strong>essional license was granted on January 9, 2012.-Disciplinary Action: February 29, 2012 – Consent Decree SignedLicense # SLP-1358 –- Letter <strong>of</strong> Reprimand valid for one (1) year, to be expunged after thedesignated timeframe has expired. The following additionalrequirements also apply:- Complete a <strong>Board</strong> approved Ethics Seminar/Course in addition to thetwenty (20) Continuing Education Requirements for license renewal in2012. Completion <strong>of</strong> the course will be completed within ninety (90)days.- Write an article regarding experiences with the <strong>West</strong> <strong>Virginia</strong> licensingprocess; to include the importance <strong>of</strong> knowing the Legislative Lawsand Rules that regulate the <strong>Speech</strong>-<strong>Language</strong> <strong>Pathology</strong> pr<strong>of</strong>essionaland the likely repercussions if ignored.- Pay a fine <strong>of</strong> $500.00Case #37 – Reported to the NPDB 06/01/2012Complainant: WV <strong>Board</strong> <strong>of</strong> <strong>Speech</strong> and AudiologyNature <strong>of</strong> Complaint: Supervision and co-signing <strong>of</strong> unlicensed provisional (CFY)services provided.Name: Joseph Louis Garcia, SLP-1301The <strong>Board</strong> found Mr. Garcia to be in violation <strong>of</strong> several articles <strong>of</strong> WV Code andWV Code Rules, i.e., 1)aiding and abetting unlicensed practice, 2)fraud anddeceit, 3)dishonorable, immoral or unpr<strong>of</strong>essional conduct, 4)”engage in anyscheme or artifice to defraud in connection with obtaining payment orreimbursement for services.” 5)dishonesty, fraud, deceit, misrepresentation, orany form <strong>of</strong> conduct that adversely reflects on the pr<strong>of</strong>ession.Mr. Garcia co-signed documents for evaluations, treatments, etc. provided by anunlicensed provisional <strong>Speech</strong>-<strong>Language</strong> Pathologist.Mr. Garcia is in violation <strong>of</strong> the WV Code§§30-32-17 (b)(4). (b)(5), (b)(9) and(b)(13) and WV Code Rule §§29-5-2.6a.3 and 2.7.b.2.Disciplinary Action: May 7, 2012 – Consent Decree SignedLicense #SLP-1301 placed on probation for a period <strong>of</strong> two (2) years with thefollowing additional requirements:- Shall not provide supervision <strong>of</strong>, including but not limited to,CFY/Provisional licensees or speech assistants for a period <strong>of</strong> two (2)years.
- Shall inform employer(s) <strong>of</strong> the probationary status <strong>of</strong> his <strong>Speech</strong>-<strong>Language</strong> <strong>Pathology</strong> license and show pro<strong>of</strong> <strong>of</strong> the same to the <strong>Board</strong>.- Shall provide documentation to the <strong>Board</strong> <strong>of</strong> formal training insupervision- Shall provide quarterly self-reports to the <strong>Board</strong>- Pay a fine <strong>of</strong> $500.00Case #38 – Not reportable to NPDBComplainant: Mr. Eric GrandonName <strong>of</strong> Licensee: Peter Americo, <strong>Speech</strong>-<strong>Language</strong> PathologistNature <strong>of</strong> Complaint: The complainant was a physical therapy assistant workingfor the respondent in the Rehab Dept. <strong>of</strong> an area medical center. Because <strong>of</strong> anextended illness due to a disability, he job was not held open for him but heclaimed he was subjected to continuous harassment and adverse terms andconditions <strong>of</strong> employment.The case against Mr. Americo was dismissed March 29, 2012. The <strong>Board</strong> iswithout jurisdiction to decide matters concerning employee/employer matters,employment and/or discrimination.
